WALTERS, III, ESQUIRE, brings this action in divorce for a Decree of Divorce from the bonds of matrimony and respectfully represents: 1. The plaintiff is RONALD L. GATES, an adult individual, who currently resides at 2409 Rye Circle, Mechanicsburg, Cumberland County, Pennsylvania. 2. The defendant is JIM'{ GATES, an adult individual, who currently resides at 2201-B Cedar Run Drive, Camp Hill, Cumberland County, Pennsylvania. 3. Plaintiff and defendant are both bona fide residents of the Commonwealth of Pennsylvania and have been for at least six (6) months immediately previous to the filing of this Complaint. 4. The plaintiff and defendant were married on July 23, 1988 in Mechanicsburg, Cumberland County, Pennsylvania. 5. There have been no prior actions of divorce or for annulment between the parties. 6. I CIVIL ACTION - LAW I AMY GATES, I Defendant I DIVORCB DBJ'ENDANT'S COUNTERCLAIM AND NOW, comes Amy Gates, Defendant above-named, by and through her counsel, Law Offices of Craig A. Diehl, and files this Counterclaim against Plaintiff, Ronald L. Gates, Jr. pursuant to Pa.R.C.p. 1920.15(a), respectfully stating in support thereof the following: COUNT I - DIVORCE 9. The allegations contained in Paragraphs 1 through 8 of Plaintiff's Divorce Complaint filed against Defendant on April 16, 1999, are incorporated herein as if fully set forth verbatim. 10. The parties have been living separate and apart within the meaning of the Pennsylvania Divorce Code since April 1, 1998, and their marriage is irretrievably broken. At the time of the trial, Defendant will submit, if applicable, an Affidavit that the parties have lived separate and apart for at least two (2) years. 11. Defendant avers that Plaintiff has offered such indignities to the person of the innocent and injured Defendant so as to render Defendant's condition intolerable and Defendant's life burdensome. 12. Defendant avers th~t Plaintiff, by cruel and barbarous treatment, has also endangered the life and/or health of the injured and innocent Defendant. 13. Defendant further avers that she, as an innocent and injured Defendant, is entitled to the entry of a decree of divorce because Plaintiff committed adultery. WHEREFORE, Defendant, Amy Gates, respectfully requests that your Honorable Court enter a Decree in Divorce, divorcing Plaintiff and Defendant. COUNT II - EQUITABLB DISTRIBUTION 14. Defendant incorporates by reference herein Paragraphs 9 through 13 of Defendant's Counterclaim, above, as if fully set forth herein in their entirety 15. On April 16, 1999, Plaintiff filed a Complaint in Divorce against Defendant in the Court of Common Pleas of Cumberland County, Pennsylvania, at the above-referenced case number. 16. Plaintiff and Defendant have acquired certain assets and liabilities during their marriage from its inception to the date of the separation of the parties. 17. Plaintiff and Defendant have been unable to agree as to an equitable division of said property and debts. 18. Defendant requests this Court to equitably divide, distribute or assign the marital property and debt between the parties in such proportion as the Court deems just after consideration of all relevant factors. WHEREFORE, Defendant requests that your Honorable Court enter an Order of Court equitably dividing all marital property pursuant to Section 3502(a) of the pennsylvania Divorce Code. COUNT III - ALIMONY 19. Defendant incorporates by reference herein paragraphs 9 through 18 above, as if fully set forth herein verbatim. 20. Defendant lacKs sufficient property to provide for her reasonable means and is unable to support herself through appropriate employment. 21. Defendant requires reasonable support to maintain herself in accordance with the standard established during the marriage.
