AND NOW, June 1, 1999, 1:55 p.m., Mark Wayne Lynch,
having appeared in open court together with the Public
Defender, Timothy L. Clawges, Esquire, and the defendant
having admitted the violation of the petition, in that he
having admitted the allegation under the affidavit of
probable cause section, in that he did get out of his car
during the transfer of custody of the children, in violation
of the order requiring him to stay seated in his car, we do
accept the defendant's admission and we do find that that
supports the charge beyond a reasonable doubt.
Having so found, sentence of the court is that the
defendant shall be placed on probation for six months on
condition that he abide by all provisions of the PFA order.
At the request of both parties for a modification of
our final order of May 5, 1999, paragraph 5 of that order
shall include the provision that the defendant not only
remain in his car at the custody transfer, but that the
transfer of custody be accepted at the site of the community

or any other residence where Plaintiff may live. Exclusive possession of the residence is
granted to Plaintiff. Defendant shall have no right or privilege to enter or he present on the
premises.

other personal effects, provided that Defendant is in the company of a law enforcement
officer when such retrieval is made.

the Plaintiff by telephone or by any other means, including third parties, except for the limited
pnrpose of facilitating custody arrangements through a mutually agreed upon third par!)'.

Pennsylvania, shall remain in effcet. See attached Exhibit A, Custody Order, incorporated
herein by reference.
Plaintiff shall have primary physical custody of the minor children, Joshua Ian
Lvneh and Dustin Thomas Lvneh.

Defendant shall remain in his vehicle at all times during transfer of
custody.
The local law enforcement agenc~' in the jurisdiction whert' the children

control of Plaintiff in accordance with the terms of this Order.
o 6. Defendant shall immediately tum over to the Sherin's Olliee, or to a local law
enforcement agency tor delivery to the Sherin's Olliee, the following weapons used or threatened
to be used by Deti:ndant in an act of abuse against Plaintiff and/or the minor ehild/ren:

weapons for the duration of this O,'der. Any weapons delivered to the sheriff under
Paragraph 6 of this Order or under Paragraph 6 of the Temporary Order shall not be
returned until fUl'ther Order of Court.

The following additional relief is granted as authorized by ~6108 of this Aet:
This Order shall remain in effect until modified or terminated by the
Court and ean be extended beyond its original expiration date if the Court finds
that Defendant has committed an act of abuse or has engaged in a pattern or
practice that indicates risk of harm to Plaintiff.
Defendant is required to relinquish to the sheriff any firearm license
Defendant may possess. Defendant's weapons and firearm license may be
returned at the expiration of the Protection Order after Defendant has
submitted a written request to the Court for the return of the weapons and the
Court has notified Plaintiff of the request and given Plaintiff an opportunity to
respond. A copy of Ihis Order shall be transmitted to Ihe chief or head of the
police department of (where Defendant resides) and the sheriff of Cumberland
County.
Defendant is enjoined from damaging or destroying any property owned
jointly by the parties or owned solely by Plaintiff.

NOTICE TO LAW ENFORCEMENT OFFICIALS
The police who havejurisdiction over Plaintiff's residence OR any location where a violation
of this Order occurs OR where Defendant may be located, shall enforce this Order. An arrest for
violation of Paragraphs I through 7 of this Order may be without warrant, based solely on probable
cause, whether or not the violation is committed in the presence of the police. 23 Pa.C.S. *6113.
Subsequent to an arrest, the police oflicer shall seize all weapons used or threatened to be
used during the violation of the Protection Order or during prior incidents of abuse. The
Cumberland County Sheriff's Department shall maintain possession of the weapons until further
Order of this Court. When Defendant is placed under arrest for violation of the Order, Defendant
shall be taken to the appropriate authority or authorities before whom Defendant is to be arraigned.
A "Complaint for Indirect Criminal Contempt" shallthcn be completed and signed by the police
officer OR Plaintiff: Plaintiff's presence and signature arc not required to tile the complaint.
If suflicient grounds for violation of this Order arc all(~gcd, Defendant shall be arraigned,

In addition, Defendant was convicted of burglary in theI980's, and served time
in the State Correctional Institution at Bellefonte, Pennsylvania, and has been convicted
of driving under thc influence, and driving under suspension.
8. A Custody Order was entered on March 2, 1995, by agrcement of the partics (Desmarais
v. Lynch, York County, No.95-SU-00638-03) (see attached Exhibit A, incorporated herein by
reference) granting Plaintiff primary physical and legal custody of the parties' minor children,
Joshua Ian Lynch and Dustin Thomas Lynch. Although the parties reconciled after the entry of the
Order, the Order has not been modified and provides that it remains in effect until further Order of
Court.
9. The facts of the most recent incident of abuse are as follows:

Place:
On or about April 23, 1999
Sigman's Mobile Home Park, 46 Garden Parkway, Lot 88,
Carlisle, Cumberland County, Pennsylvania, Plaintiffs
residence.
On or about April 23, 1999, Plaintiffworked latc, and when she returned home,
Defendant made false accusations, called her namcs in the prescnce of the parties' two
minor children, and threaten cd to hurt Plaintiff and anyone that she might get involved
with.
10. Defendant has committed the following prior acts of abuse against Plaintiff:
a) On or about April 16, 1999, Defendant demanded that Plaillliff and their two
minor children leave their friends' home and retum home with him. When Plaintiff
refused to leave, Defendant, who was intoxicated, disregarded Plaintiffs protests and
took their 5 and 7 year old children in the car and left. Fearing for the children's safety,
Plaintiff telephoned the policc for help. Dcfendant retumed with the children moments
later, yelled and screamed at Plaintiff, shoved her forcefully by her shoulders causing
her to fall backward to the ground. The East Pcnnsboro Township Police arrived,
rcmoved Defendant, and cited him f()r harassment. Dcfendant later told Plaintitr that
she was going to have to pay his fine.
b) On or about April I 0, 1999, Defendant yelled and screamed at Plaintiff, grabh('d
her by the front of her shirt, picked her up off of the floor, and threw her down on the
lloor causing her (0 fall on her back and hit her head. Defendant questioned Plaintiff
demanding answcrs from her. shoved her repeatedly, and slapped h('r about her head

Plaintiff's head, followed her whcn she took the children outside to get away from him,
and continued to verbally abuse her in thc prcsence of the childrcn.
c) On or about March 30, 1999, Defendant argued with Plaintiff'during her birthday
party, thrcw a piece of her birthday cakc on her, and as shc c1eancd the cake off ofhcr
clothing, Dcfcndant grabbed thc cakc, mashed it against her facc, and said, "Happy
Birthday."
d) On or about March 27, 1999, Defendant argued with Plaintiff when she refuscd
to let him take hcr car, took her keys and threw them at her hitting hcr in the back ofthc
ncck. Plaintiff sustained soreness, redmarks, and bruising about her ncck as a result of
this incidcnt.
c) In or about February 1999, during dinncr onc cvening, Defendant told Plaintiff
that hc could not stand her, threatencd to kill her if shc evcr cheatcd on him and to hurt
hcr if she cver left him and dated anyone elsc, and thcn he stabbed hcr on the leg with
his fork causing bruising and leaving marks on hcr leg from the tines of the fork.
t) In or about December 1998, Defendantthrcw a pocket knifc at Plaintiff grazing
hcr nosc with it, causing a laceration.
g) Sincc approximately summcr 1998, Defcndant has abuscd Plaintiff in ways
including, but not limited to, shoving, b'l'abbing, and slapping her; kicking her when shc
rcfused to givc him hcr car keys; pulling hcr hair; throwing objects such as the rcmote
control, dinncr platcs, and a bowl at hcr; rcstraining her by blocking doorways with his
body; pinning hcr to the 110or; intimidating her; threatening to hurt her and to kill her,
and on several occasions during argumcnts, gelling a gun out and cocking thc hammcr
rcpcatedly causing Plaintiff to fcar for her life.
II. Dcfcndant has used or thrcatencd to usc the following wcapons against Plaintiff: .22
gauge shotgun and 20-gauge shotgun.

B. Evict and cxcludc Defcndant !Tom Plaintiffs r(:sidence and prohibit Defcndant

C. Custody shall be as ordercd in thc York County Court of Common Pleas's Order

D. Prohibit Dcfcndant from having any contact with Plaintitf cither in person, by
telephone, or in writing, personally or through third pcrsons, including, but not limited
to, any contact at Plaintiff's placc of employmcnt and/or the schools or day carc facility
of the minor childrcn, exccpt as thc Court may find neccssary with respect to partial
custody with thc minor childrcn.
E. Prohibit Dcfcndant fTOm having any contact with Plaintiff's relatives and
Plain tift's childrcn listcd in this Pctition, cxcept as thc court may find nccessary with
rcspcct to partial custody with the minor childrcn.
F. Order Dcfcndant to tcmporarily tum ovcr wcapons to thc Sheriffofthis County

only part of the system that can make a gun safe - or unsafe. Hunting and
ts/get shoaling are among the safest of all sports_ This booklet is intended
