Dear Jim and Tom:
I have been appointed Chairman of the arbitration panel to hear the above
case. I understand, from Tom Williams, that he has some discovery outstanding
and he does not want me to schedule a hearing until discovery has been complete.
I see three ways we can resolve this dilemma. They are:
1. The two of you can agree that the appointment of the
arbitrators was premature and file a proposed order and stipulation,
signed by both of you, to have the appointment of the arbitrators
vacated.
2, If you cannot agree upon the above procedure, Tom will
have to file a motion with the court asking that the appointment be
vacated, If Jim believes that our appointment was proper, he can
resist the motion and the court can decide that issue.
3. If the two of you can agree to conclude discovery within
sixty days, I will schedule a hearing sometime shortly after 60 days
and I will then report to the COlllt Adminislrator and the President
Judge the reason for the delay,

Dear Mr, Andes:
I have been assigned as an arbitrator in the above-referenced case. Your
secretary has been in contact with my office in order to schedule the Arbitration
Hearing. It llppears that t.he Hearing will take place at 2:00 p.m., in Carlisle, on
one of several days set aside in Janllnry, 2000. AI> my secretary attempted to
explain to your secretary, I work part, time because I have two small children.
Therefore, I have child care commitments which are paramount. The days ofthe
week (Tuesdays and Thursdays) that the Hearing could be scheduled are fine, but
scheduling a hearing after Noon could calise a problem. If the Hearing is scheduled
in the afternoon. liS proposed, it is likely I would not be able to get back to Camp
Hi\1 in time to pick up my children by 5:00 p.m. Alternative arrangements for child
care are jllst not possible.
If the Hearing cannot be scheduled ill the mornings, it would be desirable to
have another attorney assir,ned to serve on your paneL Please let me know how you
wish to proceed,

COMPLAINT
COMES NOW, Plaintiff, Elisabeth R, Walters, by and through her attorney, James J. Kayer,
Esquire, who does hereby aver as follows:
I. Plaintiff, Elisabeth R, Walters, is an adult individual whose current residence is 503 South 20c~
Street, Camp Hill, Cumberland County, Pennsylvania 17011.
2. Defendant, Virginia E, Evertts, is an adult individual whose current residence is 543 Brandt
Avenue, New Cumberland, Cumberland County, Pennsylvania 17070.
3. On or about July 15, 1998, the property located at 503 South 20th Street, Camp Hill,
Pennsylvania, 170 II was transferred from the Defendant to the Plaintiff
4. On or about June 5, 1998, an Agreement of Sale was executed between the Plaintiff and the
Defendant confirming each Parties intentions to be legally bound for the sale of the premises located at
503 South 20th Street, Camp Hill, Pennsylvania, 170] I.
S. On July 14, 1998, the Plaintiff and Defendant, completed a pre-settlement walk through of the
premises. The only item noted as not being in satisfactory condition was a dishwasher, due to the fact
that the unit was being used for storage,
6. On or about June 26, 1998, the Parties executed an Addendum to the Sales Agreement
whereby the two tiffany style ceiling lights on the lower level and the ceiling light fixture at the bottom of
the stairs were not included in the sale of the home and whereby the seller was permitted 10 remain j:J
possession oflhe property after settlement until one week beiore the beginning of the 1998-1999
scholastic year at a rental rate calculated to be equal to the buyer's monthly mortgage payment,
7. At the real estate closing, which occurred on July IS, 1998, it was orally agreed between the
Parties that a walk through inspection would occur after the Defendant vacated the premises to insure
that those premises were left in the same condition as existed on July IS, 1998.
8, On July 15, 1998 the Parties executed a Post Settlement Possession Addendum to agreement
of sale whereby Defendant was to vaeate the property on or before August 2, 1998 and pay to Plaintiff in
the amount of $442.00 from the day of settlement to the day she was to vacate the property.
9. Paragraph 7 of the Post Settlement Possession Addendum to the agreement of sale required
the Defendant to maintain the property in the same condition as of the time of settlement.
10. Paragraph 8 of the Post Settlement Possession Addendum to the agreement of sale confirmed
that the Defendant was not to make any alterations or improvements to the property, unless required by
the terms of the agreement of sale or as otherwise agreed to by Buyer in writing.
11. Defendant vacated the premises at 503 South 20th Street, Camp Hill, Pennsylvania, 17011,
on or about August 2, 1998.
12. Defendant did not make herself available for a subsequent walk through inspection on August
2, 1998 or at any time thereafter.
13, Upon taking possession of the premises, it was noted by the Plaintiff that the Defendant had
caused substantial damage to the premises and had removed items and fixtures that went beyond the
terms of the Parties' Sales Agreement, the Addendum to Sales Agreement and all other documents
executed between the Parties,
14, The damage caused by the Seller's actions include the following:
A. A comer cabinet in the dining room that was a fixture that was atlached to the wall
was forcibly removed causing several large holes in the plaster wallsand also causing a
significant gap in the ba~eboard molding;
B. Various hooks and wall hanging apparatus were forcibly pulled from walls creating
damage to the plaster;
C. Master bedroom cabinets, again attached to the wall as fixtures, were foreibly
removed leaving holes in the plaster;
D. Numerous statues and bird feeders located in the exterior of the home, and
advertised as being a feature of the home, were removed,
E. Defendant was to leave a working refrigerator with the home, but instead left a
unit that had been stored in a storage shed, had been kicked in or otherwise abused, and
was unusable
F. The aforesaid items removed by the Defendant were not excluded ITom the sale
of the home in the Sales Agreement executed by the Parties or the Addendum to Sales
Agreement executed between the Parties.
15. The Defendant, when she removed those light fixtures excluded ITom the sale of the home by
the Addendum to Sales Agreement dated June 26, 1998, caused significant damage to the plaster walls,
ceiling and electrical system.
16. P]aintitTalso noted upon obtaining possession of the premises on or about August 3, ]998 that
the Defendant had failed to disclose significant material defects in and about the home.
] 7. Defendant in the Seller's Property Disclosure Statement executed by her on May 7, ] 998,
failed to disclose the following defects:
A, The wood stove designated by the Defendant as functional was not functional. To
the contrary, it has been the source of at least two separate incidents, the last of which
prompted a representative from Lower Allen Township to direct the Defendant to take
specific actions to prevent the stove from ever being llsed again due to its improper
installation;
B. The central air conditioning system does not adequately eool the first floor due to
the fact that all duct work to the first floor has been crushed and has come apart and is
inoperable;
C. Tennite damage was noted in the doorway leading from the master bath to the
laundry room, said damage was actively concealed by the use of plaster being smoothed
over the entry and exit holes and the door frames were repainted white;
D, Defendants specifieally advised that there had never been an ineident involving the
roofleaking during her ownership of the home, despite the fact that clear indications of
recent roof leaks were apparent immediately upon the Plaintiff's occupancy of the home;
E, Defendant represented in the disclosure statement that no fire damage had
occurred to the home.
F, Oven portion of the stove unit was inoperable,
18, The kitchen cabinets were found to be rotting from tennite damage or wood rot, said damage
was not readily apparent at the initial home inspection, Defendant had stated in the Seller's
disclosure statement that she was unaware to any damage to the property caused by tennites,
wood destroying insects, dry rot, or pests.
19, The aforesaid representations by the Defendant were committed with the purpose and
intention of deceiving the Plaintiff or any perspective purchaser to purchase the home at a higher price
than appropriate due to the extensive damage to the home,
20. The aforesaid actions by the Defendant were done willfully, wantonly. maliciously, and in bad
faith,
21, As a result of the damage caused by Defendant's actions as well as her failure to disclose
material defects to the property. the Plaintiffwill be forced to spend in excess of $6.000,00 in order to
repair the damage and material defects

22, WHEREFORE, Plaintiff demands judgement against Defendant for a sum in access of

11. Denied, Defendant vacated the premises at 503 South 20'h Street, Camp Hill,
Pennsylvania, at 4:00 p.lll, on August 1, 1998 at the Plaintiff's urging.
12. Denied. It is specifically denied that the Defendant agreed to take part in a walk-
through inspection on August 2, 1998, or anytime thereafter, By way of further response, the
Defendant spoke with the Plaintiff on August 1, 1998, to discuss her coming back to clean up the
premises, The Plaintiff stated that it was not necessary for the Defendant to do any cleaning or
repairing of the walls and requested that the Defendant leave the keys to the house on the kitchen
counter and vacate as soon as possible, Nothing was said during this conversation about any walk-
through. By way of further response, the Defendant left her new phone number on a note to the
Plaintiff but the Plaintiff never contacted the Defendanl. The first contact following the transfer of the
property that the Defendant received was a letter from the Plaintiff's attorney, Anthony Foschi, dated
October 6, 1998.
1.3. Denied. It is specificall)' denied that the Defendant caused any damage to the premises
or removed any items or fixtures not authorized by the agreement between the parties.
14, a. Denied, The Defendant explained to the Plaintiff during the Plaintiff's first
walk-through the house that the corner cabinet in the dining room was not to
stay in the home and that the Defendant was taking it with her when she
moved. By way of further response, on a subsequent walk-through the
Plaintiff's realtor, Barbara Genther, reminded the Plaintiff that the corner
cabinet did not s(ay with the property,
b. Denied. The Defendant moved hooks and wall hanging apparatus in a

c. Denied, It is denied that the cabinets in the bedroom were attached to the
walls as fixtures. By way of further response, it is denied that the cabinets were
to stay in the home and it is specifically alleged that the Plaintiff knew or
should have known that the cabinets were not to remain in the home. By way
of further respOnse, the Defendant removed the cabinets from the home in a
reasonable manner. To the extent that any holes or plaster was damaged, it is
specifically alleged that Plaintiff denied the Defendant the opportunity to repair
and all holes in walls or ceilings, Defendant incorporates herein by reference
her New Matter which is set forth hereafter.
d. Denied. It is specifically denied that the statues and bird feeders located at the
exterior of the home were included in the sale of the property. On the
contrary, the statues and bird feeders, all personal items, were at no time to be
included in the sale of the property, By way of further response, the
Defendant, though not obligated to do so, left several statues with the property
only taking a statue of Virgin Mary and a statue of an angel and two bird
feeders i1nd a bird bath. By way of further response, Plaintiff indicated to the
DefendJl1tlhat it was not necessary for the Defendant to leave the bird feeders
i1S she had mal1Y of her own already.

The refrigerator was purchased used and was used by the Defendant as a back
up refrigerator, It is specifically denied that the Defendant damaged the
refrigerator in any way, Finally, it is specifically alleged that the refrigerator
was in working order on the day the Defendant moved out of the home.

property until on or about October 6, 1998,
32. Despite offers by the Defendant that she would repair and/or patch holes in the walls
or ceiling, the Plaintiff refused such offers and specifically asked the Defendant to leave the premises
as soon as possible without making such repairs,
33, To the extent any damal\e was caused by Defendant, which allegations are denied, the
Plaintiff denied Defendant the opportunity to repair any such damages.
34. Defendant specifically notified the Plaintiff that the statues and bird feeders located in
the exterior of the home were to go with her and not remain with the property,
35. The Plaintiff was notified by the Defendant that the cabinets in the bedroom and dining
room were to go with the Defendant and not to remain in the home.
36, The HV AC system in the house was operating satisfactorily at the time the property was
transferred from the Defendant to the Plaintiff.
37, To the extent that there are damages in the home as alleged by the Plaintiff, such
damages being denied, any and all such damages were caused by the Plaintiff, her friends, relatives
or agents, and not by the Defendant.
38, The Plaintiff's claims are barred by her failure to mitigate damages.
39. Defendant disclosed to the Plaintiff all known problems or deficiencies of which she
was aware.

42, The Plaintiff's claims with respect to termites and/or termite damage are unfounded
inasmuch as she was provided with a termite inspection report prior to accepting title to the properly,
The Plaintiff is thus estopped from making a claim for damages due to termites.
43, The Defendant is entitled to a recoupment for monies paid to the Plaintiff pursuant to
the post settlement possession addendum inasmuch as she was not permitted to enjoy at least one day
in the premises for which she paid the Plaintiff.
44, The Defendant is entitled to a set-off in the amount equal to one day's rent pursuant to
the post settlement possession addendum inasmuch as she was not permitted to stay through August
2,1998 and had already paid for same,
45. There was never an agreement between the Defendant and the Plaintiff to take part in
a walk-though after the Defendant had moved out of the premises,
46. The Plaintiff's Complaint fails to state a cause of action upon which relief may be
granted,
WHEREFORE, the Defendant respectfully requests this Honorable Court to dismiss the
Plaintiff's Complaint with costs and attorneys' fees in defending lhis action.
