WAIVER OF RIGHT TO FILE MECHANICS' LIENS
WHEREAS, DAVID A. SHEELEY and JANICE I. BOYER, Owner(s), of
650 Roxbury Road, Newville, Cumberland County, Pennsylvania
17241, entered into a contract with FLOYD R. DARHOWER, of
523 Burgners Road, Carlisle, PA 17013 to provide materials and
perform labor necessary for excavation, site preparation,
construction of a septic system and installation of a well in
connection with construction of a dwelling house upon a tract of
land situate in North.Newton Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly called a mechanics,
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals
this -day of MAY, 1998.

EXHIBIT "A"
ALL the following described real estate lying and being situate
in North Newton Township, Cumberland County, Pennsylvania,
designated as Lot 16 on subdivision plan entitled "Minor
Subdivision for Harry J. Myers" drawn by John R. Kissinger
Surveying, which survey has been approved by the appropriate
municipal authorities as and for a subdivision plan and is
recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 79, Page 12, which
lot is more particularly bounded and described as follows:
BEGINNING at a railroad spike in the centerline of L.R. 21007
(Oakville Road) S.R. 3005; thence along line of Lot 15, North
thirty-four (34) degrees sixteen (16) minutes fifty-two (52)
seconds East, five hundred twenty-five and zero hundredths
(525.00) feet to an iron pin at common corner of Lot 15 and 17;
thence along line of Lot 17, South fifty-seven (57) degrees
thirty (30) minutes thirty-seven (37) seconds East, one hundred
seventy-five and nine hundredths (175.09) feet to an iron pin;
thence continuing along same, South thirty-four (34) degrees
sixteen (16) minutes fifty-two (52) seconds West, five hundred
twenty-five and fifty-three hundredths (525.53) feet to a
railroad spike in the centerline of L.R. 21007 (Oakville Road)
S.R. 3005; thence continuing along centerline of L.R. 21007
(Oakville Road) S.R. 3005, North fifty-seven (57) degrees twenty
(20) minutes eighteen (18) seconds West, one hundred seventy-five
and seven hundredths (175.07) feet to a railroad spike, the point
and place of BEGINNING.
CONTAINING a total area of 2.1102 acres, more or less, in
accordance with the above referred to subdivision plan.
UNDER AND SUBJECT to building setback lines, dedicated right-of-
way lines and other notations and conditions as set forth on the
above referred to subdivision plan.
BEING the same premises which Harry J. Myers, single man, by his
deed dated May , 1999 and recorded in the Office of the
Recorder of Deeds in and for Cumberland County in Deed
