COMPLAINT FOR CUSTODY
NOW COMES, Plaintiff, Donald C. Comerer, by and through his attorneys,
TOMASKO & KORANDA, P.C., and complains to this Honorable Court as follows:
1. Plaintiff, Donald C. Comerer, is an adult individual residing at 3 Creek Road,
Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant, Victoria L. Comerer, is an adult individual residing at 6304 Salem
Park Circle, Mechanicsburg, Cumberland County, Pennsylvania.
3. Plaintiff seeks custody of the following child:

The mother of the child is Defendant, Victoria L. Comerer, currently residing at 6304
Salem Park Circle, Mechanicsburg, Pennsylvania. She is divorced.
The father of the child is Plaintiff, Donald C. Comerer, currently residing at 3 Creek
Road, Mechanicsburg, Pennsylvania, He is divorced.
4. The relationship of Plaintiff to the child is that of natural father. The Plaintiff
resides with no other persons except the child on a week-on/week-off basis.
5. The relationship of Defendant to the child is that of natural mother. She
currently resides with no other persons except the child on a week-on/week-off basis.
6. Plaintiff has participated as a party or witness, or in another capacity, in other
litigation concerning the custody of the child in this court. Specifically, Plaintiff was a party to

a divorce action commenced by Defendant which resulted in a Marital Settlement Agreement
setting forth a custody arrangement between the parties. The Court, term and number of that
proceeding is as follows: Cumberland County Court of Common Pleas, No. 97-1795.
Plaintiff has no information of a custody proceeding concerning the child pending in a court of
this Commonwealth. Plaintiff does not know of a person not a party to the proceedings who
has physical custody of the child or claims to have custody or visitation rights with respect to
the child.
7. The best interest and permanent welfare of the child will be served by granting
primary physical custody to Plaintiff in that Plaintiff is better able to provide for the child's
physical, intellectual, moral and spiritual well-being.
8. Each parent whose parental rights to the child have not been terminated have
been named as parties to this action. There are no other persons who are known to have or
claim a right to custody or visitation of the child.
WHEREFORE, Plaintiff respectfully requests that this Court grant him primary
physical custody of the child, Donald C. Comerer, Jr.

ORDER
AND NOW, this day of 1999,
upon review of the Conciliator's Report, it appearing that the
parties have agreed to the terms and provisions of this Order which
was dictated in their presence and approved by them and their
counsel, it is hereby ordered and directed as follows:
1. The parties shall share legal custody of their minor
child, Donald C. Come.rer, Jr., d.o.b. June 26, 1985.
2. The parties shall share physical custody of their minor
child on a week on week off basis. The exchange of
custody shall occur on Sunday at 8:00 p.m. The party who
is commencing their period of custodial time with the
child shall pick up the child from the other party's
residence.
3. The parties shall share the holidays. The holidays are
being defined as Labor Day, Thanksgiving, Easter,
Memorial Day, and 4"' of July. This alternating schedule
shall commence with Father having Labor Day in 1999.
4. The Christmas holiday shall be divided into two segments.
Segment A shall be from December 24"' at 12:00 p.m. until
December 25"' at 12:00 p.m. Segment B shall be from
December 25"' at 12:00 p.m. until December 26t' at 12:00
p.m. Father shall have Segment A in 1999 and all odd
years thereafter and Segment B in the year 2000 and all
even years thereafter. Mother shall have Segment B in
1999 and all odd years thereafter and Segment A in the
year 2000 and all even years thereafter. In addition,
the parties shall share the remainder of the child's
Christmas vacation from school at times to be agreed upon
by the parties.
5. The parties shall provide the minor child with reasonable
telephone access with the other parent while the child is
in their respective custody. The child shall be entitled
to call the other parent, at a minimum, every Tuesday and
Thursday evening between 6:00 and 8:00 p.m. The purpose
of this telephone access is for the child alone and not
for contact between the parents.
6. The parties shall share transportation such that the
party starting their periods of custody with the child
shall be responsible for picking up the child from the
other parent..
7. Such other times as the parties may agree.

1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information concerning the child who is the
subject of this litigation is as follows:
