the Cumberland Law Journal and once in The Sentinel of Carlisle, Pennsylvania, at least 15 days
prior to the rule returnable date set forth above.
(v) Service of a copy of this Order and Rule to Show Cause shall be made upon

MOTION FOR SECOND REVISED
RULE TO SHOW CAUSE
AND NOW, this day of November, 1999 comes the Cumberland County
Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland County
Solicitor, and files this Motion for Second Revised Rule to Show Cause, of which the following is
a statement:
1. By Order and Rule to Show Cause dated September 23, 1999 the Court vacated a
prior rule returnable date and established a new rule returnable date of October 21, 1999. That
Order required, inter alia, service by publication on Saundra S. Lopez at least fifteen (15) days
prior to the said rule returnable date.
2. Service by publication of the prior rule returnable date was not able to be made at
least fifteen (15) days prior to that date. Therefore, at the rule returnable date, the matter was
continued.
3. Movant requests a new rule returnable date toward the end of January of the year
2000 and an Order directing service by publication, at least fifteen (15) days prior to that rule
returnable date pursuant to the advertisement attached hereto as Exhibit "A."
4. Movant requests Your Honorable Court to enter an Order for Service by ordinary
mail upon Saundra S. Lopez at 4 Marshall Boulevard, No. 4, Lexington Park, Maryland 20653
complete upon mailing irrespective of whether the said envelope is returned undeliverable.
5. Movant requests Your Honorable Court for an Order directing service upon the
remaining parties to this action by regular mail.
WHEREFORE, Movant prays Your Honorable Court as follows:
i. That the rule returnable date of October 21, 1999 be canceled;
ii. That a new Rule be issued with a rule returnable date set during the last two
weeks of January of the year 2000.
iii. That service upon Saundra S. Lopez be by publication of the advertisement
attached hereto as Exhibit "A" once in the Cumberland Law Journal and once in the Sentinel of
Carlisle, Pennsylvania, at least fifteen (15) days prior to the new rule returnable date;
iv. That service upon Saundra S. Lopez also be made by mailing a certified
copy of the Rule issued pursuant to this Motion by ordinary United States mail to her at 4 Marshall
Boulevard, No. 4, Lexington Park, Maryland 20653, and that such service be complete upon
mailing, regardless of whether or not the envelope is returned undeliverable, and;
v. That service upon the remaining parties to this action be made by regular
mail.

AND NOW, this -2-R day of September, 1999, comes the Cumberland County
Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant Cumberland
County Solicitor, and files this Motion for Revised Rule to Show Cause and Motion for
Service Pursuant to Special Order of Court by Publication and Regular Mail Pursuant
to Pa.R.C.P. 430, of which the following is a statement:
1. On or about May 12, 1999 your Petitioner, the Cumberland County Tax
Claim Bureau, filed a Petition for Rule for Judicial Sale of the property of Saundra S.
Lopez known as Cumberland County tax parcel number 23-32-2338-123, to the above
captioned term and number.
2. On May 25, 1999 your Honor issued a Rule to Show Cause returnable
August 12, 1999.
3. Service was not able to be made upon Saundra S. Lopez at her address
as disclosed by the public records, to wit: 4 Marshall Boulevard, No. 4, Lexington
Park, Maryland 20653. The Sheriffs return shows that the Sheriffs envelope to Ms.
Lopez at this address was returned marked "No Such Number." On August 12, 1999
Your Honor issued an Order continuing the case generally.
4. Movant made efforts to locate Saundra S. Lopez as described in the
affidavit of Jacob L. Heisey attached hereto, marked Exhibit "A," and incorporated
herein by reference thereto as if fully set forth herein.
5. Movant requests your Honorable Court to enter an Order for Service by
ordinary mail upon Saundra S. Lopez at 4 Marshall Boulevard #4, Lexington Park,
Maryland 20653 complete upon mailing, irrespective of whether the said envelope is
returned undeliverable.
6. Movant also requests an Order for Service by publication pursuant to Pa.
R.C.P. 430 pursuant to the advertisement attached hereto as Exhibit "B."
7. A hearing at the rule returnable date of August 12, 1999 was not able to
be held because service had not been made upon the taxpayer. Movant requests a
new rule returnable date of October 21, 1999, when other Tax Claim Bureau judicial
sale matters are scheduled for hearing.
WHEREFORE, Movant prays your Honorable Court as follows:
(i) That the Rule to Show Cause dated May 25, 1999 be
vacated and the returnable date of August 12, 1999 canceled;
(ii) That a New Rule be issued with a Rule returnable date of
October 21, 1999 at 3:00 p.m;
(iii) Order service of the Rule to Show Cause upon Saundra S.

I, JACOB L. HEISEY, Director, Cumberland County Tax Claim Bureau, having
my principle place of business at the Old Cumberland County Courthouse, Carlisle,
Cumberland County, Pennsylvania, do hereby swear and affirm as follows:
1. I have reviewed in the Cumberland County Prothonotary's Office the files
for each of the liens described in the Petition which initiated the above captioned
action, and I find no addresses for the taxpayer, Saundra S. Lopez, other than the
address set forth in paragraph 5 of the Petition, to wit: 4 Marshall Boulevard, No. 4,
Lexington Park, Maryland 20653.
2. The Fairfield Associates judgment (Petition paragraph 4(f)) was on a
mortgage which also covered a Dauphin County property. Therefore, I called the
Dauphin County Assessment Office but was told that they have no listing for any real
estate owned by Saundra S. Lopez.
3. 1 performed a computer search of both the Grantor and Grantee indices in
the Cumberland County Recorder of Deeds Office from December 1, 1993 to
September 1, 1999 and found no entry for Saundra S. Lopez or Saundra Lopez.
4. 1 performed a marriage license computer search of the records of the
Cumberland County Register of Wills Office from approximately 1994 to September 1,
1999 and found no record for Saundra S. Lopez or Saundra Lopez.
5. 1 have researched the current Harrisburg area and Carlisle area
telephone directories and found no entry for Saundra Lopez or Saundra S. Lopez.
6. 1 researched the cross-reference directory available in the Cumberland
Exhibit A"

Eounty-S#rerif#'s Office for the property known as 145 North East Street, Carlisle,
Pennsylvania, which is the subject premises, and found no listing for an owner.
7. 1 reviewed the records of the Cumberland County Occupation
Assessment Office as of September 1, 1999 and found no listing for Saundra Lopez or
Saundra S. Lopez.
8. The only address set forth in the Cumberland County Assessment
records and in the records of the Cumberland County Tax Claim Bureau for Saundra
S. Lopez is 4 Marshall Boulevard, #4, Lexington Park, Maryland 20653.
I verify that the statements made herein are true and correct to the best of my
knowledge, information and belief, and understand that false statements herein are
made subject to the penalties of 18 PA. C.S.A. §4904 relating to unsworn falsification
to authorities.

PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this
Petition for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. §5860.101, et sic.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents as
follows:
a. Tax claim upon which the property was exposed for sale: 1993
through and including 1997 Cumberland County, Cumberland
County Library and Carlisle Borough real estate taxes. 1993-94
through and including 1997-98 Carlisle Area School District real
estate taxes. Total amount of claim, including penalty and interest
as of date of tax sale: $3,437.89.
b. Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
C. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 28, 1998.
d. Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. §5860.605, which upset price
was $5,640.16.

e. Your Petitioner, the Bureau, was unable to obtain a bid at the
public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
02-21-0318-153. The property is situate in Carlisle Borough, Cumberland County,
Pennsylvania, and is known as 145 North East Street.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as

PETITION FOR CONFIRMATION OF JUDICIAL SALE
1. Petitioner is the Cumberland County Tax Claim Bureau (hereinafter called
"Bureau") created under the provisions of the Real Estate Tax Sale Law of the
Commonwealth of Pennsylvania Act of July 7, 1947, P.L.1368, as amended 72
P.S.§5860.101 et sic.
2. This Petition for Confirmation for Judicial Sale concerns a parcel of real
estate which was successfully sold at a Judicial Sale of real estate on March 24,
2000, which was tax parcel number 02-21-0318-153, owned prior to the Judicial Sale,
or reputedly owned prior to the Judicial Sale, by Saundra S. Lopez, and consisting of
the property situate in the Borough of Carlisle, Cumberland County, Pennsylvania, and
is known as 145 North East Street. The property was sold on March 24, 2000 by the
Cumberland County Tax Claim Bureau pursuant to the Court's Order of February 8,
2000 ordering and directing that the property be sold to the highest bidder freed and
cleared of all tax and municipal claims, liens, mortgages, charges and estates, except
separately taxed ground rents.
3. The said Order of February 8, 2000 directed that advertisement of such
sale be made by one insertion in two newspapers of general circulation in
Cumberland County and one insertion in the Cumberland Law Journal, all of which at
least thirty (30) days prior to the sale dale. Proofs of such publication are attached
eel tion for Confirmation of Judicial Sale (Parcel No. 02.21.0310.153) Page 1
hereto, marked Exhibit "A", and incorporated herein by reference thereto.
4. At the said Judicial Sale on March 24, 2000 the property of Saundra S.
Lopez known as tax parcel number 02-21-0318-153 was sold for $9,800.00, a price
equal to or in excess of the minimum bid acceptable to the Tax Claim Bureau, to
Cumberland Valley Habitat For Humanity, Inc., c/o Samuel W. Milkes, Esquire, 52 E.
High Street, Carlisle, PA 17013, which paid said purchase price to the Tax Claim
Bureau at the time of sale.
5. After the sale, on April 3, 2000, Saundra S. Lopez was mailed a notice
that the property had been sold, to her last known address of 4 Marshall Boulevard,
No. 4, Lexington Park, Maryland 20653. The envelope was sent by regular United
States mail however it is expected to be returned as undeliverable. A copy of the
notice and envelope is attached hereto as Exhibit "B."
6. The title report and copy of the prior deed which were intended to be
attached to the Petition which initiated this action are attached hereto as Exhibit "C."
7. There is no express post-Judicial Sale procedure known to your
Petitioner except for the following portion of 612(a) of the Real Estate Tax Sale Law:
Out of the proceeds of such sale shall be paid the costs set
forth in the upset price at the prior sale, and the additional costs
incurred relative to this sale, including the fee for title search....
The remainder of said proceeds shall be distributed by the office
designated by the county commissioners under section 205.
After the purchaser shall have paid over the purchase price, the
bureau shall make and deliver a deed in the manner herein-
before provided.
72 P.S. §5860.61 2(a) (footnote omitted). The reference to Section 205 is, of course,
72 P.S. §5860.205. Your Petitioner, however, desires to proceed by a procedure
analogous to the Consolidated Return to Court Procedure set forth in §607 or the
Petition for Confirmation of Judicial Sale (Parcel No. 02.21.0318.153) `°y
Real Estate Tax Sale Law (72 P.S. §5860.607), however without the requirement of
certified mail, restricted delivery, return receipt requested for the post-sale notice to
the prior owner.
8. Your Petitioner respectfully requests that the Court's Confirmation Nisi
provide that a notice regarding the subject property sold on March 24, 2000 be
published once in The Cumberland Law Journal, once in The Harrisburg Patriot
News, and once in The Sentinel of Cumberland County, Pennsylvania, within ten (10)
days of the date of the Confirmation Nisi, and that Petitioner further be ordered to send
a copy of this Petition and the Court's Confirmation Nisi to Saundra S. Lopez at her
last known address, as previously set forth herein, by regular United States mail,
complete upon mailing irrespective of any return as undeliverable, and that any
exceptions or orders to the Court's Confirmation Nisi be filed within thirty (30) days of
the Court's Order.
9. Your Petitioner respectfully requests that the proceeds of sale be
distributed pursuant to the Schedule of Distribution of Sale Proceeds attached hereto
as Exhibit "D."
WHEREFORE the Bureau respectfully requests your Honorable Court to enter a

COMMONS OF SALE
Successful bidders at the Judicial
Sale will be required to provide cerd-
fication to the Bureau that he or she
1s not delinquent in paying real estate
taxes to any of the taxing districts in
the county where the property is lo-
cated and that the successful bidder
has no municipal utility bills that are
more than one year outstanding. Cer-
tification shall be by actual receipts
of paid real estate taxes and mumet-
pal utility bills or by a notarized affl-
davit that all such taxes and bills are
paid. Affidavits for certification will
be available at the time and place of
sale. Successful bidders will need
photo identification for notary of the
certification. The Cumberland County
Tax Clams Bureau requires that cer-
tlflcation be provided at the time of
successful bid and payment of the
purchase price.
The purchaser of any property at
any such sale shall, as soon as the
property 1s struck down, pay to the
Bureau the entire purchase money.
Payment shall be cash in the form of
currency of the United States or
check payable to county of Cumber
land. In case said amount Is not so
paid, the sale shall be voided and the
property shall be put up again at the
same sale. Deeds for the premises
will be prepared by the Tax Claim
Bureau and recorded and mailed to
the address given by the buyer at the
sale. Buyers will be required to pay,
in addition to their bid, at the time
the property Is struck down to them,
the basic suns of recording the deed,
