COMPLAINT
AND NOW, comes the Plaintiff, Fulton Bank, by and through its attorneys, Caldwell &
Kearns, and does file the following Complaint against Defendants, Harvey B. Vedder and Judy B.
Vedder, stating in support thereof, the following:
1. Plaintiff, Fulton Bank, is a duly licensed banking corporation organized and existing
under the laws ofthe Commonwealth of Pennsylvania, having its principal place of business located
at One Penn Square, Lancaster, Lancaster County, Pennsylvania 17604. At all relevant times, Fulton
Bank does conduct business within Cumberland County.
2. Defendants, Harvey B. Vedder and Judy B. Vedder are both adult individuals whose
last known address is 65 St. Marks Place, Apartment 2, New York, New York, 10003.
3. On or about January 23, 1997, in consideration of a loan given by Fulton Bank to
Defendant Harvey B. Vedder in the amount 01'$48,569.50 said Defendant did execute and deliver
to Fulton Bank a certain Note and Mortgage Agreement. In further consideration of said loan,
Defendants Harvey B. Vedder and Judy B. Vedder did eliecute and deliver to Fulton Bank an
accompanying Murtgage in which both Defendants did ah'ree to pay said sum pursuant to the tenns
thereof. A true and correct copy of the initial Note of January 23, 1997 is attached hcreto marked
Exhibit "A" and made a part hereofby referencc thereto.
4. Thereafler, on or about December 27, 1997, Ihe original Note, Exhibit "A" was
amended and restated in a thrther Amended and Reslated Promissory Note, dated Deccmber 12,
J 997 inlhe revised amount of$47,781.21. A tme and correct copy of this a Amended and Restated
Promissory Note given by the PlaintilTto the Defendants is attached hereto, marked Exhibit"B" and
made a part hereofby reference thereto. This Amcnded and Restated Promissory Note provided the
Defendants would pay to Fulton Bank seventy-five (75) consecutive monthly installments on
account of principal and interest in the lUllount of$850.00 each, commencing January 15, 1998 and
continuing on the 15th day of each consecutive month thereafler with one final payment of all unpaid
principal and unpaid accrued interest due and payable no later than April 15, 2004. Said Amended
and Restated Promissory Note further provided interest applicable to the principal amount financed
would be at a variable rate of 1.5% above the annual floating rate of interest designated from time
to time by Fulton Bank as its prime rate.
5. At the time of execution of the initial Note, Exhibit "A" said Defendants did
furthennore issue a collateral Mortgage securing the improved real estate at 103 Brindle Road,
Monroe Township, Cumberland County, Pennsylvania, 17055. A tme and correct copy of said
Mortgage is attached hcrelo. marked Exhibit "C" and made a part hercofby reference thereto. Said
Mortgag~ was thereafler reeordcd in the Office ofthc Recorder of Deeds of Cumberland County on
Febmary 18, 1997 in Cumbcrland County Mortgage Book 1365, Page 778.
6. A descriplion of the mortgage premises referred to in the preceding paragraph,
paragraph 5 of 103 Brindle Road, Monroe Township, Cumberland County, Pennsylvania, marked
Exhibit "D" and made a part hereof by reference thereto.

6, Suid Defendunts did fail und/or refuse to puy the puyments due on said Amended und
Restated Promissory Note on February 15, 1998 thereby constituting an event of default as so stated
in the Amended and Restated Promissory Note accelerating the full amount due and payable of
principal and interest accrued on the Note and any other liabilities therein provided.
7. Furthermore, said Defendants have failed and/or refused to make any further
payments ofprincipaJ from February 15, 1998 through the March is, 1998, although a payment of
interest of$1,OOO.00 was received on or about October 19, 1998, which paid the interest from March
of 1998 through a portion of May of 1998.
8. Defendants obligation is therefore presently in default in the following amounts:

It is noted that interest is accruing on said obligation at a per diem rate of$11.96 per day after
April 8, 1999.
9. As provided in the Note, reasonable attorneys fees in the amount of S 1,500.00 is
demanded.
10. By virtue of the collateral Mortgage of Fulton Bank, Fulton Bank did issue a Notice
on March 9,1999 of its intention to foreclose on mortgagc (Act 6). A true and correct copy of said
Notice is attached hereto, markcd Exhibit "En and made a part hereof by reference thereto, with the
attached postal receipt forms indicating rcceipt of same by said Defendants on or about March 12,
1999.
II. Plaintifrhas made demand of said sums and Defendants have failed and/or refuscd
to pay same or any portion thereof other than as hcn:inbcfore related.
