STIPULATION AGAINST LIENS
THIS AGREEMENT made the 151kf May, 1999, by and between
J.W. Mumper Construction, Inc.,
AND
John H. Linko and Linda M. Linko, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
Lot 11, Hillside Farms, Mechanicsburg, PA 17055, Silver Spring
Township, Cumberland County
(SEE ATTACHED LEGAL DESCRIPTION)
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said. buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

ALL THAT CERTAIN tract or lot of land situate in the Township
of Silver Spring, County of Cumberland, Commonwealth of
Pennsylvania, bounded and described as follows:
BEGINNING at a point on the western right of way line of
Shiloh Court at the corner of Lot No. 10 of the hereinafter
mentioned Plan of Lots; thence by the western right of way line
of Shiloh Court by a curve to the left having a radius of 95.00
feet, an arc distance of 243.31 feet to a point at the corner of
Lot No. 12; thence along Lot No. 12 South 20 degrees 23 minutes
41 seconds East a distance of 132.76 feet to a point to property
now or formerly of Waterford Square; thence along lands now or
formerly of Waterford Square 73 degrees 01 minute 25 seconds West
a distance of 226.81 feet to a point at the corner of Lot No. 8;
thence along Lot No. 8 North 20 degrees 23 minutes 41 seconds
West a distance of 214.24 feet to a point at the corner of Lot
No. 10; thence along Lot No. 10 North 69 degrees 36 minutes 19
seconds East, a distance of 131.40 feet to a point on the western
right of way line of Shiloh Court, the place of BEGINNING.
CONTAINING 0.98 acres of land.
BEING Lot No. 11 of the Final Subdivision Plan of Hillside
Farms, Phase I, prepared by H. Edward Black and Associates, P.C.,
and recorded in the Office of the Recorder of Deeds of Cumberland,
County, Pennsylvania, in Plan Book 72, Page 77.
UNDER AND SUBJECT to a Declaration of Covenants and
Restrictions recorded in Cumberland County Miscellaneous Book
529, Page 333, and under and subject to the By-Laws of Hillside
Farms Homeowner's Association, Inc. recorded in Cumberland County
Miscellaneous Book 529, Page 354.
BEING THE SAME PREMISES which Max C. Hempt and Martha D. Hempt,
by deed to be recorded simultaneously herewith in the Cumberland
County Recorder of Deeds Office to grant and convey John H. Linko
and Linda M. Linko.
