I. 7tJe prior Order of this Court dated July 6, 1999 is vacated and
replaced with this Order.
2. The Mother, Katherine E. Smith, and the Father, Bart W. Smith,
shall have shared legal custOdy of Claire R. Smith, born July 13, 1987.
Each parent shall have an equal right, to be exercised jointly with the
other parent, to make all major non-emergency decisions affecting the
Child's general well-being including, but not limited to, all decisions
regarding her health, education and religion. The parties shall consult
with each other and cooperate in scheduling ongoing activities for the
Child.
3. The parties shall share having physical custody of the Child during
the school year as follows:
A. 7tJe parties shall alternate having custody of the Child on
weekends from Friday at 6:00 p.m. through Sunday at 6:00 p.m.
B. The Mother shall have custody of the Child every week on
Monday, Tuesday, Wednesday and Friday from 7:00 a.m., when the
Mother shall piCk up the Child before school until 4:00 p.m.
C. The Mother shall have custOdy of the Child every Wednesday
evening from 6:00 p.m. until 9:00 p.m.
D. During weeks fOllowing the Father's periods of weekend custody,
the Mother shall have custody of the Child on Monday from after
school until 6:00 p.m.
E. The Father shall have custody of the Child at all times not
otherwise specified in this provision for the Mother.
F. The parties shall cooperate in adjusting the regular custody
schedule to accommodate the Child's needs and preferences as
the parties agree is in the Child's best interest.
G. In the event the Father takes time off from work on a weekday
or weekdays when the Child does not have school due to an
in-service day or other holiday not otherwise addressed in this
Order, the parties shall equally share having physical custOdy
of the Child.
4. The parties shall share or alternate having custOdy of the Child
on holidays as follows:
A. CllRIS'l1lAS: In every year, the Mother shall have custOdy of the
Child from 7:00 a.m. until lO:oo p.m. on Christmas Eve and the
Father shall have custody of the Child from lO:oo p.m. on
Christmas Eve through lO:OO p.m. on Christmas Day.
B. EASl'IlR: In every year, the Mother shall have custody of the
Child on the Saturday before Easter from 3:00 p.m. until lO:oo
p.m. and the Father shall have custOdy of the Child from lO:oo
p.m. on the Saturday before Easter through Easter Sunday.
C. REMAINING HOLIDAYS: Unless the parties agree otherwise,
custOdy arrangements for the remaining holidays, including
Thanksgiving, Memorial Day, July 4th, Labor Day, Mother's Day
and Father's Day shall follow the regular custOdy schedule.
D. EXTmlDED SCOOOL BREAKS: In the event the Father takes off days
from work during the Child's Christmas and Spring breaks from
school, the parties shall equally share having custody of the
Child.
5. Each party shall be entitled to have custody of the Child for 2
weeks each summer (to be scheduled non-consecutively unless otherwise
agreed between the parties), upon providing 60 days advance notice to the
other party. Each party shall schedule the extended periods of custody
under this provision to include his or her regular weekend period of
custody .
6. Neither party shall interfere with or prevent the Child from
contacting the other party by telephone.
7. 7tJis Order is entered pursuant to an agreement of the parties at a
Custody conciliation Conference. The parties may modify the provisions of
this Order by mutual consent. In the absence of mutual consent, the terms
of this Order shall control. -,
