6. Section 933 of the Judicial Codc statcs that the vcnuc shall bc in "the county whcre thc
arrest for a violation of75 Pa. C.S.1i 3731 (rclating to driving under influcnce of alcohol or
controlled substance) was made in appeals involving the suspcnsion of operating privilcges under
75 Pa. C.S. 1i 1547 (relating to chcmicaltesting to determine amount of alcohol or eontrolled
substancc) or the rcsidence of any individual appcllant where the venue is not otherwise fixed by
this scntence". 42 Pa. C.S. 933. See Exhibit 2.
7. The proper venue for this matter is in the Court of Common Pleas of Cumberland
County.
8. The motorist's operating privilege has been restored pending appeal pursuant to
Section 1550 of the Vehicle Code.
9. The undersigned on April 9, 1999, spoke to Marcus A. McKnight, III. Esquire,
attorney for the petitioner, and he indicated that he concurrs with the granting of this motion.
WHEREFORE, the Department respectfully requests that this matter be transferred to the
Court of Common Pleas of Cumberland County where proper venue lies.

land bounded and described as follows:
All that certain lot, piece or parcel of land situated in the Township of Henry Clay, County
of Fayetu, Commonwealth of Pennsylvania, bounded and described as follows:
Beginning at a point, said point being the first described point of that pan:eI of land
conveyed by W. H. Reiber et we to the Connell5\iIle and Stale Line Railway Company by
deed dated June 6, 1910, and recorded in the Otlice of the Recorder of Deeds of Fayette
County, Pennsylvania, in Deed Book 296 at Page 308; thence from said point of beginning

petitioner believed he had consented to the test. When the lest was not
administered, he asked to leave. He was subsequently placed under arrest
and the test was not given.
Your petitioner, therefore, prays that this matter be set down for hearing de novo before Your
Honorable Court as provided by i5 Po. C.S.A. Section 1547 and Section 1550 and 42 Pa. C.S.A. Section
933, and that the order of the Department be set aside.

MOTION TO SCHEDULE MATIER FOR HEARING
The Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver
Licensing (Department), by and through its attorney, George H. Kabusk, Esquire, respectfully
represents as follows:
I. The Department mailed to James Edward Burnham a notice dated February 12, 1999,
informing him that as a result of his violation of Section 1547 of the Vehicle Code, relating to
Chemical Test Refusal, on January 13, 1999, his driving privilege was being suspended for a
period of one year.
2. Mr. Burnham filed an appeal of the above mentioned suspension in the Court of
Common Pleas of Perry County.
3. The proper venue for this matter is in the Court of Common Pleas of Cumberland
County. See 42 Pa. C.S. 933.
4. The matter was transferred from the Court of Common Pleas of Perry County to the
Court of Common Pleas of Cumberland County.
