Your Petitioner, the Bureau, was unable to obtain a bid at the public sale sufficient to pay the said upset price. 3. Attached hereto, marked Exhibit "A," and incorporated herein by reference as if fully set forth herein, is a copy of a title report received from a title searcher retained by the Bureau together with a reduced copy of the most recent deed for the subject premises, as of the date of the search. The tax parcel number of the property is 05-20-1798-299. The property is situate in Borough of Carlisle, Cumberland County, Pennsylvania, and is known as 161 West Locust Street or Avenue. 4. The names and addresses of all parties holding tax and municipal claims, liens, mortgages, ground rents, charges and estates against the property are as follows: a. Cumberland County Tax Claim Bureau Cumberland County Courthouse Carlisle, Pennsylvania 17013 Delinquent taxes payable through March 31, 1999: $1,721.88. (Includes taxes through 1998 County, Library and Borough now returned to Tax Claim Bureau.) b. Darlene L. Moyer, Tax Collector P.O. Box 128 Carlisle, Pennsylvania 17013 1998-99 Carlisle Area School District taxes payable at penalty in the amount of $196.59. c. The last known address of the owner of the property as set forth in the assessment records of Cumberland County is: P.O. Box 684 Carlisle, PA 17013. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called "Bureau") created under the provisions of the Real Estate Tax Sale Law of the Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72 P.S.§5860.101 et sic. 2. This Petition for Confirmation of Judicial Sale concerns a parcel of real estate which was successfully sold at a Judicial Sale of real estate on September 24, 1999, which was tax parcel number 05-20-1798-299, owned prior to the Judicial Sale, or reputedly owned prior to the Judicial Sale, by William P. Stanton, and consisting of the property situate in the Borough of Carlisle, Cumberland County, Pennsylvania, and is known as 161 West Locust Street or Avenue. The property was sold on September 24, 1999 by the Cumberland County Tax Claim Bureau pursuant to the Court's Order of August 12, 1999 ordering and directing that the property be sold to the highest bidder freed and cleared of all tax and municipal claims, liens, mortgages, charges and estates, except separately taxed ground rents. 3. The said Order of August 12, 1999 directed that advertisement of such sale be made by one insertion in two newspapers of general circulation in Cumberland County and one insertion in the Cumberland Law Journal, all of which at least thirty (30) days prior to the sale dale. Stanton known as tax parcel number 05-20-1798-299 was sold for $937.04 (including transfer tax and recording fee), a price equal to or in excess of the minimum bid acceptable to the Tax Claim Bureau, to The Cumberland County Housing Authority, of 114 N. Hanover St., Carlisle, PA 17013, who paid said purchase price to I the Tax Claim Bureau at the time of sale. "I 5. After the sale, on September 30, 1999, the estate of William P. Stanton lIJ was mailed a notice that the property had been sold, to the address of his sister Betty L. Stanton Ettress, to wit: 154 West North Street, Carlisle, PA 17013, as evidenced by the copy of the Notice and receipt for mailing attached hereto, marked Exhibit "B" incorporated herein by reference hereto. The envelope was sent by regular United States mail. 6. The title report and copy of the prior deed which were intented to be attached to the Petition which initiated this action are attached hereto as Exhibit "C." 7. There is no express post-Judicial Sale procedure known to your Petitioner except for the following portion of 612(a) of the Real Estate Tax Sale Law: Out of the proceeds of such sale shall be paid the costs set forth in the upset price at the prior sale, and the additional costs incurred relative to this sale, including the fee for title search.... The remainder of said proceeds shall be distributed by the office designated by the county commissioners under section 205. After the purchaser shall have paid over the purchase price, the bureau shall make and deliver a deed in the manner herein-before provided. 72 P.S. §5860.61 2(a) (footnote omitted). The reference to Section 205 is, of course, to 72 P.S. §5860.205.
