OR_ ?+a CIVIL TERM IN CUSTODY ORDER E?R OF COURT AND NOW, this dQ iN\ day of / ' Y 1' 41 , 1999, upon presentation and consideration of the within Petition, it is hereby ORDERED AND DECREED as follows: 1. TIMOTHY J. RITCHIE (hereinafter referred to as "Father") and KIMBERLY A. RITCHIE (hereinafter referred to as "Mother") shall have shared legal custody of their children, namely, AMBER LYNN RITCHIE, born March 11, 1986; STEFANIE ELLYSSA RITCHIE, born June 15, 1989; and SYDNEY ELIZABETH RITCHIE, born October 6, 1996. 2. Mother shall maintain primary physical custody of the children with periods of temporary physical custody belonging to Father on alternating weekends, beginning on Friday at 7:00 p.m. and continuing until Sunday at 7:00 p.m.; and a mutually agreeable day during each week. 3. During the children's summer vacation from school, Father's periods of temporary physical custody on alternation weekends will he liberally extended for additional days. 4. The parties shall alternate physical custody of the children during the Holidays at such mutually agreed times as the parties deem proper. 5. The parties shall share transportation of the children such that the party seeking to exercise a period of physical custody shall be responsible for traveling to acquire the children. 6. The parties will keep each other advised immediately in the event of serious illness or medical emergency concerning a child and shall further take any necessary steps to ensure that the health and well-being of the child is protected. During such illness or medical emergency, both parties shall have the right to visit the child as often as he or she desires consistent with the proper medical care of the child. 7. The parties shall not do anything which may estrange the children from the other party, or injure the opinion of the children as to the other party, or which may hamper the free and natural development of the children's love and affection for the other party. RITCHIE, Defendant : IN CUSTODY CUSTODY S'nPULA110N AND AGREEMENT THIS AGREEMENT AND STIPULATION entered into the day and year hereinafter set forth, by and between TIMOTHY J. RITCHIE, (hereinafter referred to as "Father") and KIMBERLY A. RITCHIE (hereinafter referred to as "Mother"). WHEREAS, the panics are the natural parents of AMBER LYNN RITCHIE, born March 11, 1986; STL'FAME ELLYSSA RITCI IIE, born June 15, 1989; and SYDNEY ELIZABETH RITCHIE, born October 6, 1996. WHEREAS, Father and Mother are presently separated and living in separate residences; and WHEREAS, the parties wish to enter into an agreement relative to custody and partial custody of the children; and NOW THEREFORE, in consideration of the mutual covenants, promises and agreements as hereinafter set forth, the parties agree as follows: 1. The Parties further agree that Father shall claim two children as dependents for income tax purposes during odd numbered tax years. Mother shall claim two children as defendants during even numbered years. 8. Any modification or waiver of any of the provisions of this Agreement shall be effective only if made in writing and only if executed with the same formality as this Stipulation and Agreement. 4. The paries desire that this Stipulation and Agreement be made an Order of Court to the Court of Common Pleas of Cumberland County, and further acknowledge that the Court of Common Pleas of Cumberland County does, in fact, have jurisdiction over the issue of custody of the parties' minor children who have resided in Cumberland County for more than t%vo years and shall retain such jurisdiction should circumstances change and either party desire or require modification of said Order. 10. The parties agree that in making this Agreement, there has been no fraud, concealment, overreaching, coercion, or other unfair dealing on the part of the other. 11. The parties acknowledge that they have read and understand the provisions of this Agreement;_'ach party acknowledges that the Agreement is fair and equitable and that it is not the result of duress or undue influence.
