CIVIL ACTION/EQUITY
First Union National Bank f/k/a Meridian Bank, by its
attorneys, Federman and Phelan, respectfully requests this
Honorable Court strike a Satisfaction of Mortgage erroneously
filed on or about June 18, 1998, in the Office of the Recorder of
Deeds of Cumberland County, and in support thereof, avers the
following:
1. On or around May 25, 1994, Defendant(s) made,
executed and delivered a Mortgage upon the premises at 234 Main
Street, Shiremanstown, PA 17011 to Meridian Mortgage Corporation
in the principal sum of $50,000.00, which was duly recorded in
the Office of the Recorder of Deeds of Cumberland County on or
about May 26, 1994 in Record Book 1214, Page 1151. A true and
correct copy of the Mortgage is attached hereto as Exhibit "A",
2. On or around August 18, 1994, the Mortgage was

III, ESQUIRE, set forth their answers to the allegations of First Union National Bank,
whereof the following is a statement:

recorded in Cumberland County Rerorder's Office on May 26, 1994 in Mortgage Book
1214, at page 1151.
12. Defendants sold the premises known as 850 Range End Road, Dillsburg,
York County, Pennsylvania on May 18, 1998, and remilled a payoff to Meridian Bank, the
request for whieh identified the arcount to be paid by the number shown on the
Defendants' payment coupon,
13. Plaintiff generated a payoff statement which reflected a different account
number, but a payoff balance of approximately the amount designated by the Defendants
as being owed to satisfy the account.
14. Upon receipt of the mortgage that secured 234 Main Street, Shiremanstown,
marked satisfied, Defendants made enumerable calls to Plaintiff to correct the erroneous
satisfaction, but were advised that the satisfaction cannot be "undone" and were instructed
to not make payments on the account because the obligation was marked satisfied and the
proper credit would not be received.
15. The duplicate $50,000.00 obligations remained open as liens against 850
Range End Road, DiIlsburg, until late August 1998, at which time those mortgages were
marked satisfied and returned to the Defendants.
16. During the fall of 1998 Defendants attempted to refinance the outstanding
balance initially owed to Meridian Bank, subsequently to CoreS tates, and ultimately First
Union at the historic low rate of five and three quarter percent to six percent, but were not
successful because of a credit report that showed a delinquent account in June 1998 and

the entry in an action of mortgage foreclosure by First Union for nonpayment of an
obligation that Defendants were instructed to not pay.
