JACK GAUGHEN, INC. t/d/b/a JACK GAUGHEN REALTOR, Defendant : COMPLAINT AND NOW come the Plaintiffs, Hanish and Neena Agarwal, by and through their attorneys, Friedman and King, P.c., and brinq this complaint, averrinq as follows: 1. Plaintiffs are Manish and Neena Agarwal, adult individuals, husband and wife, who reside at 13 Irongate Court, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Defendant is Jack Gaughen, Inc., a Pennsylvania corporation which trades and does business as Jack Gaughen Realtor, with its principal place of business at 3800 Market st., Camp Hill, Cumberland County, Pennsylvania, 17011. 3. On or about July 20, 1998, Plaintiffs entered into a Standard Agreement for the Sale of Real Estate with Yonas Zegeye and Hirut Seleshi, Sellers, for the purchase of premises situate 4349 Carlisle Pike, camp Hill, Pennsylvania. A copy of the relevant portion of said Agreement is attached hereto as Exhibit A. 4. Defendant acted as agent for both sellers and buyers in said transaction. ~~ *' 1j i r " ~ j .;" of I"~ ci ~ 1 !~ 1 ~: r,: ! 5. In accordance with the terms of Exhibit A, Plaintiffs tendered a down payment in the amount of $25,000.00 to Defendant as Sellers' escrow agent. 6. Subsequent to the execution of Exhibit A, the Sellers thereunder (Zegeye and Seleshi) defaulted under the terms of said Agreement. 7. Under the terms of said Agreement, Plaintiffs are therefore entitled to a full return of said $25,000.00 security deposit. 8. Plaintiffs have made demand upon Defendant for return of said $25,000.00 downpayment. 9. Defendant has stated to Plaintiffs that it is unable to return said $25,000.00 downpayment because it is unable to obtain a release from Sellers, Zegeye and Seleshi. WHEREFORE, Plaintiffs demand Judgment in their favor and against Defendant in the amount of $25,000.00 together with interest from July 20, 1998, and costs of the within action.
