Huynh of Harrisburg is about to execute Contemporaneously herewith, a contract, with Fogarty Ho es, Inc. of Harrisburg Pennsylvania, for the erection of Ste building upon a lot of land situat 0 r, See Attached legal fi7 T rN ~ O %??? ? , 1 ' Z 13 NOW, 1999, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Cuong Quoc and Phoi S. Huynh, to the said Fogarty Homes, Inc., to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Cuong Quoc and Phoi S. Huynh, and the further consideration of one Dollar, to Fogarty Homes, Inc., paid by Cuong Quoc and Phoi S. Huynh, it is agreed that no lien shall be filed against the building and/or land by the contractor, or any subcontractor, now by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. BETWEEN PAGAN'S RUN ASSOCIATES, a Pennsylvania General Partnership comprised of Logan's Run Corporation, a Pennsylvania Business Corporation, and Haubert Homes, inc., a Pennsylvania Corporation, hereinafter referred to as GRANTORS, AND CUONG QUOC HUYNH AND PHOI S. HUYNH HUSBAND AND WIFE, of Harrisburg, Dauphin County, Pennsylvania, hereinafter referred to as GRANTEES. WITNESSETH chat the said GRANTOR, for and in consideration of the sum of THIRTY-SIX THOUSAND DOLLARS ($36,000.00), lawful money of the United States of America, and other good and valuable considerations, well and truly paid by the said GRANTEES to the said GRANTOR, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained, sold, aliened, enfeoffed, released, conveyed, and confirmed and by these presents does grant, bargain, sell, alien, enfeoff, release, convey, and confirm unto the said GRANTEES, their heirs and assigns, ALL THAT CERTAIN lot or piece of land situate in East Pennsboro Township, Cumberland County, Pennsylvania, bounded and described according to a certain Final Plan of Penn Valley, prepared by Hartmen & Associates, Inc., Engineers and Surveyors, Camp Hill, Pennsylvania, dated June 23, 1993 and last revised September 9, 1993, more particularly described as follows, to wit: BEGINNING at a point on the northern right-of-way line of Willow Way Drive (50' wide) at the dividing line between lots No. 155 and No. 156 as shown on the hereinafter mentioned plan; thence along the northern right-of-way line of Willow Way Drive South 81 degrees 00 minutes 00 seconds West a distance of 80.0' feet to a point at the dividing line between lots No. 156 and No. 157; thence along the dividing line between lots No. 156 and No. 157 North 09 degrees 00 minutes 00 seconds West a distance of 10.0' feet to a point at the dividing line between lots No. 156 and NO. 157, No. 161 and No. 162 North 81 degrees 00 minutes 00 seconds East a distance of 80.00' feet to a point between lots No. 155 and No. 156 M distance of 80.00' feet to a point between lots No. 155 and No. 156 South 09 degrees 00 minutes 00 seconds East a distance of 100.00' feet to a point on the northern right-of-way line of Willow way Drive, said point being the place of BEGINNING. BEING lot No. 156 as shown on the Final Subdivision Plan of Penn Valley, Pahse II, Recorded in PLan Book 71, Page 102. BEING PART OF THE SAME PREMISES which Penn Valley Corporation, a Pennsylvania corporation, by deed dated June 23, 1998 and recorded June 30, 1998 by the Recorder of Deeds in and for Cumberland County in deed Book 180, Page 263, granted and conveyed unto Logans Run Associates, a Pennsylvania General Partnership comprised of Logan's Run Corporation, a Pennsylvania Business Corporation, and Haubert Homes, Inc., a Pennsylvania Corporation GRANTORS herein. ALSO UNDER AND SUBJECT, nevertheless, to easements, restrictions, reservations, conditions, and rights of ways of record or visible upon inspection of premises. TOGETHER with all and singular, the tenements, hereditaments and appurtenances to the same belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; AND ALSO all the estate, right, title, interest, property, claim and demand whatsoever, both in law and equity, of the said GRANTOR, of, in, to or out of the said premises, and every part and parcel thereof. TO HAVE AND TO HOLD the said premises, with all and singular the appurtenances, unto the said GRANTEES, their heirs, assigns, to and for the only proper use and behoof of the said GRANTEES, their heirs and assigns, forever. AND THE SAID GRANTOR, for Grantor's self and Grantor's heirs, executors, and administrators, does by these presents, covenant, grant and agree to and with the said GRANTEES, their heirs and assigns, that the said GRANTOR and Grantor's heirs and assigns, all and singular the hereditaments and premises hereinabove described and granted or mentioned, and intended so to be, with appurtenances, unto the said GRANTEES, their heirs and assigns, against the said GRANTOR and Grantor's heirs and assigns against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof, by, from or under him, her, them or any of them, shall and will by these presents SPECIALLY WARRANT AND FOREVER DEFEND.
