KEELEY STIPULATION AGAINST LIENS Contractor THIS AGREEMENT made and concluded this 21sF day of May 1999, by and between Daniel D. Hooven and Kathy H. Hooven, his wife, of Hampden Township, Cumberland County, Pennsylvania ("Owners"), and William D. Keeley, of Hampden Township, Cumberland County, Pennsylvania ("Contractor"). WHEREAS, the parties have by a duly executed agreement dated , 1999, entered into a written agreement for the construction and completion of a home on the property referred to in the tax roles of Hampden Township as parcel 10-19-1604-152, located at 5800 Stephens Crossing, Mechanicsburg, PA 17055, Lot #56 Village of Westover (East). NOW THIS AGREEMENT WITNESSETH at the time of and immediately before the execution of the principal contract and before any authority has been given by the said Owners to the said Contractor to commence work on the construction of the home, or purchase materials for the same in consideration of the signing of said contract with Contractor, and in hand paid by Owner to Contractor and other valuable consideration, receipt of which is hereby acknowledged, it is agreed that no lien shall be filed against the said home and the property upon which it is to be constructed by the Contractor, or any of its subcontractors, nor by any material men or workmen or any other person for any labor or materials purchased, or extra labor or materials purchased for the erection of said building on said property, the right to file such liens being expressly waived. IN WITNESS WHEREOF we hereunto set our hands and seals the first date written above. WITNESS: r (SEAL) ALL THAI' CERTAIN tract or parcel of laud situate in the Township of Hampden, County of Cumberland and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit: BEGINNING at point oil the northern line of Stephen's Crossing at the dividing line between Lots Nos. 55 and 56 as shown on the hereinafter mentioned plan of lots; thence along the dividing line between Lots Nos. 55 and 56 North 74 degrees 25 minutes 24 seconds East a distance of 133.48 feet to a point at lands now or formerly of Joseph B. and Jane W. Brenner; thence along said Bremner lands South 12 degrees 01 minutes 59 second East a distance of 289.63 feet to a point, said point being the intersecting point between Lots Nos. 56, 57 and lands of said Breimers; thence along the dividing line between Lots Nos. 56 and 57 North 48 degrees 16 minutes 31 seconds West a distance of 273.52 feel to a point on the line of Stephen's Crossing; thence along the line of Stephen's Crossing by a curve to the right having a delta of 57 degrees 18 minutes 02 seconds and a tangent of 38.24 feel, a radius of 70.00 feet all arc distance of 46.60 feel to a point on (lie northern line of Stephcn's Crossing, said paint being the place of BEGINNING. CONTAINING 26,959.72 square feel, (0.619 acres) more or less. BEING all of Lot No. 56 as shown in the Final Revised Development Plan of Village of Westover (East Section), recorded in the Office of the Recorder of Deeds of Cumberland County in Plan Book 60, Page 74 oil April 27, 1990.
