STIPULATION i VAINSi LIENS
THIS AGREEMENT made the 26th day of May, 1999, by and between WIRL BUILDERS,
hereinafter referred to as Contractor, and JOHN FRITZ and JANICE FRITZ, hereinafter referred to
as Owner, whereby the former undertook and agreed to erect and construct a custom built home on
that certain lot of ground situate at Lot No. 24, Indian Hills, South Middleton Township,
Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made
a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of anv work done or materials
fumished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

BEGINNING at an iron pin along Hope Drive (50 foot right of way) at comer of Lot Nos. 24 and
25 of said subdivision plan; thence along Hope Drive South 49 degrees 55 minutes 45 seconds East
a distance of 82.26 feet to a concrete monument; thence South 50 degrees 26 minutes 02 seconds
East on a curve to the left having a radius of 443.00 feet and an arc length of 7.80 feet to an iron pin
at the dividing line between Lot Nos, 24 and 23 of said subdivision plan; thence along the dividing
line of Lot Nos. 24 and 23 South 36 degrees 39 minutes 48 seconds West a distance of 172.16 feet
to an iron pin; thence along the dividing line between Lots No. 24 and 36 of said subdivision plan
North 35 degrees 06 minutes 51 seconds West a distance of 103.75 feet to an iron pin; thence along
the dividing line between Lot Nos. 24 and 25 of said subdivision plan North 40 degrees 04 minutes

BEGINNING.
CONTAINING 15,021.67 square feet.

of the Recorder of Deeds of Cumberland County in Plan Book 67, Page 36.
