WHEREAS, Joseph A. Scalera and Deborah A. Scalera of 5308 Oxford Circle.
Mechanicsburg. PA 17055. is about to execute contemporaneously herewith, a contract,
with Michael Manning and Associates of 1706 Katherine Street New Cumberland. PA
17070. for the erection of a split level brick and vinvl siding residence upon a lot of land
situate and known as
ALL THAT CERTAIN piece or parcel ofland situate in East Pennsboro Township,
Cumberland County, Pennsylvania, being known as Lot #40, Kent Drive, Final
Subdivision Plan of Hickory Ridge, Phase I, Mechanicsburg, Pennsylvania.

NOW, April 16, 1999, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Joseph A. Scalera
and Deborah A. Scalera to the said Michael Manning and Associates to commence work
on the said building, or purchase materials for the same in consideration of the making of
the said contract with Joseph A. Scalera and Deborah A. Scalera and the further
consideration of One ($1.00) Dollar, to Michael Manning and Associates paid by Joseph
A. Scalera and Deborah A. Scalera it is agreed that no lien shall be filed against the
building by the contractor, or any subcontractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or
materials purchased for the erection of said building, the right to file such liens being
expressly waived.
