4. On or about March 24. 1999, Respondent issued a Notice of
Proposed Action to Suspend Petitioner's motor vehicle privileges under ~ 1535 of
the Motor Vehicle Code (passing a stopped school bus).
S. This action was based upon apparent notice received from the Office
of District Justice Joseph S. Solomon, District Court Number 12-1-03, Docket
Number TR-0000782-99. A copy of said March 24, 1999, notice is attached
hereto as Exhibit "An and is incorporated by reference herein.
6. This notice is in error because:
A. Petitioner did not in fact plead guilty by sending in the ticket
and paying the set amount; rather, the District Justice rejected her
submission because of an improper amount of payment had been made.
B. Thereupon Petitioner paid the proper amount to District
Justice Solomon after learning that she needed additional monies to apply
towards a hearing, The District Justice thereupon directed a hearing for
April 12, 1999.
C. On April 12, 1999, Petitioner, with counsel, appeared for a
hearing, The hearing was dismissed for failure to prosecute on the part of
the Commonwealth,

As mandated under SectiDn 1535 Df the Vehicle CDde, a
60 DAY(S) suspensiDn is hereby impDsed.
In Drder tD cDmply with this sanctiDn YDU are required tD
return any current driver's license, 'learner's permit and/Dr
temPDrary driver's license (camera card) in YDur PDssessiDn
nD later than the effective date listed. If YDU cannDt
cDmply with the requirements stated abDve, YDU are required
tD submit a DL16LC FDrm Dr a SWDrn affidavit stating that
YDU are aware Df the sanctiDn against your driving privi-
lege. Failure tD cDmply with this notice shall result in
this Bureau referring this matter to the PennSYlvania State
PDlice fDr prDsecutiDn under SECTION 1571(a)(4) Df the Ve-
hicle CDde.
AlthDugh the law mandates that !IOllr drivinll privilege is
under suspensiDn even if you do nDt surrender your license,
Cf"edit will nDt begin until all current driver' s license
product(s), the DL16LC FDrm, or a letter acknDwledging YDUr
sanctiDn is received in this Bureau.
WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGE-
MENT, WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS
RECEIPT WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY.
OTHERWISE, YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS
SANCTION.
The effective date of suspension is 04/28/1999, 12:01 a.m.
