CIVIL ACTION - LAW
COMPLAINT
1. Plaintiff, DONALD E. STEVENS, is an adult, individual
citizen and legal resident of the Commonwealth of Pennsylvania,
residing at 201 North 67th Street, Apt. A, HarriSburg, Pennsylvania
17111.
2. Defendant, THE FORD MOTOR COMPANY (hereinafter "FORD"),
is a business corporation qualified to do business in the
Commonwealth of Pennsylvania, and can be served c/o CT Corporation,
1635 Market Street, Philadelphia, PA 19103.
3. Defendant, KUHNS-HARNISH FORD, INC. (hereinafter "Kuhns-
Harnish"), is a business incorporated in the Commonwealth of
Pennsylvania, with its principal place of business located at 6320
Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania
17055.

BACKGROUND
4. On or about March 28, 1998, Plaintiff purchased a pre-
owned 1994 Ford Econoline Van bearing the Vehicle Identification
Number IFDEE14Y2RHB99723.
The vehicle was purchased and is
registered in the Commonwealth of Pennsylvania.
5. The purchase price of the vehicle, including registration
charges, document fees, sales tax, finance and bank charges totaled
more than $14,995.00.
A true and correct copy of the Sales
Agreement is attached hereto, made a part hereof and marked as
Exhibit "A."
6. In consideration for the purchase of the above vehicle,
Defendant Kuhns-Harnish issued to Plaintiff a 2'-month/3, OOO-mile
warranty.
A true and correct copy of the warranty is attached
hereto, made a part hereof and marked as Exhibit "B."
7. In addition, Plaintiff purchased an Extended Service Plan
warranty, entitled PowertrainCARE for Used Vehicles, from Defendant
FORD, said warranty providing 12-month/12,000-mile coverage. A
true and correct copy of the Extended Service Plan warranty is
attached hereto, made a part hereof and marked as Exhibit "C."
8. Plaintiff avers that as a result of misrepresentations
made to him by Defendant Kuhns-Harnish about the fitness of the
subject vehicle, in addition to the ineffective repair attempts
made by Defendant Kuhns-Harnish and its agents, the vehicle cannot
be used for tr.e purposes intended by Plaintiff at the time of
acquisition. Thus the vehicle is worthless.

9. The first warranty repair attempt is believed to have
occurred on or about March 28, 1998, prior to Plaintiff taking
possession of the vehicle. On that date, Plaintiff pointed out to
Defendant Kuhns-Harnish that the vehicle's radiator was defective
and was leaking.
10. On or about April 1, 1998, Defendant discovered that the
vehicle's radio/cassette player was inoperable, and Plaintiff
returned the vehicle to Kuhns-Harnish for the second warranty
repair attempt.
11. The third warranty repair attempt occurred on or about
April 6, 1998, when the vehicle's odometer showed 67,092 miles. On
that date a repair attempt was made to correct a defect in the
vehicle which caused the vehicle to pull to the right; and three
ball joints were replaced along with a front-end alignment. A true
and correct copy of the repair invoice is attached hereto, made a
part hereof and marked Exhibit "D."
12. The fourth warranty repair attempt is believed to have
occurred on or about April 30, 1998, when the vehicle's odometer
showed 67,387. On that date, a repair attempt was made to repair
a defective power steering pump, to reseal the power steering gear
box, and replace the sector shaft. A true and correct copy of the
repair invoice is attached hereto, made a part hereof and marked
Exhibit "E."
13. The fifth warranty repair attempt: is believed to have
occurred on or about May 18, 1998, when the vehicle's odometer

showed 67,631 miles. On that date, a repair attempt was made to
remedy a defective fuel pump assembly. A true and correct copy of
the repair invoice is attached hereto, made a part hereof and
marked Exhibit "F."
14. The sixth warranty repair attempt is believed to have
occurred on or about August 24, 1998, when the vehicle's odometer
showed 69,044 miles. On that date, a repair attempt was made to
remedy a defective air bag light which was flashing. A true and
correct copy of the repair invoice is attached hereto, made a part
hereof and marked Exhibit "G."
15. The seventh warranty repair attempt is believed to have
occurred on or about September 11, 1998, when the vehicle's
odometer showed 69,3J_8. On that date, a repair attempt was made to
repair a defective anti-lock brake system. A true and correct copy
of the repair invoice is attached hereto, made a part hereof and
marked Exhibit "R."
16. The eighth warranty repair attempt is believed to have
occurred on or about February 3, 1999, when the vehicle's odometer
showed 71,697 miles. On that date, a repair attempt was made to
remedy a squealing noise which was coming from the vehicle, as well
as to perform a State inspection and have the oil and oil filter
changed. A true and correct copy of the repair invoice is attached
hereto, made a part hereof and marked Exhibit "I."
17. The ninth warranty repair attempt is believed to have
occurred on or about February 23/ 1999, when the vehicle' 8 odometer

24. By the terms of the express written warranties referred
to in this Complaint, Defendants agreed to perform effective
warranty repairs at no charge for parts and/or labor.
25. Defendant Ford's authorized service facility has made
attempts on several occasions to comply with the terms of its
express warranties; however, such repair attempts have been
ineffective.
26. As a direct and proximate result of Defendants' failure
to comply with the express written warranties, Plaintiff has
suffered damages and, in accordance with 15 U.S.C. ~2310(d) (1),
Plaintiff is entitled to bring suit for such damages and other
legal and equitable relief.
27. Title 15 U.S.C. provides:
If a consumer finally prevails on an action
brought under paragraph (1) of this
subsection, he may be allowed by the court to
recover as part of the judgment a sum equal to
the amount of aggregate amount of costs and
expenses (including attorney fees based upon
actual time expended), determined by the court

commencement and prosecution of such action,
unless the court, in its discretion shall
determine that such an award of attorney's
fees would be inappropriate.
28. Plaintiff avers that upon successfully prevailing upon
the Magnuson-Moss claim herein, all reasonable attorney fees are
recoverable and are demanded against Defendants.
WHEREFORE, Plaintiff respectfully demands judgment in his
favor and against Defendants in an amount equal to the purchase

EXTENDED SERVICE PLAN PROVISIONS
This is an ESP PowertrainCARE for Used Vehicles service Contract between Donald E. Stevens
and Ford Motor Services Company and is insured by The American Road Insurance Company.
Under this plan, Ford Motor Services Company agrees to repair or replace any covered parts that
fail, or that fail due to normal wcar and tear, within the time and mileage term selected, except for
the deductible stated below, for the plan period.
1. CONTRACT PERIOD. This contract begins when the contract is sold to you. For contracts
purchased prior to the expiration of the manufacturer's powe:train warranty coverage, this
contract provides coverage for 12 months or 12,000 miles from the expiration of the
manufacturer's powertrain warranty coverage, whichever occurs first. For contracts purchased
after the manufacturer's powertrain warranty coverage has expired, this contract provides
coverage for 12 months or 12,000 miles from the contract sale date and miles, whichever
occurs first. Therefore, this contract expires 03-28-1999 or at 78,842 miles, whichever Occurs
first.
2. CONTRACT CHANGES. The expiration date, mileage, and/or options (except for
PowertrainCARE 12112 for vehicles with 90,000 to 100,000 miles) of this contract may be
changed by you within 90 days of the signature date of the contract. Please contact your
selling dealer for additional information.
3. WHERE TO GO FOR REPAIRS. As thc seller of the contract, your dealership is interested
in your satisfaction. It is recommended, therefore, that you return to your sclling dealership
for repair of a covcred COmponent. However, cOI'ered repairs may be performed at any
participating Ford or Lincoln-Mercury dealership in the 50 States and Canada. If you rcquirc
assistance in receiving covcred rcpairs or locating the nearest Ford or Lincoln-Mercury
dealership, Ford/Mercury Owncrs may Contact the Ford Customer Assistance Center at 800-
392-FORD (Lincoln owners 800-521-4140). Covered repairs on a Ford or Lincoln-Mercury
vchicle are not to be performed by mIleI' than a Ford or Lincoln-Mercury dealership, except in
an emergency (if your covered vchicle is inopcrable and all local Ford and Lincoln-Mercury

4. COVERED COMPONENTS. Components covercd by this contract arc shown on the reverse
side. During the Contract Period, Ford Motor Company agrees that its participating, authorized
dealerships will repair or replace covered components found to be defective in factory-supplied
materials or workmanship. For each eligible repair visit, you will be charged a $50 deductible by
the dealership which you must pay.

S. REPAIRS. All repairs of covcred parts MUST be made with service parts or rcmanufactured
parts authorized by Ford Motor Company. In some cases, the use of Ford Authorized
Remanufactured products is required following expiration of the new vehicle warranty. Repairs
will be paid up to the then current N.A.D.A. wholesale value of the vehicle per repair visit.
6. CARE OF VEHICLE. Your vehicle must be properly operated and maintained in accordance
with the maintenance schedule in the Service Guide of the Owner's Manual for the vehicle.
Proof of maintenance may be required before vehicle is eligible for repairs of covercd
components.
7. TRANSPORTATION REIMBURSEMENT. Transportation reimbursement applies only after
it has been determined by the repairing dealer that 1) the repair is covered under this ESP/ESC
contract; or 2) the repair is covered under a manufacturer's new vehicle limited warranty or
powertrain warranty; and 3) the vehicle must be kept overnight by the repairing dealer.
Reimbursement will be made for rental charges incurred up to the plan limits of up to $28/day
(up to $33/day for Lincoln or Merkur vehicles) for up to five days while thc repair is being
completed. The replacement vehicle must be rented from a Ford or Lincoln-Mercury dealership
or other commercial agency to be eligible for reimbursement.
8. TOWING REIMBURSEMENT. If a covered part fails and makcs towing necessary, towing
costs not paid by insurance will be covered for up to $50 to the repairing dealership.
9. TERMINATION.
- All cancellation requests must be submitted in writing by the purchaser to the selling
dealership. If the selling dealership is no longer in business, the purchaser must submit a
writter: request to ESP Headquarters, P.O. Box 6045, Dearborn, Michigan, 48121.
The Application for Contract, Provision Certificate, and odometer reading must be included
with the request.
The customer's refund will be based upon the purchase price paid.
Refunds will be made to the lienholder or purchaser by the selling dealership. If the selling
dealership is no longer in business, refunds will be made to the lienholder or purchaser by ESP
Headquarters.
If this contract is expired by time or mileage or has been transferred, it is not eligible for a
refund.
Options purchased with the plan cannot be cancelled separately from the ESP contract.
FOR CONTRACTS PURCHASED AFTER THE MANUFACTURER'S NEW VEHICLE
LL\1ITED WARRAl\l'Y (OR MANUFACTURER'S POWERTRAIN WARRANTY FOR
POWERTRAL'iCARE FOR USED VEHICLES CONTRACTS) HAS EXPIRED: If the request
is received within sixty (60) days from contract signature date, the sclling dealership will
terminate the agreemcnt and refund the full purchase price, less a fifty dollar ($50) processing

within the applicable statute of limitations. Actions under the
Magnuson-Moss Act may be brought within four years of the discovery
of a defect. Actions arising under the Unfair Trade Practices Law
may be brought within six years of when the cause of action
accrues. Gabriel v. O'Hara, 534 A.2d at 493. As for breach of
express warranty, the applicable statute of limitations, 13
Pa.C.S.A. ~2725, provides that a breach of warranty action must be
commenced within four years from the date it accrues. A claim for
breach of implied warranty accrues on the date the seller delivers
the vehicle. Nationwide Insurance Company v. General Motors
Corporation, 533 Pa. 423, 625 A.2d 1172, 1178 (Pa. 1993).
43. Denied. As stated in the Complaint, Defendant Kuhns-
Harnish issued to Plaintiff a 2 -month/3, 000 -mile warranty in
consideration for the purchase of the subject vehicle. In
addition, Plaintiff purchased an Extended Service plan warranty,
entitled PowertrainCARE for Used Vehicles, from Defendant FORD,
said warranty providing 12-month/12,000-mile coverage.
WHEREFORE, Plaintiff, Donald E. Stevens, respectfully requests
