WHEREAS, ROXANN K. GUYER of 1870 Hunter Drive, Mechanicsburg, Pennsylvania, is about
to execute contemporaneously herewith, a contract, with Pollard & Co. of , Pennsylvania,
for the erection of it building upon premises commonly known as LOT 21 ASHCOMBE FARMS, UPPER
ALLEN TWP. MECHANICSBURG, CUMBERLAND County, Pennsylvania, as set forth in the deed dated
recorded at Deed Book , Page , in the Recorder's Office for
CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated
herein and attached hereto.
NOW, APRIL 28, 1999, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owner to the said Contractor to commence work on the
said building, or purchase materials for the same in consideration of the making of the said contract with
Contractor and the flurdter consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that
no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the
materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL, THAT CERTAIN lot in the property known, named and identified in the Declaration,
referenced below, as "Ashcombe Farms F.R.D., a Flexible Residential Planned Community,"
located in Upper Allen Township, Cumberland County, Pennsylvania, which has heretofore been
submitted to the provisions of the Pennsylvania Uniform Planned Community Act, 68 Pa.C.S.A.
§§ 5101 Pt?as amended, by the recording in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania, the Declaration for Ashcombe Farms P.R.D., a Flexible Residential Planned
Community ("Declaration"), dated April 6, 1998, recorded April 131 1998, in Miscellaneous hook 573,
Page; 407, as amended by First Amendment to Declaration for Ashcombe Farms P.R.D., a Flexible
Residential Planned Community, dated March 13, 1999,recorded Marchl9th,1999, in Miscellaneous
Book 607, Page 440, being and designated in such Declaration, as amended as Lot No. 21 (Identifying
Number) described in Section 2.2 of the Declaration
BEGINNING at a concrete monument on the eastern right-of-way line of Rower Court, a
50 foot wide street, said monument being the northwestern corner of Lot No. 20;
`THENCE along said right-of-way line along a curve to the right having a radius of 500.00
feet and an are length of 77.02 feet, said arc being subtended by a chord of North 29
degrees 40 minutes 69 seconds West a distance of 76.94 feet to a concrete monttntont.;
77TENCE continuing along said right-of-way line along a curve to the right having a
radius of 26.00 feet and an arc length of 42,90 feet, said arc being subtended by a chord of
North 23 degrees 53 minutes 20 seconds East a distance of 37.83 feet to n concrete
monument; THENCE continuing along said right-of-way line North 73 degrees 02 minutes
54 seconds East a distance of 95.94 feet to a point, said point being the northwestern
corner of Lot No. 22; TFMCE along the western line of said lot South 16 degrees 57
minutes 06 seconds East a distance of 71.67 feet to a point, said point being the northerly
most corner of Lot No. 20; THENCE along the northern line of said lot South 55 degrees
54 rrdnutes 15 seconds. West a distance of 108,55 feet to a concrete monument, the PLACE
OF BEGINNING,
CONTAINING: 10,164.07 square feet or 0.2333 acres.
UNDER AND SUBJECT, to restrictions and covenants of record, including, but not limited to,
Declaration for Ashcombe Farms P.R.D., a Flexible Residential Planned Community, dated April 6, 1999,
to be recorded in the Office of the Recorder of Deeds of Cumberland County, in Miscellaneous Book
573, Page 407, First Amendment to Declaration of Ashcombe Farms. P.R.D., a Flexible Residential
Planned Community, Dated March 13th, 1999, recorded in the Office of the Recorder of Deeds of
Cumberland County in Miscellaneous Book 607, Page 440, and under and subject, nevertheless, to all
restrictions. Gtsements, covenants and rights-of-way of record, or visible by inspection of premises.
