WITNESSETH: WHEREAS, Mother and Father are the parents of Jessica Helen Rafferty, born January 10, 1997; and WHEREAS, Mother and Father wish to enter into this Custody Agreement to settle and resolve the outstanding issues regarding the custody of their child; NOW THEREFORE, it is agreed by the parties that: 1. Mother and Father shall share legal custody of the child, which means that each party is to have equal access to the child's personal, school and medical records and each party is to inform the other of significant events that occur in the child's life. Each parent shall have access to medical, dental and school records. 2. Mother shall have primary physical custody of the child subject to Father's liberal periods of partial custody: A. Every other weekend from Friday at 6:00 p.m. until Sunday evening at 7:00 p.m.. B. Evenings during the week as the parties may agree consistent with each parties' work schedule. C. With at least 30 days prior notice, two (2) uninterrupted weeks throughout the year, they may be consecutive. Mother shall also be entitled to have two (2) uninterrupted weeks that may be consecutive. Each uninterrupted week must include a parent's regularly scheduled weekend. D. Father may have the child at other times as agreed by the parties. 4. Mother and father shall alternate the holidays of Easter, Memorial Day, Independence Day, Labor Day and Thanksgiving. Father shall have Easter, Independence Day and Thanksgiving in even years and Memorial Day and Labor Day in odd years. Mother shall have Easter, Independence Day and Thanksgiving in odd years and Memorial Day and Labor Day in even years. Each year Mother shall have the child on Mother's. Day and Father shall have the child for Father's Day. The holiday will begin at 6:00 p.m. the day before the holiday and end at 7:00 p.m. the day of the holiday. The holiday schedule shall supersede the regular schedule. 2 ?? 5. Christmas shall be shared. Father shall have the child each year from 6:00 p.m. December 23 until 10:00 p.m. December 24. Mother shall have the child each year from 10:00 p.m. December 24 until 10:00 a.m. December 26. 6. Father shall provide transportation for the pickup and delivery for the custody transfers. 7. This Agreement may be modified by mutual agreement of the parties. B. If the parties are unable to agree on an acceptable custody schedule, they agree to seek the assistance of a custody conciliator. The cost of the custody conciliator shall be equally shared by the parties. 9. Both parents understand the need to provide a loving and stable environment for their child. 10. Mother and Father agree to place any personal differences aside and work for the best interests of the child. 11. The parties shall provide for reasonable telephone access to the child. 12. Neither party shall make derogatory comments about the other in the presence or hearing of the child. 13. Each party is to inform the other of any change in employment, residence and/or telephone number. 14. This Agreement shall supersede any and all other Agreements or Stipulations concerning the custody of the child. 3 15. It is the intent of the parties that this Agreement be made an Order of Court. The coordinating parent shall communicate with the other parent to work out an acceptable itinerary considering each parents' work schedule, expenses and best interest of the chil.d. The parties shall equally share in the cost of the transportation of their child. The receiving parent shall be solely responsible for his or her own transportation costs and other expenses incurred in the pickup for the custody exchanges. 4.
