Improvement Act, totaled more than $18,271.00. A true and
correct copy of the Sales Agreement is attached hereto, made a
part hereof and marked as Exhibit "A."
5. Plaintiff avers that, as a result of the ineffective
repair attempts made by Defendant Chevrolet and its authorized
dealer, the vehicle cannot be used for the purposes intended by
Plaintiff at the time of acquisition; as such, the vehicle is
worthless.
Defendant issued to Plaintiff several written warranties,
6. In consideration for the purchase of the above vehicle,
including the remainder of a three (3) year, thirty-six thousand
(36,000) mile basic warranty, as well as other standard
warranties fully outlined in the warranty booklet, delivered at
time of sale.
COUNT I
LEMON LAW
7. Plaintiff hereby incorporates paragraphs 1 through 6
inclusive as if set forth fully below.
8. Plaintiff, Barbara K. Smith, is a "Purchaser" as
defined by 73 Pa. C.S.A. 51952.
9. Defendant is a "Manufacturer" as defined by 73 Pa.
C.S.A. 51952.
10. Sutliff Chevrolet Co. is and/or was at the time of sale
a Motor Vehicle Dealer in the business of buying, selling, and/or
exchanging vehicles as defined by 73 Pa. C.S.A. 51952.

16. In addition, the above vehicle has or will be out-of-
service by reason of the non-conformities complained of for a
cumulative total of thirty (3D) days or more.
17. Plaintiff has delivered the non-conforming vehicle to
an authorized service and repair facility of the manufacturer on
numerous occasions. After a reasonable number of attempts, the
manufacturer was unable to repair the non-conformities.
18. The first warranty repair attempt is believed to have
occurred on or before December 15, 1995, when the vehicle's
odometer showed 4,123 miles. On that date, a repair attempt was
made to remedy a problem in which the vehicle would not start.
The vehicle was jump-started and the alternator was replaced. A
true and correct copy of the repair invoice is attached hereto,
made a part hereof and marked Exhibit "B."
19. The second warranty repair attempt is believed to have
occurred on or before March J.3, J.996, when the vehicle's odometer
showed 4,721 miles. On that date, a repair attempt was made to
remedy a problem in which the vehicle made a clicking noise when
turning the ignition and would not start. The vehicle was jump-
started, the battery was tested to detect the drain, and the
battery was recharged. A true and correct copy of the repair
invoice is attached hereto, made a part hereof and marked Exhibit

20. The third warranty repair attempt is believed to have
occurred on or before May 16, 1996, when the vehicle's odometer

showed 5,143 miles. On that date, a repair attempt again was
made to remedy a problem in which the vehicle made a clicking
noise when turning the ignition and would not start. The vehicle
was jump-started, the battery/electrical systent was tested to
detect the drain, and the battery was recharged. A true and
correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "D."
21. The fourth warranty repair attempt is believed to have
occurred on or before January 11, 1997, when the vehicle's
odometer showed 8,991 miles. On that date, another repair
attempt was made to remedy a problem in which the vehicle made a
clicking noise when turning the ignition and would not start.
The vehicle was towed to the dealer, the battery/electrical
system was tested to detect the drain, and the battery was
replaced. A true and correct copy of the repair invoice is
attached hereto, made a part hereof and marked Exhibit "E."
22. The fifth warranty repair attempt is believed to have
occurred between March 8, 1997 and March 10, 1997, when the
vehicle's odometer showed 9,165 miles. On that date, a repair
attempt was yet again made to remedy a problem in which the
vehicle made a clicking noise when turning the ignition and would
not start. The vehicle was towed to the dealer and the
battery/electrical system was tested. A true and correct copy of
the repair invoice is attached hereto, made a part hereof and
marked Exhibit "F."

23. The sixth warranty repair attempt is believed to have
occurred between November 3, 1997 and November 5, 1997, when the
vehicle's odometer showed 12,698 miles. On that date, a repair
attempt was made again to determine why vehicle would not start.
The vehicle was towed to the dealer, the battery was tested to
detect the drain, and the battery was recharged. A true and
correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "G."
24. The seventh warranty repair attempt is believed to have
occurred on or before November 17, 1997, when the vehicle's
odometer showed 12,820 miles. On that date, upon advice from
Chevrolet in Detroit, a technician at another dealer checked the
vehicle to determine why the battery goes dead. No repair was
done. A true and correct copy of the repair invoice is attached
hereto, made a part hereof and marked Exhibit "H."
25. The eigth warranty repair attempt is believed to have
occurred on or before January 6, 1999. On that date, repair
attempts were made to correct the vehicle's battery problem by an
electrical system specialist. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "I."
26. In addition, Plaintiff avers the vehicle has been
subject to additional repair attempts for defects and/or non-
conformities and/Qr conditions for which the dealer did not
maintain records.

43. Plaintiff has incurred damages as a direct and
proximate result of the breach and failure of Defendant to honor
its express and implied warranties.
44. Such damages include, but are not limited to, the
purchase price of the vehicle plus all collateral charges,
including attorney fees and costs, as well as other expenses, the
full extent of which are not yet known.
WHEREFORE, Plaintiff respectfully demands judgment in her
favor and against Defendant, in an amount equal to the purchase
price of the subject vehicle, plus all available collateral
charges and attorney fees.
COUNT IV
UNFAIR TRADE PRACTICES AND CONSUMER PROTECTION CLAIM
45. Plaintiff hereby incorporates paragraphs 1 through 44 by
reference as if set forth at length herein.
46. Section 1961 of The Pennsvlvania Automobile Lemon Law,
provides that a violation of its provisions is also a violation of
the Unfair Trade Practices and Consumer Protection Law.
47. In addition, the Unfair Trade Practices and Consumer
Protection Law defines unfair methods of competition to include the
following:
(vii) . Representing that goods or services
are of a particular standard, quality or
grade, or that the goods are of a particular
style or model, if they are of another.
(xiv). Failing to comply with the terms of
any written guarantee or warranty gi.ven to the
buyer at, prior to, or after a contract for
the purchase of goods or services is made.
