Revised Rule to Show Cause and motion for Service Pursuant to Special Order of Court by
Publication and Regular Mail Pursuant to Pa.R.C,P. 430, it is Ordered and Decreed as follows:
(i) The Rule to Show Cause dated May 12, 1999 is vacated and the returnable date of
August 12, 1999 is canceled,
(ii) A Rule to Show Cause is issued upon all interested parties to appear and show
cause why a decree should not be made that the property (as described in the Petition which began
this action) be sold freed and cleared of all tax and municipal claims, liens, mortgages, charges and
estates, except separately taxed ground rents.

irrespective of any return as undeliverable.
(iv) Service of the Rule to Show Cause upon John P. Leisey and Carol A. Leisey and
F.G.B. Realty Advisors, Incorporated shall also be made by publication of the Notice in the form
attached to the Motion for Revised Rule to Show Cause and Motion for Service Pursuant to Special
Order of Court by Publication and Regular Mail Pursuant to Pa.R.C.P. 430, as Exhibit "D" once
in the Cumberland Law Journal and once in The Patriot News of Harrisburg, at least 15 days prior
to the rule returnable date set forth above,

AND NOW, this
Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland
County Solicitor, and files this Motion for Revised Rule to Show Cause and Motion for
Service Pursuant to Special Order of Court by Publication and Regular Mail Pursuant
to Pa.R.C.P. 430, of which the following is a statement:
1. On or about May 12, 1999 your Petitioner, the Cumberland County Tax
Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of John P.
Leisey and Carol A. Leisey known as Cumberland County tax parcel number 42-24-
0792-085 to the above captioned term and number.
2. On May 25, 1999 your Honor issued a Rule to Show Cause returnable
August 12, 1999.
3. Service was not able to be made upon John P. Leisey or Carol A. Leisey
at their address as disclosed by the public records, to wit: 283 Crescent Drive,
Hershey, PA 17033 or 262 Crescent Drive, Hershey, PA 17033.

day of January, 2000, comes the Cumberland County Tax
4. Service was also not complete upon F.G.B. Realty Advisors, Inc. at its
address disclosed on the assignment of a mortgage to it, which assignment is
recorded in Cumberland County Miscellaneous Record Book 480, Page 1100, which
address was: Attention: Julie Foster, 8282 South Memorial, Suite 2000, Tulsa,
Oklahoma 74101-3427. The certified mailing sent by the Cumberland County Sheriff
was returned marked "Forwarding Order Expired."
5. Therefore, this case was continued generally by Order dated August 12,
1999.
5. Movant made efforts to locate Carol A. Leisey and John P. Leisey as
described in the Affidavit of Jacob L. Heisey attached hereto, marked Exhibit "A" and
incorporated herein by reference thereto as if fully set forth herein. Movant was unable
to locate Carol A. Leisey or John P. Leisey, however the Cumberland County Tax
Claim Bureau, in August of 1999 sent a letter to Carol A. Leisey at 283 Crescent Drive,
Hershey, PA 17033 and the same was not returned. An envelope sent at the same
time to John P. Leisey at 283 Crescent Drive, Hershey, PA 17033 was returned
marked "Forwarding time Expired, Return to Sender" and noting a forwarding address
for John P. Leisey of 840 Lisburn Road, Apartment C, Camp Hill, PA 17011-7472. In
August of 1999 the Cumberland County-fax Claim Bureau then sent a mailing to John
P. Leisey at the said Camp Hill address, which mailing was not returned. The said
mailings from the Cumberland County Tax Claim Bureau in August of 1999 contained
a copy of the Court's continuation Order of August 12, 1999.
7. Thereafter counsel for Movant sent a letter to John P. Leisey and Carol A.
Leisey to 840 Lisburn Road, Apt. C, Camp Hill, PA 17011 and also to c/o Remax

Associates 3425 Market Street, Camp Hill, PA 17011. A copy of said letter is attached
hereto as Exhibit "B" and incorporated herein by reference thereto.
8. Movant made efforts of locate F.G.B. Realty Advisors, Incorporated as
described in the Affidavit of Jacob L. Halsey and Stephen D. Tiley attached hereto,
marked Exhibit "C" incorporated herein by reference thereto as if fully set forth herein.
Movant was unable to locate a current address for F.G.B. Realty Advisors,
Incorporated.
9. Movant requests an Order for Service by Publication upon John P. Leisey
and Carol A. Leisey and F.G.B. Realty Advisors, Incorporated pursuant to Pa.R.C.P.
430 with the advertisement attached hereto as Exhibit "D."
10. As a hearing at the rule returnable date of August 12, 1999 was not able
to be held because service had not been made, Movant requests a new rule
returnable date of on or after February 15, 2000.
WHEREFORE, Movant prays your Honorable Court as follows:
(i) That a new Rule be issued with a rule retunable date on or
after February 15, 2000;
(?i) Order service of the Rule to Show Cause upon John P.
Leisey and Carol A. Leisey and F.G.B. Realty Advisors,
Incorporated, by publication of the advertisement attached hereto
as Exhibit "D" once in the Cumberland Law Journal and once in t.;
The Patriot News of Harrisburg, Pennsylvania, at least 15 days
prior to the rule returnable date, and; f ?i,
(iii) Order that service upon John P. Leisey, also be made by
mailing of a certified copy of the Rule by ordinary United States
mail to him at 840 Lisburn Road, Apartment C, Camp Hill, PA
17011-7472, upon Carol A. Leisey by mailing a certified copy of
the Rule by ordinary United States mail to her at 283 Crescent
Drive, Hershey, PA 17033, upon F.G.B. Realty Advisors,
Incorporated by mailing a certified copy of the Rule by ordinary
United States mail to it at Attention Julie Foster, P,O.Box 3427,
Tulsa, Oklahoma 74101-3427, and that each such service be
complete upon mailing, regardless of whether or not the envelope
is returned undeliverable.

the memorandum to Stephen D. Tiley dated November 16, 1999 and materials
attached thereto, all of which is attached hereto as Attachment One and are

The following efforts have been made to reach the Leiseys:
¦ Several phone calls to their home phone 717-975-9731, 840 Lisburn Road, Apt. C,
Camp Hill (Lower Allen Twp.) and Mr. Leisey's place of employment, RE/MAX
REALTY ASSOCIATES, 3425 Market St,., Camp Hill, 717-761-6300. No answer
at home number and not in at office.
Further attempts to locate FGB at Tuisa. On recent trip to Tulsa, I stopped at the
address formerly known to be that of FGB Realty Advisors, Inc. This office is now
occupied by another financial business. Receptionist claimed to have no knowledge
of former tenant. A call to PA Corporation Bureau listed FGB as a Texas based
firm with an address at 14651 Dallas Parkway, Dallas, TX 75240. Also process agent
as C T Corporation System, 1635 Market St., Philadelphia. I first tried directory
assistance for phone number of FGB, Dallas. No listing. I got a phone number from
directory assistance for C ,r Corp. System of 215-563-7750. I called and talked to the
receptionist who advised me that service for FGB was discontinued 4-99. No further
information available.
I had furnished you with the Lisburn Road address for Leiseys some time ago but I don't
know if this was ever given to the Sheriff's Dept. for a service attempt.
I will continue to try to reach one of the Leiseys by phone in hopes of learning more
about the situation.

The following contacts have been made or attempted to locate the above:
Called Department of Banking for Oklahoma, Oklahoma City, OK 405-521-2783. Advised
that office has no record of FGB Realty Advisors.
• Called Department of Consumer Credit on suggestion of Dept, of Banking. No record.
• Called Insurance Department of Oklahoma and received same response.
• Called my brother who lives in Tulsa. He checked current telephone directories, both White
Page and Yellow Page sections and could not find a listing for FGB Realty Advisors.
¦ Call phone number listed on Web Page (918-459-3000) and received a recorded message that
number is not in service - no further information available.
All attempts were made on September 27, 29 & 30, 1999.
A further review of the records in the Recorder of Deeds Office relative to this matter still ends
with the Assignment from Homestead Savings to FGB.
As you are already aware, the P.O. Box had been closed and the street address used by the
Sheriff's Office was returned undelivered.
I can think of any other places to look.

The following efforts have been made to reach the Leiseys:
Several phone calls to their home phone 717-975-9731, 840 Lisburn Road, Apt. C,
Camp Hill (Lower Allen Twp.) and Mr. Leisey's place of employment, RE/MAX
REALTY ASSOCIATES, 3425 Market St,., Camp Hill, 717-761-6300. No answer
at home number and not in at office.
Further attempts to locate FGB at Tulsa. On recent trip to Tulsa, I stopped at the
address formerly known to be that of FGB Realty Advisors, Inc. This office is now
occupied by another financial business. Receptionist claimed to have no knowledge
of former tenant. A call to PA Corporation Bureau listed FGB as a Texas based
firm with an address at 14651 Dallas Parkway, Dallas, TX 75240. Also process agent
as C T Corporation System, 1635 Market St., Philadelphia. I first tried directory
assistance I'or phone number of FGB, Dallas. No listing. 1 got a phone number from
directory assistance for C T Corp. System of 215-563-7750. 1 called and talked to the
receptionist who advised me that service for FGB was discontinued 4-99. No further
information available.
I had furnished you with the Lisburn Road address for Leiseys some time ago but I don't
know if this was ever given to the Sheriffs Dept. for a service attempt.
I will continue to try to reach one of the Leiseys by phone in hopes of learning more
about the situation.

On September 26, 19991 performed an internet search using my Earthl-ink
home page search engine for "F.G.B. Realty Advisors". I obtained one "hit" which
seemed to provide an address. Enclosed please find a two-sided copy of a portion of
a web page which provided an address for F.G.B. Realty Advisors, Inc. At the end of
the second page is the citation to the web page from which the copy was made. I
have highlighted the address. Interestingly, the web page indicates that company
was added in March of 1998, which would make it fairly recent. You will see that there
are also telephone numbers and a contact individual.
Next enclosed is a copy of the Sheriffs return for F.G.B. Realty Advisors, Inc. As
you can see, the Sheriffs copy included a copy of the certified envelope marked
Return and what I can guess is "Forwarding Order Expired." Notwithstanding that,
they mistakenly copied the return receipt card for Eastern Savings Bank. The Eastern
Savings Bank return receipt card should be considered an irrelevance. You know
from my memorandum of September 22, 1999, my analysis of the Eastern Savings
Bank judgement showed that that judgement was not related to the mortgage
ultimately assigned to F.G.B. Realty Advisors, Inc.
It is interesting to note that the address on the Sheriffs return is the same or
very similar to that which was on the web page. Unfortunately, the state and zip code
is illegible on the Sheriff's return. Why this address was used by the Sheriff I do not
know. Paragraph 4c of the original Petition, which provided addresses to the Sheriffs
office, showed a P.O. Box for F.G.B. Realty Advisors.
It may be desirable to try call F.G.B. Realty Advisors and see if you can reach

them. We do need to conclude this research and the Leisey research as soon as
possible so that we can get Order signed and service started by this Friday. If not, we
will not be able to have this case on the same schedule as the others, with a hearing

PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this
Petition for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P. S. §5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale: 1996
through and including 1997 Cumberland County, Cumberland
County Library and Upper Allen Township real estate taxes. 1995-
96 through and including 1997-98 Mechanicsburg Area School
District real estate taxes. Total amount of claim, including penalty
and interest as of date of tax sale: $4,290.53.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 28, 1998.
d. Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. §5860.605, which upset price
was $5,625.73.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the
public sale sufficient to pay the said upset price.

3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
42-24-0792-085. The property is situate in Upper Allen Township, Cumberland
County, Pennsylvania, and is known as 497 Lexington Avenue.
4. The names and addresses of all parties holding tax and municipal claims,

AND NOW, comes the Cumberland County Tax Claim Bureau, by its attortL4y,

Petition for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale: 1996
through and including 1997 Cumberland County, Cumberland
County Library and Upper Allen Township real estate taxes. 1995-
96 through and including 1997-98 Mechanicsburg Area School
District real estate taxes. Total amount of claim, including penalty
and interest as of date of tax sale: $4,290.53.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 28, 1998.
d. Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. §5860.605, which upset price
was $5,625.73.
e. Your Petitioner, the Bureau, was unable to obtain a bid at the
public sale sufficient to pay the said upset price.

AND DISTRIBUTION OF SALE PROCEEDS
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72 P.S.
§5860.101 et seq.
2. This Petition for Confirmation of Judicial Sale concerns a parcel of real
estate which was successfully sold at a Judicial Sale of real estate on April 28, 2000,
which was tax parcel number 42-24-0792-085, owned prior to the Judicial Sale, or
reputedly owned prior to the Judicial Sale, by John P. Leisey and Carol A. Leisey, and
consisting of the property situate in the Upper Allen Township, Cumberland County,
Pennsylvania, and is known as 497 Lexington Avenue. The property was sold on April
28, 2000 by the Cumberland County Tax Claim Bureau pursuant to the Court's Order
of March 1, 2000 ordering and directing that the property be sold to the highest bidder
freed and cleared of all tax and municipal claims, liens, mortgages, charges and
estates, except separately taxed ground rents.
3. The said Order of March 1, 2000 directed that advertisement of such sale
be made by one insertion in two newspapers of general circulation in Cumberland
eauon Tor confirmation of Judicial Sale (Parcel No. 42.24-0792-085) Page I
County and one insertion in the Cumberland Law Journal, all of which at least thirty
(30) days prior to the sale date. Proofs of such publication are attached hereto,
marked Exhibit "A", and incorporated herein by reference thereto.
4. At the said Judicial Sale on April 28, 2000 the property of John P. Leisey
and Carol A. Leisey known as tax parcel number 42-24-0792-085 was sold for
$58,500.00, a price in excess of the minimum bid acceptable to the Tax Claim
Bureau, to Mark B. Evans and Marion E. Evans of 918 D Ricketts Road,
Mechanicsburg, PA 17055, who paid said purchase price to the Tax Claim Bureau at
the time of sale.
5. After the sale, on May 2, 2000, John P. Leisey and Carol A. Leisey were
mailed separate notices that the property had been sold, both such notices to: 840
Lisburn Road, Apt. C., Camp Hill, Pennsylvania 17011, as evidenced by the copies of
Notice and receipt for mailing attached hereto, marked Exhibit "B" incorporated herein
by reference hereto. The envelope was sent by certified return receipt fee and
postage prepaid, however, neither the return receipt cards nor the envelope were
returned to the Tax Claim Bureau. It is noted that service of the Order and Rule to
Show Cause ordering the sale was made by publication pursuant to the Court's Order
and Rule of January 19, 2000.
6. The title report and copy of the prior deed which were intended to be
attached to the Petition which initiated this action are attached hereto as Exhibit "C."
7. This is no express post-Judicial Sale procedure known to your Petitioner
except for the following portion of 612(a) of the Real Estate Tax Sale Law:

Out of the proceeds of such sale shall be paid the costs set forth in
the upset price at the prior sale, and the additional costs incurred relative to
this sale, including the fee for title search.... The remainder of said proceeds
shall be distributed by the office designated by the county commissioners
under section 205. After the purchaser shall have paid over the purchase
price, the bureau shall make and deliver a deed in the manner herein-before
provided.
72 P.S. §5860.612(a) (footnote omitted). The reference to Section 205 is, of course,
72 P.S. §5860.205. Your Petitioner, however, desires to proceed by a procedure
analogous to the Consolidated Return to Court Procedure set forth in §607 of the Real
Estate Tax Sale Law (72 P.S. §5860.607), however without the requirement of certified
mail, restricted delivery, return receipt requested for the post-sale notice to the prior
owner. (§607 is applicable to annual "upset" tax sales where the Bureau sells
properties subject to all liens, and without prior Court involvement. The subject of this
Petition is a "judicial" sale where the Bureau sells property free of most liens after a
Rule to Show Cause, notice to creditors, and hearing.)
8. The property sold on April 28, 2000 was subject to a mortgage in favor of
F.G.B. Realty Advisors, Inc., but your Petitioner was unable to locate F.G.B. Realty
Advisors, Inc. and so that mortgagee was served by publication. The underlying
mortgage was recorded on April 22, 1988 and in the just sum of $73,500.00. (See
Motion for Revised Rule to Show Cause and Motion for Service Pursuant to Special
Order of Court by Publication and Regular Mail Pursuant to Pa. R.C.P. 430 filed
I
January 18, 2000.) The mortgage is recorded in Cumberland County Mortgage Book
900, Page 873. The only and last assignment is to F.G.B. Realty Advisors,
Incorporated and is recorded in Cumberland County Miscellaneous Record Book 480,
Page 1100.
9. There exists a Federal Tax Lien against this property in the amount of

$29,069.00 as filed on August 2, 1994. The Internal Revenue Service now claims the
total due as of May 31, 2000 to be $48,106.54. See copy of the notice faxed May 5,
2000 by the I.R.S. attached hereto as Exhibit "D."
10. The property which is the subject of this Judicial Sale is subject to a
Declaration recorded in Cumberland County Miscellaneous Record Book 300, Page
612, creating the Ridge Court Home Owners Association, which Declaration is
incorporated herein by reference thereto as if fully set forth herein.
11. This action was initiated by Petition For Rule For Judicial Sale filed on
May 17, 1999.
12. Exhibit "E" attached hereto is a statement from the Ridge Court Home
Owners Association showing a total of $720.00 fees due on May 17, 1999 of which
$144.00 was due for fees incurred during the six months immediately preceding May
17, 2000. Said statement also indicates that $1,458.00 was due as of April 28, 2000,
the date of the Judicial Sale.
13. Neither the said Declaration nor the existence of the Ridge Court Home
Owners Association was disclosed on the title report received by the Tax Claim
Bureau. The Ridge Court Home Owners Association was not listed as a creditor at
paragraph 4 of the Petition For Rule For Judicial Sale and was not served with the
Petition for Rule to Show Cause, however, the Tax Claim Bureau believes, and
therefore avers, that the Ridge Court Home Owners Association would not have been
able to show any reason why the Judicial Sale should not have been held and that
therefore the result would not have been different.

14. Section 5102(b) of the Uniform Planned Community Act (68 Pa.C.S.A.
§5101 et. seq.) makes Section 5315 of that Act, relating to "Lien for assessments"
applicable retroactively to all planned communities in the Commonwealth.
15. Section 5315(b) of the Uniform Planned Community Act gives the lien for
assessments fourth priority after (paraphrasing): (i) Liens recorded prior to the
Declaration; (ii) First mortgages recorded prior to the due date of the assessment;
and (iii) "Liens for real estate taxes and other governmental assessments or changes
against the unit." The Bureau believes, and therefore avers, that clause (iii) does not
include I.R.S. tax liens in "other governmental assessments or changes."
Furthermore Section 5315(b)(2) of the Act provides that assessments made within six
months immediately preceding institution of this action are not divested by Judicial
Sale and that the association's assessments shall be paid before any other creditor
to the extent that there are sale proceeds left over after paying the claims described at
(i),(ii), and (iii) of this paragraph.
16. Distribution of sale proceeds by the Bureau is controlled by 72 P.S.
§5860.205(d) according to the following priority:
(1) First, to the Commonwealth, by payment to the State Treasurer through
the Department of Revenue, for satisfaction of tax liens of the
Commonwealth oniy if the total amount of such liens or such portion
thereof have been included in the purchase price and paid by the
purchaser or the property is sold at judicial sale pursuant to this act.
(2) Second, to the respective taxing districts in proportion to the taxes due
them.
(3) Third, to taxing districts or municipal authorities for satisfaction of municipal
claims.
(4) Fourth, to mortgagees and other lien holders, in order of their priority, for
satisfaction of mortgages and liens as they may appear of record,

whether or not discharged by the sale.
(5) Fifth, to the owner of the property.
17. Attached as Exhibit "F" is a Schedule of Distribution of Sale Proceeds
showing $47,366.80 available for distribution to F.G.B. Realty Advisors, Inc., the Ridge
Court Home Owners Association, the Internal Revenue Service, or other lien holders.
18. The lien of Ridge Court Home Owners Association (except $144.00 for
assessments six months prior to instituting this action) and the lien of the Federal Tax
Lien is inferior to the prior mortgage however since the Tax Claim Bureau has been
unable to contact the mortgagee, F.G.B. Realty Advisors, Inc., the Bureau cannot
determine what amount of the net proceeds of sale, if any, is due F.G.B. Realty
Advisors, Inc.
19. Your Petitioner has been unable to find a statutory procedure providing
guidance as to the distribution of the net proceeds in this instance, and, specifically,
addressing whether funds should.be held in the event that the first mortgage should
appear, or whether the first mortgager should be deemed to have abandoned its
interest in the mortgage for failure to maintain a presence, or if the mortgage was
assigned, for failure to have recorded an assignment of the mortgage. (Petitioner has
reviewed 21 P.S. §683 and 686, both repelled in part, but determined that neither j
P
provide sufficient guidance in this instance.)
20. As of the date of this Petition the mortgage given by John P. Leisey and
Carol A. Leisey to Homestead Savings Association by instrument dated April 21, 1988
and recorded April 22, 1988 in Cumberland County Mortgage Book 900, Page 873 in
Petition for Confirmation of Judicial Sale (Parcel No. 42-24-0792-085) Page 6
the amount of $73,500,00 which mortgage was assigned to FGB Realty Advisors,
Incorporated by instrument recorded April 22, 1988 in the Cumberland County
Miscellaneous Record Book 480, Page 1100, remains without further recorded
assignment by FGB Realty Advisors, Incorporated; and the Tax Claim Bureau has
received no contact nor does it know how to contact FGB Realty Advisors,
Incorporated.
21. After the initial Petition for the sale of this property was filed the Bureau
became aware that the prior owner had entered into a 'lien spread agreement' by
Agreement dated October 8, 1990 and recorded in Cumberland County
Miscellaneous Record Book 389, Page 340. That agreement purports to "spread" the
lien of five mortgages over a number of properties, one of which is the property at 497
Lexington Avenue, Upper Allen Township, Cumberland County, Pennsylvania, which
is the subject of these proceedings.
22. One of the five mortgages mentioned in the lien spread agreement is the
mortgage recorded at Cumberland County Mortgage Book 900, Page 873, and last
assigned to F.G.B. Realty Advisors, and oringially covering the property which is the
subject of these proceedings. (See paragraph 8 of this Petition.) None of the other
four mortgagees were served with the Petition for Rule to Show Cause in this action,
although the effect of the lien spread agreement and any duty to serve these four
mortgagees is unclear. The Tax Claim Bureau believes, and therefore avers, that the
said other four mortgagees (identified in the next paragraph) would not have been
able to show any reason why the Judicial Sale should not have been held and that
therefore the result would not have been different.

23. The four additional mortgagees under the lien spread agreement are:

as last assignee of a mortgage recorded In Cumberland County Mortgage Book 755,

b) Eastern Savings Bank, FSB of 11350 McCorrmick Road, Building
2, #200, Hunt Valley Maryland 21031, as last assignee of a mortgage recorded in
Cumberland County Mortgage Book 891, Page 322.
C) M & T Bank, c/o Keystone Financial Bank, N.A., of One Keystone
Piazza, First and Market Streets, Harrisburg, Pennsylvania 17101, successor to
Homestead Savings Association, mortgagee of a mortgage recorded in Cumberland
County Mortgage Book 895, Page 318.
d) M & T Bank, c/o Keystone Financial Bank, N.A., of One Keystone
Piazza, First and Market Streets, Harrisburg, Pennsylvania 17101, successor to

24. Petitioner intends to have each of the additional rnortgagees listed at
paragraph 23 herein served with a copy of this Petition and Rule in order to provide
them with the opportunity to make any challenges to the sale, and to make any claims
to the net proceeds available for distribution.

25. Petitioner believes, and therefore avers, that the aforementioned
mortgage now held of record by FGB Realty Advisors, Incorporated should be deemed
abandoned and none of the net proceeds available for distribution should be
allocated to it.
26. Petitioner believes, and therefore avers, that the four additional
mortgagees named at paragraph 23 herein do not have an interest in the net
proceeds and none of the net proceeds available for distribution should be allocated
to them.
27. Petitioner proposes that the $47,366.80 of net proceeds of this Judicial
Sale, after the payment of all taxes and expenses (see Exhibit "F"), should be
distributed as follows:
a) $1,458.00 to the Ridge Court Home Owners Association, and
b) $45,908.80 to the United States Treasury.
28. Section 205(e) of the Real Estate Tax Sale Law (72 P.S. §5860.101 et.
seq.) provides as follows:
Prior to the actual distribution required by subsection (d), the bureau shall
petition the court of common pleas for a confirmation of distribution. The
petition shall set forth a proposed schedule of distribution for each account
and shall request the court to issue a rule to show cause on each distributee I
why the court should not confirm the distribution as proposed. The rule to
show cause and a copy of the petition shall be served by first class mail upon
each distributee and upon the purchaser, with proof of mailing to the last
residence or place of business of the distributee known to the bureau and to
the purchaser at the address given to the bureau. If the rule to show cause
is not returned by any distributee or purchaser, on or before the time set for its
return, the court shall forthwith confirm the distribution absolutely. If any
distributee or purchaser makes a return of the rule within the time set by the
court, the court shall forthwith hear any objections and exceptions to the
proposed distribution and thereafter adjust the schedule of distribution as it

deems just and equitable according to law and confirm the distribution
absolutely as adjusted. An absolute confirmation of distribution by the court
shall be final and nonappealable with respect to all distributees listed in the
petition.
20, The post-upset sale procedure of Section 607 of the Real Estate Tax
Sale Law (referred to by analogy, see paragraph 7 of this Petition) suggests that a
Confirmation Nisi be issued however Petitioner requests that the Court issue a Rule
to Show Cause why the sale should not be confirmed absolutely and the proposed
distribution set forth in Exhibit "F" and paragraph 27 herein confirmed. There being no
statutory post Judicial Sale confirmation procedure, the Bureau avers that the only
party with standing to challenge the sale would be the Ridge Court Home. Owners
Association.
30. Your Petitioner respectfully requests that the Rule be Returnable on or
after December 15, 2000 in order to allow publication and service thereof.
31. Your Petitioner respectfully requests that the Court's Rule to Show
Cause provide that a notice on the form attached hereto as Exhibit "G" be published
once in The Cumberland Law Journal, The Carlisle Sentinel, and The Harrisburg
Patriot News, within fifteen (15) days of the date of the Rule.
32. Your Petitioner further requests that a copy of the Court's Rule to Show
Cause also be served upon John P. Leisey at 840 Lisburn Road, Apt. C., Camp Hill,
PA 17011-7472, upon Carol A. Leisey at 283 Crescent Drive, Hershey, PA 17033,
and upon F.G.B. Realty Advisors, Incorporated Attn: Julie Foster, P.O. Box 3427, Tulsa,
OK 74101-3427 by regular United States mail, complete upon mailing, irrespective of
any return as undeliverable.

Tax Claim Bureau.
34. Your Petitioner further requests that service of the Court's Rule to Show
Cause upon Ridge Court Home Owners Association, and upon the four mortgagees
named at paragraph 23 of this Petition, be made by the Cumberland County Sheriff,
as original process.

NOTICE IS HEREBY GIVEN by
the Tax Claim Bureau in and for the
County of Cumberland under the Act
No. 542 of 1947, Article VI, Section
612, that the said Bureau will expose
at Judicial Sale in the Cumberland
County Old Courthouse, One Court-
house Square, in the Borough of Car-
lisle, Pennsylvania, at 11:00 A.M. on
April 28, 2000, as previously adver-
tised in the Paulot-News and the
Sentinel on August 11. 1998, the
Shippensburg News-Chronicle on
August 10, 1998, and In the Cumber-
land Law Journal on August 14.

The property will be sold free and
clear of all taxes and municipal
claims, mortgages, bens, charges,
and estate whatsoever kind, except
ground rents, separately taxed and
2000 taxes which will not be dis-
charged by this sale.
The Real Estate Tax Sale Law pro-
vides that "There shall be no re-
demption of any Property after the
actual sale thereof, and the sale;
when confirmed shall be deemed to
pass a good and valid title to the
purchaser". (501(c) of Real Estate
Tax Sale Law). The sale of any prop-
erty may be stayed if the owner
thereof or any interested party pays
the delinquent tax amount and costs
in full prior to the time of sale.
CONDITIONS OF SALE
Successful bidders at the Judicial
Sale will be required to provide certi-
fication to the Bureau that he or she
is not delinquent in paying real estate
taxes to any of the taxing districts in
the county where the property is lo-
cated and that the successful bidder
has no municipal utility bills that are
more than one year outstanding.
Certification shall be by actual re-
ceipts of paid real estate taxes and
municipal utility bills or by a nota-
rized affidavit that all such taxes and
bills are paid. Affidavits for certlfica-
ran will be available at the time and
place of sale. Successful bidders will
need photo identification for notary
of the certification. The Cumberland
County Tax Claim Bureau requires
that certification be provided at the
time of successful bid and payment
of tire purchase price.
The purchaser of any properly at
any such sale shall, as soon as the
property Is struck down, pay to the
Bureau the entire purchase money.
Payment shall be cash in the form of
currency of the United States or
check payable to County of Cumber-
land. In case said amount is not so
paid, the sale shall be voided and the
property shall be put up again at the
same sale. Deeds for the premises
will be prepared by the Tax Claim
Bureau and recorded and mailed to
the address given by the buyer at the
Cumberland Notices

sale. Buyers will be required to pay,
in addition to their bid, at the time
the property is struck down to them,
the basic sum of recording the deed,
and the cost of such realty transfer
tax as may be necessary.
NO SALE of property will be made
at the time unless a bid is received
equal to or greater than the fixed
bidding price.
It is strongly urged that the pro-
spective purchasers have examina-
tion made of the tide to any property
in which they may be interested.
Every reasonable effort has been made
to keep the proceedings free from
error. However. In every case, the Tax
Claim Bureau, does not guarantee or
wan-ant. as to eidstence, correctness
or ownership, size, boundaries, loca-
tion, structures, or lack of structures
upon the land, or any other matter,
or thing whatsoever. All sales will be
made under these conditions and
will be final. No adjustments will be
made after the property is struck
down.

listed in the Petition as West Shore Area instead of Mechanicsburg Area, at which
point I served Mechanicsburg Area School District by sending a copy of the Order and
Rule to Show Cause dated October 31, 2000, together with its Petition for
Confirmation of Judicial Sale and Distribution of Sale Proceeds, by mailing a certified
copy of that Order and Rule to Show Cause to the hereinafter named attorney for the
Mechanicsburg Area School District on November 8, 2000 by regular United States
mail, postage prepaid to:
