WHEREAS, JERRY W. SWARTZ, JR. AND TINA M. SWARTZ, is about to execute
contemporaneously herewith a contract with JERRY W. SWARTZ, for the erection of a single
family dwelling upon a lot of land situate as follows:
SEE EXHIBIT "A" ATTACHED
Now, 51999 at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said owners to the said
contractor to commence work on the said building, or purchase materials for the same in
consideration of the making of the said contract with contractor and the further consideration of
One ($1.00) Dollar to contractor paid by owner, it is agreed that no lien sliall be filed against the
building and/or land by the contractor, or any subcontractor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.

ALL THAT CERTAIN tract or parcel of land with buildings erected thereon, situate in
Petro Township, Cumberland County, bounded and described pursuant to the Final
Subdivision Plan for Daniel G.' Rhoads and Lorie L. Rhoads, dated September 22,
1989, as prepared by Eugene A. Hockensmith, P.L.S.; and recorded in the Recorder of
Deeds Office in and for Cumberland County, Pennsylvania, in Plan Book 60, Page 93
as follows:
BEGINNING at an existing railroad spike in the centerline of Township Route 349
(Southside Drive) at comers common with Lot No. 3 of the above-mentioned
subdivision plan; thence along said centerline South 60 degrees 11 minutes 51 seconds
West, a distance of 151.73 feet to an existing railroad spike in the centerline of said
Township Route at comers common with lands now or formerly of Michael L. Failor,
et. ux; thence along said Failor lands North 6 degrees 58 minutes 59 seconds East a
distance of 175.18 feet through an existing iron pipe to a second iron pipe; thence
along same North 87 degrees 20 minutes 30 seconds West a distance of 131.47 feet to
an existing iron pipe; thence along lands now or formerly of Betty Jane Deitzel North
19 degrees 30 minutes 43 seconds East a distance of 111.11 feet to existing bolt; thence
along Lot No. 1 of the aforementioned subdivision plan North 89 degrees 58 minutes
16 seconds East a distance of 233.52 feet to an iron pin at corners common with Lots
Nos. 1 and 3 of the aforementioned Subdivision plan; thence along said Lot No. 3
South 7 degrees 51 minutes 57 seconds East a distance of 211.40 feet through a point
on the dedicated right of way line to an existing railroad spike in the centerline of
Township Route 349 (Southside Drive), being the place of BEGINNING.
BEING all of Lot No. 2 of the aforementioned Subdivision Plan. CONTAINING 1
Acre, more or less. SUBJECT to a 25 feet right of way as noted on the
aforementioned subdivision plan as well as other easements and restrictions of record.
BEING the same premises which became vested in Jerry W. Swart, Jr. and Tina M.
Swartz, his wife by virtue of deed dated 8/2196 and recorded 8/9/96 in Cumberland
County Records in Deed Book 143 Page 1147.
