PETITION FOR PROTECTIVE ORDER
The Plaintiff, through her attorney, Lindsay Darc Baird, Esquire, allcgcs the following:
PROTECTION FROM ABUS~
I. Plaintiff is an adult individual who is rcsiding at J 225 Willow Mill Road,
Mechanicsburg, PA 17055.
2. Dcfcndant is an adult individual whose Icgal rcsidence is 1225 Willow Mill Road,
Mechanicsburg,I'A 17055.
3. The parties were married on Octobcr 16,1982 in Enola, PA..
4. The Defendant has attcmptcd to cause and has intentionally, knowingly, and
recklessly caused bodily injury to plaintiff and to the partics' adopted son, Seth. In addition,
plaintiff has becn placed in fear of imminent bodily injul)' and /01'1 death,
5, On Sunday, April 4, 1999, plaintiff was told by the partics' daughter, Kclly,that
defendant had Seth by the throat in the bathroom, Plaintiff arrin'd at thc bathroom to see
defendant holding Seth off of the ground by his arm and threatening him. Plaintifl'removcd
dcfcndant's hands from the child, An argument ensued and the parties moved to the living room.
After defendant said he "could not stand Seth", plainliffthrew a hasket against the wall in anger.
The basket hit a comer of the curio cahinet. Al plaintill's request. defendant left the residence
and stayed away most of the night. Seth "ustainL'd hruises on his aml \\hich remained for a week.

6. On Saturday, April 17, 1999, uround II :00 P.M., the parties entered into an
argument regurding the household financcs. Defendant grahbed pluintiff and threw her onto the
sofa. No visible injuries were sustuined, but pluintifl'wus very badly frightened and unsure of her
safety.
7. On Sunday, Muy 2. 1999, l\round 4:30 P.M. the pUl1ies entered into an argumcnt
about taking the children out for dinner on Mothers' Duy, Kelly, the daughter, was involved and
as the argument escalated, she threw a basket and pushed the plaintiff onto the sofu. The
argument continued into the bathroom and in order to keep the daughter out of the argument,
plaintiff locked the doors, The daughter kicked a hole in the door before going to her room as
directed. The argument continued outdoors. Plaintiff asked defendant for a receipt which was in
defendant's van and defendant acted suspicious about the contents of his van. When plaintiff
questioned him and tried to look in the van, defendant grabbed plaintiff tightly by the neck, then
anus, and threw her into a stone wall, bruising her anus, leg, and breast. Plaintiff filed a report
with the Silver Springs Police and had pictures taken of her bruises.
8. Defendant directed the arrival of a private investigator to the marital residence for
the purpose of questioning plaintiff: Plaintiff would not answer his questions on the advice of
counsel. The private investigator remained in the home in excess of two bours and lell only aileI'
the police were called and came to the residence.
9. Plaintiff believes and therefore avers that she and the minor child will be in
immediate and present danger of serious ubuse Irom defendant and that she is in need of
protection from abuse.
WHEREFORE, pursuunt to the provisions of the "Protection From Abuse Act" 23
Pa.C.S. ~6101 et seq., plaintifTprays this Honorable Court tn grant the following relief:
A. Grant a Tcmpormy Ordcr pursuunt to the "ProtcctiDn From Abuse Act".

On 5/3/99 at 1000hrs the victim came to the station to report that her husband
and her , into verbal their residence. The husband then grabbe
got a argument at
the victim around both arms and shoved her into a stone wall loca ted outside c
the residence. The victim did not report this to the police a t the time of the
incident because their three children were home at the time and she did not
want to make a big deal out of it in front of the kids, since the kids did not
see'this take place,
The victim did tell me that she has filed for a divorce and t.hings have been
getting ugly around the home. This was the first time t.hat he has became
physical with the victim.
I did take a photo of bruises on the victims right arm. The victim also had a
smaller bruise to her left elbow area.
A citation will be mailed tc t.he defendant for harassment.
The victim said she will try to get a pfa and have the husband eXCluded from
the residence.
