STIPULATION AGAINST LIENS
THIS AGREEMENT made this act day of April, 1999, by and
between Michael P. Gardner, 102 Fairway Drive, Carlisle,
pennsylvania, hereinafter referred to as Contractor,
AND
FAGER DEVELOPMENT CORP., hereinafter referred to as Owner, whereby
the contractor undertook and agreed to erected and construct a
dwelling on the certain lot of ground situate in North Middleton
Township, Cumberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot #37, North Ridge, Carlisle, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others unde:!." them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

EXHIBIT A
ALL THAT certain lot ofland situate in North Middleton Township, Cumberland County, Pennsylvania,
more pllrticularly bounded and described as follows:
BEGINNING A T a point on the northern side of Regal View (50 feet wide Tight of way) at the
southwestern comer of Lot No 36 on the hereinafter mentioned plan of lots; thence along Regal View the
following two courses and distances: (I) North 82 degTees 30 minutes 42 seconds West, a distance of
twenty-six and eight hundredths feet to a point; (2) by a curve extending to the right io a northwestwardly
direction and having a radius of one hundred seventy-five feet, an arc distance of one hundred thirty-and
seventy-one hundredths (130.71) feet to a point at Lot No. 16 on Phase I; thence by the same the following
two courses and distances: (I) North 50 degrees 17 minutes 01 second East, a distance of ninety-six and
eighty-two hundredths (96.82) feet to a point; (2) South 87 degrees 49 minutes 47 seconds East, a distance
of seventy-nine and fifty-four hundredths (79.54) feet to a point; thence by Lot No. 36 South 7 degrees 29
minutes 18 seconds West, a distance of one hundred twenty-live (125.00) feet to a point, the place of
BEGINNING.
BEING the same premises which Fred A. Gettys and Yvonne W. Gettys, husband and wife, granled and
conveyed to Fager Development Corp..
