STIPULATION AGAINST LIENS
WHEREAS, Robert A. Maag and Theresa M. Maag, his wife, the OWNER of the real estate described
below, has or is about to execute a contr ct with S & A Homes, Inc., whose principal place of business is _

dwelling upon lands situate in, Carlisle, Cumberland County, Pennsylvania. and more particularly bounded
and described on Exhibit ''A" attached hereto and made a part hereof; and,
NOW, THEREFORE, this 17" day of Mav, 1999, before any authority had been given by S & A
Homes, Inc,., to commence work on said facilities, or purchase materiels for same, in consideration of
making of the above-described Contract with Robert A. Maag and Theresa M. Maag, his wife, Owner, and in
further consideration of One ($1.00) Dollar paid to the general contractor by Robert A. Maag and Theresa M.
Maag, his wife, the recnint whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed
or maintained against the Owner's facilities and the land above-described, or upon Robert A. Maag and
Theresa M. Maag, his wife, the Owner, by the general contractor. or any of its subcontractors, or by any of
the materialmen or workmen, or any other person acting through or under them, for or on account of any
labor, or materials purchased, or extra labor or material,, purchased for, towards, in or about the e:ecticn,
construction, design and improvement of said facilities, under said contract or otherwise, the right to have,
file and maintain such loans or claims against the facilities, the land above described, and Robert A. Maag
and Theresa M. Maag, his wife, the Owner, being hereby e-orassly waived by the general contractor for
itself, its subcontractors, all materialmen, or workmen and other acing through or under them.
IN WITNESS WHEREOF, each of the parties by their duly authorized representatives have hereunto
executed the Stipulation Against Liens this 17`" day of May, 1999.

ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a Plan prepared by Rodney Lee Decker, R.P.L.S.,
dated March 11, 1993 and recorded in the Office of the Recorder of Deeds for Cumberland County, in Plan
Book 67, Page 91.
BEGINNING at a point in centerline of T-544, Montsera Road, at corner of Lot No. 25; thence along
Lot No. 25, South 49 degrees 33 minutes 10 seconds West, 376.63 feet to a point; thence along Lot No. 23,
North 16 degrees 42 minutes 20 seconds West, 337.33 feet to a point in PA Route 174; thence along PA Route
174, North 73 degrees 17 minutes 40 seconds East, 260.13 feet to a point at the intersection of PA Route 174
and Montsera Road, T-544; thence along centerline of Montsera Road, T-544, South 41 degrees 12 minutes 25
seconds East, 204.07 feet to a point, the place of BEGINNING.
CONTAINING 1.889 acres and designated as Lot 24,on Plan of Mooredale Manor.
BEING THE SAME PREMISES which Harry H. Fox, Jr. and Ann G. Fox, his wife, and John H. Fox,
single person, and Cinda L. Fox, by deed dated August 24, 1998 and recorded September 1, 1998 in the Office
of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Book 184, Page 666, granted and
conveyed unto Robert A. Maag and Theresa M. Maag, his wife.
UNDER AND SUBJECT, NEVERTHELESS, to all notes and restrictions on the Plan of Subdivision
herein before mentioned, all easements, reservations and restrictions of prior record, as well as to the following
conditions and restrictions to which the hereby granted parcel of land shall be and will remain subject:
1. There shall be permitted no accumulations of junk, debris, or unlicensed vehicles.
2. There shall be utilized no mobile homes, trailers or temporary structures on the within described
parcel.
3. Living in the basement level of an uncompleted residence shall not be permitted.
4. No commercial breeding or boarding kennels shall be permitted on the within described parcel.
5. All residential structures shall have an attached garage of at least one car capacity and shall have a
minimum habitable, finished living area of: ranch, bi-level or cape cod style - 1,300 square feet;
two story style - 800 square feet per level.
6. Horses shall be permitted as provided in Dickinson and Penn Township Zoning Ordinances.
