2. For value received from plaintiff, defendant(s) executed the promisf.Ory note,
annexed hereto as Exhibit" A".
3. Despite demand, said instrument has not been paid in accordance with its terms
leaving a balance due and owing of $800.00 as more fully set forth in plaintiff's statement of
account, a true and correct copy of which is annexed hereto as Exhibit "B" and made a part
hereof.
WHEREFORE, Plaintiff demands judgment against the defendant(s) in the sum of
$800,00 plus interest in the amount of $453,60 and attorney's fees in the amount of $313.40 for

11. Contrary to the terms of the Note, Plaintiff initiated collection efforts in
August, 1991.
12. Plaintiff's efforts included contacting Defendant's parents rather than
Defendant personally, although Defendant was at all relevant times of
the age of majority; such actions were in direct violation of 15 U.S.C 9
1692, et seq.
13, Defendant's student loans, including undergraduate and graduate loans,
were consolidated and are serviced by the Student Loan Servicing
Center, now Direct Loans.
1.4. Plaintiff, through its actions of placing said Note for collection while it was
in deferment status, caused said Note to be ineligible for consolidation.
15. Plaintiff's cause of action and right to recovery is barred by waiver.
16. Plaintiff failed to perform all its obligations under the Note. Specifically,
Plaintiff's failure to abide by the deferment provision of the Note
constitutes a breach of its conditions and obligations.
17. Plaintiff has failed to act in good faith,
18. Plaintiff has not used substantial effort or due diligence in attempting to
comply with the terms of its Note.
WHEREFORE, Defendant, William C. Vohs, demands judgment be entered in
his favor and against Plaintiff, and Plaintiff's Complaint be dismissed with
prejudice,

COUNTERCLAIM
19,The averments contained in Paragraphs 1-18 above are incorporated by
references as it fully set forth herein.
20, Plaintiff's conduct, as set forth more fully above, constitutes a violation
of Pennsylvania's Debt Collection Trade Practices, 37 Pa.Code 9 303.1, et
seq.
21. Plaintiff's conduct, as set forth more fully above, constitutes a violation of
the Fair Debt Collection Practices Act, 15 U.S,C. 9 1692, et seq.
22. Pursuant to 15 U.s.c. Section 1692k, Plaintiff is liable to Defendant for
$1,000, plus attorney fees and costs.
23. Plaintiff's conduct, as set forth more fully above, constitutes a violation of
Pennsylvania's Unfair Trade Practices and Consumer Protection Law, 73
P.S, 201-1, et seq.
24. Pursuant 73 P.S. Section 201-9.2, Plaintiff is liable to Defendant for an
amount equal to three times his damages, plus attorney fees and costs.
25, Alternatively, pursuant 73 P.S. Section 201-9.2, Plaintiff is liable to
Defendant for a statutory amount of not less than $100 statutory
damages, plus attorney fees and costs.
26, Plaintiff, by its actions, breached the terms of said Note.

ORDER OF COURT
AND NOW, April 29, 1999, the Jury Selection Commission
for Cumberland County, with the assistance of Board of Elections,
Cumberland County, Carlisle, Pennsylvania, is directed to select
in random fashion 300 persons from the master list of prospective
jurors for Cumberland County for the year 1999 for service as
jurors to try all cases and matters which may be pending before
the Court of Common Pleas, Civil Division, at a session
commencing July 12, 1999.
When the selection has been made, the District Court
Administrator is directed to summon said prospective jurors for
service as indicated above, as required by law, and to direct
said prospective jurors to respond to the questionnaire submitted
with the summons,
