STONER hereinafter referred ~o as Owner, whereby the former undertook and agreed to construct a single family dwelling, in NOW THEREFORE. THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ONE (i.00) Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. STONER A~LL THAT CERTAIN tract of land situate in Hampden Township, Cumberland County, Pennsylvania, bounded and described in accordance with a survey prepared by Hartman & Associates, Inc., dated March 28, 1995, to wit: BEGIITNING at a point in the low water mark on the West side of the Conodoguinet Creek at the Southeast corner of lands now or formerly of Paul T. Shearer and Violena M. Shearer, his wife; thence on a line North seventy-two (72) degrees ~welve (12) minutes fifty-six (56) seconds West, a distance of two hundred thirty-five (235.00) feet to an iron pin on the western side of a twelve (12) foot macadam cartway; [hence on a line North five (05) degrees fifty-three (53) minutes seventy-one (71) seconds East, a distance of ninety-one and thirty- five hundredths {91.35) feet to an iron pin in corner of lands now or formerly of J. Robert Stauffer; thence on a line South seventy-two (72) degrees forty-five (45) minutes zero (00) degrees East, in lin~ of lands now or formerly of J. Robert Stauffer a distance of two hundred thirty-five (235.00) feet to the low water mark of the Conodoguinet Creek; thence on a line South seven (07) degrees ten minutes thirty (30) seconds West, a distance of one hundred one and fifty-two hundredths (101.52) feet, to the point or place of BEGINNING. ilo.
