Plaintiff, Beneficial Consumer Discount Company, doing business as Beneficial Mortgage Company of Pennsylvania, is a Pennsylvania Business Corporation organized and existing under the laws of Pennsylvania, having a principal place of business at 4910 Carlisle Pike, Suite 104, Cumberland County, Pennsylvania 17055. 2. Defendant, Cynthia Gene Middleton, a/k/a Cynthia Gene Lush, is an adult individual, currently residing at 5965 Eberly Drive, Mechanicsburg, Pennsylvania 17055. 3. This action is based on a certain mortgage dated May 22, 1996, which mortgage was executed by Defendant in favor of Plaintiff and was recorded in the Recorder of Deeds Office in and for Cumberland County on or about May 23, 1996 at Record Book 1321, Page 852. Said Mortgage and Note are attached hereto and marked Exhibit "A". 4. The Defendants are not in the military service of the United States of America or any of its allies. 5. The premises subject to said mortgage is described as follows: ALL THAT CERTAIN: property situated in the township of Hampden in the County of Cumberland and Commonwealth of Pennsylvania. Being more fully described in a fee simple deed dated 7/26/95 and recorded 7/27/95. Among the land records of the County and State set forth above. 6. The said mortgage is in default and subject to foreclosure because the Defendant failed to make payments when due in accordance with the terms and conditions on the Note and Mortgage. 7. In accordance with the terms and conditions of the Mortgage, the whole principal debt secured thereby has become due and payable and recoverable immediately together with all interest due thereon with reasonable attorney fees and cost of suit. 8. The amount due on said mortgage as of May 4, 1999, is computed as follows: Principal balance due - $7,597.66 Delinquent interest - 1,007.49 Late fees - 0.00 Per diem ($5.75/day from 5/04/99) - 0.00 Attorney fee (5%) - 430.26 TOTAL - $9,038.41 10. The requirements of Act 6 of 1974 and the requirements of Act 91 of 1983, if applicable, which were sent by certified and regular United States mail, have been fulfilled and copies thereof are attached hereto and marked collectively as Exhibit "B". WHEREFORE, Plaintiff demands judgment against Defendant in the sum of $9,038.41, together with costs, interest and attorney fees for the foreclosure and sale of the mortgaged premises.
