STIPULATION AGAINST LIENS
THIS AGREEMENT made the 11114 of
and between Classic Communities, Inc., mt?yr 1999' by
AND
Daniel Deitchman and Jennifer C. Deitchman, hereinafter referred
to as Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
Lot 139, Hampden Hearth, 1202 Montrose Circle, Mechanicsburg,
Hampden Township, Cumberland County, Pennsylvania I,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to Classic Communities, Inc. in hand paid by Owner, the receipt
whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their j
subcontractors and others under them hereby expressly waive and I
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

LEGAL DESCRIPTION
ALL THAT CERTAIN parcel of land situate in the Township of
Hampden, County of Cumberland, State of Pennsylvania and being
more particularly bounded and described as follows:
Beginning at an iron pin at the southern most corner of lot
140 and corner common to lots 136 and 135, said point being
located, South 56 degrees 251 1011 West:, a distance of 145.75
feet-, and South 65 degrees 351 5511 West, a distance of 67.37 feet
from an iron pin on the northeast corner of the lands now or
formerly of R. Eugene Hoerner and the northwesterly corner of Lot
134 and on the westerly right-of-way line of Township Road 600
(Jerusalem Road) ; thence, leaving the said lot 135 and extending
along lots 136 and 137, Soutli 63 degrees 351 5511 West, a distance
of 206.51 feet to an iron pin at the northeasterly comer of lot
138; thence, leaving lot 137 and extending along lot- 138, South
84 degrees 45' 0411 West, a distance of 97.95 feet to a concrete
monument on the easterly right-of-way line of a 50 foot street
known as Montrose Circle, thence, leaving the said lot 138 and
extending along the said Circle, North 01 degree 191 3411 East, a
distance of 100.0 feet to an iron pin at the southwesterly corner
of lot 140; thence, leaving the said right-of--way and extending
along the said lot 140, Soutlt 88 degrees 50' 5411 East, a distance
of 283.35 feet to a point and place of beginning. Containing
17,486.00 square feet and being shown as lot 139 on the Hampden
Hearth Section 4 Subdivision Plan prepared by Grove Associates
and recorded for the County of Cumberland in Plan Book 68 Volume
X Page 66.
BEING THE PREMISES which The H S Service Corporation, Trustee
for I1ampden Hearth Joint Venture, a joint venture of H S Service
Corporation, a Pennsylvania Corporation, and Equico Realty Group,
a Pennsylvania General Partnersliip, by their deed to be recorded
simultaneously herewith in the office of the Recorder of Deeds
of Cumberland County, granted and conveyed unto Daniel Deitchman
and Jennifer C. Deit3chman.
