WHEREAS, The Episcopal Home at Shippensburg, Equitable Owner, of 206 East Burd Street, Shippensburg,
Pennsylvania is about to execute contemporaneously herewith, a contract, with Geesaman-Rock Construction,
Inc., Contractor, of 3289 Waynecastle Road, Zullinger, Pennsylvania, for the erection and construction of
building additions and alterations to the Episcopal Home, the construction of paved parking and related
improvements (hereinafter, collectively the "Improvements") upon a lot of land situate in Shippensburg Borough,
Cumberland County, Pennsylvania, being known and numbered as 206 East Burd Street, and being more
specifically described by the attached legal description.
NOW, April 16, 1999, before any authority has been given by the Record or Equitable Owner, or either of
them, to the said Contractor to commence work on the said Improvements or purchase materials for the same
in consideration of the making of the said contract with Contractor and the further consideration of one dollar
to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the contractor, or
any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens
being e/iressly waived.

East Burd Strcet, thence along the western side of Maple Avenue, south 40 degrees 11
minutes 18 seconds east, 175.50 feet to a Parker Kalon nail on the west side of Maple
Avenue, thence along the west side of Maple Avenue, south 40 degrees 12 minutes 07
seconds east 94.29 feet to an existing Parker Kalon nail at the intersection of Maple Avenue
