The Court feels that the case could be tried
in two days with four challenges to each side; Mr. Keller
is unavailable for jury selection on Monday, March 13,
2000, but is otherwise available for trial that week.
Defense counsel raises a question as to the
applicability of Section 1797(a) of the Motor Vehicle
Financial Responsibility Law, and how it should be applied
in this trial. It is the Court's initial feeling that the
gross amount of medicals should be submitted to the jury
and the jury verdict subsequently molded in accordance with
the insurance law; however, defense counsel has an
opportunity to furnish a brief to the Court to determine
what, if any, the jury may have involvement in this
determination by way of a jury interrogatory. The Court
directs that that brief be filed with the Court within
seven days of today's date and defense counsel shall have
seven days to respond.
Each counsel relates to the Court that they
are satisfied with the authenticity of the medical records
in existence, but not necessarily their admissibility,
including photocopies.
Plaintiff's counsel indicates that there
will be a revised vocational report forthcoming, and the
Court directs that that be given to defense counsel by the

Defenciants that Defendant Musser was cited only for the CDL
violation and not for the other violations alleged. The Defendants

License, is irrelevant and immaterial, and the fact of the alleged
citation is inadmissible in this action.

DEFENDANTS' MOTrON FOR CONTINUANCE FROM MARCH 2000 TRIAL TERM
Now come the Defendants, by their attorney, John N. Keller,
and move your Honorable Court for entry of an Order continuing this
case from the March 2000 trial term which begins on March 13, 2000,
for the following reasons:
1.
Counsel for the Defendants is lead counsel for the Plaintiffs
in a Franklin County civil action, Buchanan v. Shank and Morgan
Drive Awav. Inc~, No. A.D. 1993-125, in which a Scheduling
Conference Order was entered by the Honorable Richard J. Walsh on
August 30, 1999, several months before this case was listed for
trial, fixing jury selection for Monday, March 13, 2000, beginning
at 9:30 a.m. Attached hereto and marked "Exhibit A" is a true copy
of the said Scheduling Conference Order.
2.
A summary judgment motion filed by the Defendants on December
9, 1999, seeking dismissal of Defendants Forrester Farms and Daniel
Forrester from this action, remains pending, In response to the
motion, the Plaintiff took the deposition of Defendant Daniel
Forrester on February 8, 2000, however, the Plaintiff has not yet
filed a response to the motion.
3.
At the request of counsel for the Plaintiff on January 11,
2000, deposition of the Plaintiff scheduled for January 13, 2000,
was continued and was rescheduled for February 8, 2000.
4.
At his deposition on February 8, 2000, the Plaintiff denied
certain statements attributed to him by his treating health care
providers in their records and contended that his health care
providers had provided certain advice to him not documented in
their records.
5.
For reasons which include the aforementioned deposition
testimony of the Plaintiff given on February 8, 2000, the
Defendants now intend to schedule and are in the process of
attempting to schedule depositions of some of the Plaintiff's
health care providers who are not expected to testify for the
Plaintiff, however, defense counsel believes that it may not be
possible to schedule these depositions prior to March 13, 2000.
6.
Defense counsel has consulted with an independent physician
who has agreed to review the health care records of the Plaintiff
in this case and who may be asked by the Defendants to provide
trial testimony. Defense counsel is concerned, however, given the
voluminous records which have been generated, that it may not be
possible to provide the Plaintiff with expert discovery prior to
any scheduled deposition or trial testimony of such reviewing

the Plaintiff, Andrew H. Dowling, Esq., and advised that I would be

The Court feels that the case could be tried
in two days with four challenges to each side; Mr. Keller
is unavailable for jury selection on Monday, March 13,
2000, but is otherwise available for trial that week.
Defense counsel raises a question as to the
applicability of Section 1797(a) of the Motor Vehicle
Financial Responsibility Law, and how it should be applied
in this trial. It is the Court's initial feeling that the
gross amount of medicals should be submitted to the jury
and the jury verdict subsequently molded in accordance with
the insurance law; however, defense counsel has an
opportunity to furnish a brief to the Court to determine
what, if any, the jury may have involvement in this
determination by way of a jury interrogatory. The Court
directs that that brief be filed with the Court within
seven days of today's date and defense counsel shall have
seven days to respond.
Each counsel relates to the Court that they
are satisfied with the authenticity of the medical records
in existence, but not necessarily their admissibility,
including photocopies.
Plaintiff's counsel indicates that there
will be a revised vocational report forthcoming, and the
Court directs that that be given to defense counsel by the
