COMPLAINT
AND NOW, comes the Plaintiffs, by and through their attorney, and files
this Complaint, as follows:

Plaintiffs James L. Rich and Sharon A. Rich, husband and wife, are adult
individuals currently residing at 18 Tiffany Drive, Carlisle, Pennsylvania.
Defendants Harry B. Clark and Joyce B. Clarke, husband and wife, are
adult individuals, currently residing at 117 Fineview Road, Camp Hill,
Pennsylvania.
Defendants, at all times relevant to this Complaint, operated and did
business under the name "Joy Ark Builders".
On or about July 18, 1996 Plaintiffs and Defendants entered into a
contract (attached and incorporated fully herein as Exhibit "A")whereby
Defendants would construct asingle-family home on PlaintiNs' property
located at 18 Tiffany Drive, Carlisle. (hereinafter referred to as "the
Home")
5. Numerous defects with the Home exist, of which Defendants have failed
and refused to rectify.
6. Due to the defects in the Home, it is believed and therefore averred that
the value of the Home is less than that paid to Defendants under the
contract.
7. The defects in the Home. at least as known to Plaintiffs at this time,
include:
a. cracks in the foundation of the Home due to improper
placement of footers,
b. cracks throughout interior walls,
c. water seepage in various areas,
d. defective heating system, including lack of adequate system
installation and presence of substantial dust. Such defects
further required the replacement of drywall and repainting of
effected areas,
e. improper placement of dryer vent,
f. Improper hanging of interior doors.
8. Plaintiffs have been required to utilize other contractors in order to rectify
the substandard work performed by Defendants.
9. Defendants have been fully appraised of these defects, but have not
attempted to resolve the problems.
COUNTI
BREACH OF CONTRACT
10. Paragraphs 1 through 9 are incorporated fully herein by reference.
11. Defendants have breached the contract by:
a. failing to construct a home to the quality or value agreed upon in
the contract,
b. failing to act in good faith or with fair dealing.
WHEREFORE, Plaintiffs respectfully request this Honorable Court enter
judgement for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs,
COUNT It
BREACH OF WARRANTY
12. Paragraphs 1 through 11 are incorporated fully herein by reference.
13. The Home was a newly constructed home.
14. As a new home Plaintiffs provided, as a matter of law, a warranty of
habitability.
15. The defects in the Home, as more fully set forth above, are breaches of
such warranty.
WHEREFORE, Plaintiffs respectfully request fhis Honorable Court enter
judgement for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.
COUNT III
NEGLIGENCE
16. Paragraphs 1 through 15 are incorporated fully herein by reference.
17. Defendants owed a duty to Plaintiffs to construct the Home using a
reasonable standard of care, skill and workmanship.
18. Defendants breached such duty by failing to utilize such care, skill and
workmanship, and thereby caused Plaintiffs to incur damages.
WHEREFORE, Plaintiffs respectfully request this Honorable Court enter
judgment for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.
COUNT IV
NEGLIGENT MISREPRESENTATION
19. Paragraphs 1 through 18 are incorporated fully herein by reference.
20. Defendants made material misrepresentations to Plaintiffs regarding their
ability to construct a quality home for the money paid, as well as the lack
of defects in the Home, as well as misrepresentations regarding
certification by Comfort Home.
21. Such material misrepresentations were made both prior to entering into
the contract, as well as during the construction process.
22. Such material misrepresentations were made with the intent to induce
Plaintiffs to enter into the contract and accept the Home as constructed.
23. Defendants knew, or reasonably should have known, that Plaintiffs would
rely on such misrepresentations.
24. Plaintiffs did justifiably rely on such misrepresentations, and have suffered
damages as a result of such reliance.
WHEREFORE, Plaintiffs respectfully requests this Honorable Court enter
judgment for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.
COUNT V
UNFAIR TRADE PRACTICES ACT
25. Paragraphs 1 through 24 are incorporated fully herein by reference.
26. Defendants actions, as set forth above, constitute unfair and deceptive
acts or practices under Pennsylvania's Unfair Trade Practices Act, in that
Defendants:
a. Represented that there services had characteristics or benefits
that they did not have;
b. Represented that their services were of a particular standard or
quality, when they were not;
c. Engaged in other fraudulent and deceptive conduct, which
created a likelihood of confusion or rr~isunderstanding.
WHEREFORE, Plaintiffs respectfully request this Honorable Court enter
judgment for them and against Defendants in an amount greater than
$25,000.00, plus treble damages, attorney's fees, interest and costs.

2. Additional Defendant Samuel J. Kacyon, Jr., is an adult individual, residing at 419
Old York Road, Dillsburg, Pennsylvania.
3. At ail times relevant hereto, Samuel J. Kacyon, Jr. traded and did business as
Samuel J. Kacyon, Jr. Heating & Cooling, with a business address of 419 Old
York Road, Dillsburg, Pennsylvania.
4. Defendant, Harry B. Clark, d/b/a Joy-Ark Builders, vas formerly a general
conh•actor with a business address of 117 Fineview Road, Camp Hill,
Pennsylvania.
5. Joy-Ark Builders is a Pemrsylvania corporation with a registered address of 117
Fineview Road, Camp Hill, Pennsylvania.
G. On or about September 1$, 2002, Defendant, Harry B. Clark, Ud/b/a Joy-Art:
Builders (hereinafter "Joy-Ark Builders") was served with the Complaint attached
hereto as Exhibit "'A". Exhibit "A" is incorporated herein as if fully set forth at
length.
7. The aforementioned Complaint alleges that on or about July 18, 1996, Plaintiffs
and Defendant Joy-Ark Builders entered into a contract, whereby Defendant Joy-
Ark Builders agreed to construct for the Plaintiffs a single-family residence on
real properly located at 1S'fiffmy Drive. Carlisle. Pcmisyh:mia.
8. The Complaint alleges that the Plaintiffs' home contains a defective hcating
system. The Complaint alleges that the defect caused damages to the Plaintiffs'
residence.
9. On or about February 18, 1997, Defendant Hatry B. Clark, Ud/b/a Joy-Ark
Builders, contracted with Additional Defendant, Samuel J. Kacyon, Jr., Ud/b/a
Samuel J. Kacyon, Jr. Healing & Cooling, to install the hcating and cooling
system for the above-referenced property. A copy of statements and proposal
issued to Harry Clark front Samuel J. Kacyon, Jr. is attached hereto as Exhibit "B"
and incorporated as if set forth herein at length.
10. At all times relevant hereto, Additional Defendant was, in pari, in the business of
installing heating and cooling systems in newly constructed residences.
11. Additional Defendant owed a duty to Defendant Joy-Ark and the Plaintiffs to
exercise reasonable care in the installation of the heating and cooling system.
12. If the allegations in the Plaintiffs' Complaint are proven true, then Additional
Defendant breached that duty by negligently installing the heating and cooling
system in the property.
13. If the allegations in the Plaintiffs' Complaint are proven true, then Defendant Joy-
Ark Builders aver that Additional Defendant breached its contract with Defendant
.toy-Ark Builders by failing to correctly install the hcating and cooling system for
the property.
14. Any negligence and/or breach by the Additional Dcfcndant is the direct and
proximate cause of the injuries allegedly suffered by the Plaintiffs.
] 5. Any negligence and/or breach by the Additional Defendant is the direct and
proximate cause of any damages suffered by the. Dcfcndant.
16. Dcfcndant Joy-Ark Builders aver that Additional Defendant is alone liable to the
Plaintiff, or that Additional Defendant is jointly and severally liable to the
Plaintiff, or that the Additional Defendant is liable over to Defendant Joy-Ark
Builders on the Plaintiffs' cause of action.

AND NOW, comes the Plaintiffs, by and through their attorney, and files
this Complaint, as follows:

Plaintiffs James L. Rich and Sharon A. Rich, husband and wife, are adult
individuals currently residing at 18 Tiffany Drive, Carlisle, Pennsylvania.
Defendants Harry B. Clark and Joyce B. Clarke, husband and wife, are
adult individuals, currently residing at 117 Fineview Road, Camp Hill,
Pennsylvania.
Defendants, at all times relevant to this Complaint, operated and did
business under the name "Joy Ark Builders".
On or about July 18, 1996 Plaintiffs and Defendants entered into a
contract (attached and incorporated fully herein as Exhibit "A") whereby
Defendants would construct asingle-family home on Plaintiffs' property
located at 18 Tiffany Drive, Carlisle. (hereinafter referred to as "the
Home")
5• Numerous defects with the Home exist, of which Defendants have failed
and refused to rectify.
6• Due to the defects in the Home, it is believed and therefore averred that
the value of the Home is less than that paid to Defendants under the
contract.
7• The defects in the Home, at (east as known to Plaintiffs at this time,
include:
a. cracks in the foundation of the Home due to improper
placement of footers,
b. cracks throughout interior walls,
c. water seepage in various areas,
d. defective heating system, including lack of adequate system
installation and presence of substantial dust. Such defects
further required the replacement of drywall and repainting of
effected areas,
e. improper placement of dryer vent,
f. Improper hanging of interior doors.
8. Plaintiffs have been required to utilize other contractors in order to rectify
the substandard work performed by Defendants.
9. Defendants have been fully appraised o(these defects, but have not
attempted to resolve the problems.

11. Defendants have breached the contract by:
a. failing to construct a home to the quality or value agreed upon in
the contract,
b, failing to act in good faith or with fair dealing.
WHEREFORE, Plaintiffs respectfully request this Honorable Court enter
judgement for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.

BREACH OFtNARRANTY
12. Paragraphs 1 through 11 are incorporated fully herein by reference.
13. The Home was a newly constructed home.
14. As a new home Plaintiffs provided, as a matter of law, a warranty of
habitability.
15. The defects in the Home, as more fully set forth above, are breaches of
such warranty.
WHEREFORE, Plaintiffs respectfully request this Hanorable Court enter
judgement for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.
COUNT III
NEGLIGENCE
16. Paragraphs 1 through 15 are incorporated fully herein by reference.
17. Defendants owed a duty to Plaintiffs to construct ttie Home using a
reasonable standard of care, skill and workmanship.
18. Defendants breached such duty by failing to utilize such care, skill and
workmanship, and thereby caused Plaintiffs to incur damages.
WHEREFORE, Plaintiffs respectfully request this Honorable Court enter
judgment for them and against Defendants in an amount greater than
$25,000.00, plus interest and costs.

NEGLIGENT MISREPRESENTATION
19. Paragraphs 1 through 18 are incorporated fully herein by reference.
20. Defendants made material misrepresentations to Plaintiffs regarding their
ability to construct a quality home for the money paid, as well as the lack
of defects in the Home, as well as misrepresentations regarding
certification by Comfort Home.
21. Such material misrepresentations were made both prior to entering into
the contract, as well as during the construction process.
22. Such material misrepresentations were made with the intent to induce
Plaintiffs to enter into the contract and accept the Home as constructed.
23. Defendants knew, or reasonably should have known, that Plaintiffs would
rely on such misrepresentations.
24. Plaintiffs did justifiably rely on such misrepresentations, and have suffered
damages as a result of such reliance.
WHEREFORE, Plaintiffs respectfully requests this Honorable Court enter
judgment for them and against Defendants in an amount greater than
$25,000.00, plus interest and casts.

UNFAIR TRADE PRACTICES ACT

26. Defendants actions, as set forth above, constitute unfair and deceptive
acts or practices under Pennsylvania's Unfair Trade Practices Act, in that
Defendants:
a. Represented that there services had characteristics orbenefits
that they did not have;
b. Represented that their services were of a particular standard or
quality, when they were not;
c. Engaged in other fraudulent and deceptive conduct, which
created a likelihood of confusion or misunderstanding.
WHEREFORE, Plaintiffs respectfully request khis Honorable Court enter
judgment for them and against Defendants in an amount greater than

The Complaint does not allege, that at all relevant times hereto, Joy-Ark Builders
was a corporation or registered in Pennsylvania as the fictitious name of Harry B.
Clark and Joyce B. Clark
8. It is an indisputable fact that Joy-Ark Builders was neither a coq oration or a
registered fictitious name at the relevant times hereto of this litigation.
9. Attached to the Complaint and incorl~oratcd therein is a construction contract
dated July 18, 1996.
10. The construction contract identifies the contractor as .loy-Ark Builders.
1 I. The construction contract is signed by Harry B. Clark, contractor.
12. ,loyce B. Clark's name does not appear on the construction contract.
13. Joyce B. Clark did not sign the construction contract.
14. As a matter of law, ,loyce B. Clark cannot be liable raider a contract in which she

therein, expressly provides a limitation of liability.
19. The construction agreement clearly and unambiguously provides that the
cont.ractor's liability to the Plaintiffs is limited for a period of one year from the
date of completion or the date of occupancy, +vhichever occurs first.
20. Pursuant to Paragraph 11 of the construction agreement, the contractor is only
responsible for those defects conlainrd in a +vritlcn list provided +vithin the one-
year period.
21. The contract expressly provides that the one-year warranty cotatrols and is adopted
in lieu of any other warranties, whether expressed or implied bylaw.
22. The Complaint fails to allege that the Plaintiffs delivered to the contractonvithin
the mte year a written list of any of the defects alleged in the Complaint.
23. The Contplainl frill to allege that the defects alleged in the Complaint occurred

phonograph, compact disc or any other sound recording, Document also includes any
card, disc, magnetic tape, printout, data cell, drum and any other data cdmpilations
designed for the storage of information in conjunction with a computer or any other
word/data processing system.
2. "Identify' or "Identity", when used herein with respect to:
a. A natural person means to state:
i. the person's full name;
ii. the person's present or last known address; and
iii. the person's employer and employer's address at the time of
tl~e evenfs referred to in the Interrogatory.
b. An entity other than an individual, including a corporation,
partnership, limited liability company or partnership, unincorporated association,
governmental agency, etc. or a subsidiary, division, or subdivision thereof, means to
state:

ii. the date and place of incorporation, if known;
iii. tl-~e present or last known address of the entity; and
iv. if applicable, the full names and present or last known

films, charts, graphs, videotapes, recordings, and motion pictures); and electrical
records or representations of any kind (including, without limitation, tapes, cassettes,

AND NOW, comes the Plaintiffs, by and through their attorney, Mark K.
Emery, Esquire, and files these Objections to Striking Case Under Local Rule
228, as follows:

Plaintiffs have proceeded on this case throughout the time it has been
docketed.
Plaintiffs have made attempts to resolve this matter with Defendants
during the pendency of the action.
Plaintiffs were not made aware by their prior counsel that the matter was
subject to purge absent their being formally docketed action within a
prescribed time-period.
Plaintiffs had retained the undersigned and were in the process of filing a
Complaint when they were made aware of the placement of this matter on
the purge list.
5. Plaintiffs have since filed a Gomplaint, on September 18, 2002, in an effort
to move this matter forward.
6. The relevant statute of limitations have not expired on the claims set forth
in the Complaint.
7. Defendants have not been prejudiced by the inactivity of docketed action.
WHEREFORE, Plaintiffs respec±fully request this Honorable Court not
dismiss this case.

NEW MATTER
27. Answering Defendant hereby incorporates their answers to Paragraphs 1 through
26 as though the same were set forth in full hereunder.
28. Plaintiffs fail to state a claim upon which relief can be granted under any theory
of la+v.
29. Joyce B. Clark is not a proper party to this litigation
30. The construction contract is signed only by Harry B. Clark.
31. Harry B. Clark's liability under the contract is limited for a period of one year
from the date of completion or the date of occupancy, whichever occurs first.
32. Under the toms of the construction agreement, Harry B. Clark is only responsible
for those defects contained in a written list provided within the one year period.
33. The constmction contract expressly provides that the one year warranty controls
and is adopted in lieu of any other warranties, whether express or in,plicd by law.
34. The Plaintiffs failed to deliver to the contractor within one year of the date of
completion a written list of any of the defects now alleged in the Complaint.
35. The alleged defects complained of in the Crnnplaint did not occur within Iltc one
ycanvarranty period provided for in the conslniction contract.
3G. The alleged defects complained of were not on the punch list provided by the
Plaintiffs to Harry B. Clark.
37. All items on the punch list provided to Henry B. Clark were remedied.
38. Prior to initiating this litigation, the Plaintiffs never informed Harry B. Clark of
the alleged defects stated in the Complaint.
39. Harry B. Clark was never given the opporiwtity to make any repairs of the alleged
defects.
40. The Plaintiffs Complaint is barred in whole or in part by the Doctrine of
Economic Loss.
41. The Plaintiffs Complaint is barred in whole or in pari by the Gist of the Action
Doctrine.
42. The rights and remedies behvecn the Plaintiffs and Defendants are limited as set
forth in the construction contract.

44. The origination of soot in the property is from a fireplace on the second floor
which was not installed by Harry B. Clark or subcontractors employed by Harry B. Clark.
