WAIVER OF RIGHT TO FILE MECHANICS' LIENS
WHEREAS, MICHAEL A. FOREMAN AND STACY A. FOREMAN Husband and
Wife, Owner(s), of P.O. Box 98, Boiling Springs, Cumberland
County, Pennsylvania 17013, entered into a contract with TERRY L.
DOUGHERTY, 266 West Barrens Church Road, Dillsburg, PA 17019, to
provide materials and perform labor necessary for the
construction of a dwelling house upon a tract of land situate in
South Middleton Township, Cumberland County, Pennsylvania, more
particularly bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals

LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in South Middleton
Township, Cumberland County, Pennsylvania, bounded and described
as follows:
BEGINNING at a railroad spike in the center line of Mountain
Road, Township Road T-548 (previously erroneously identified as
Sheet Iron Roof Road, Township Road T-538), at northeast corner
of land now or formerly of Dale F. Shughart, Jr., et al; thence
by lands now or formerly of Dale F. Shughart, Jr., et al, South.
78 degrees 16 minutes 37 seconds West 442.77 feet to an iron pin
in line of Tract No. 2 hereinafter described; thence by said
Tract No. 2 hereof North 00 degrees 48 minutes 12 seconds East
98.97 feet to an iron pin; thence by the same North 27 degrees
59 minutes 43 seconds West 148.31 feet to an iron pin; thence by
the same North 36 degrees 12 minutes 36 seconds West 163.13 feet
to an iron pin; thence by the same North 28 degrees 41 minutes
04 seconds East 148.51 feet to an iron pin at the southwest
corner of land now or formerly of David A. Nickel; thence by land
now or formerly of David A. Nickel North 77 degrees 04 minutes
01 seconds East 841.28 feet to a railroad spike in the center of
Township Road T-548; thence by the center line of said Township
Road South 21 degrees 32 minutes 42 seconds West 165.00 feet to a
railroad spike in the center line of said Township Road; thence
South 30 degrees 16 minutes 12 seconds West 214.50 feet to an
existing iron pin 03 feet East of the center line of said
Township Road; thence South 26 degrees 19 minutes 12 seconds West
280.50 feet to a railroad spike in the center line of said
Township Road, the PLACE OF BEGINNING.
CONTAINING 7.8324 acres, more or less and being Cumberland County
Tax Parcel No. 40-13-0126-023.
BEING Tract No. 1 of the same premises which Dale F. Shughart,
Jr., by his deed dated May 19, 1999 and recorded in the office of
the Recorder of Deeds aforesaid in Deed Book Page
granted and conveyed unto Michael A. Foreman and Stacy A.
Foreman, husband and wife.
