1. The Plaintiff is Kathleen M. Kyle, residing at 838 Oakville Road, Newville Cumberland
County, Pennsylvania 17241.
2. The Defendant is Scott A. Kitson, residing at 167 Lepore Drive, Lancaster, Lancaster County,
Pennsylvania 17602.
3. Plaintiff seeks custody of the following child:

4. The relationship of Plaintiff to the child is that of natural mother.
The Plaintiff currently resides with the following persons:

6. Plaintiff has not participated as a party or witness, or in another capacity, in other litigation
concerning the custody of the child in this or another court.
Plaintiff does not have information of a custody proceeding concerning the child pending in a
court of this Commonwealth.
Plaintiff is not aware of a person not a party to the proceedings who has physical custody of
the child and claims to have custody or visitation rights with respect to the child.
7. The best interest and permanent welfare of the child will be served by granting the relief
request because:
a. Plaintiff is better able to care for the physical, emotional, educational and medical needs of
the child;
b. Defendant has shown little interest in the child.
8. Each parent who parental rights to the child have not been terminated and the person who has
physical custody of the child has been named as parties to this action.
WHEREFORE, Plaintiff requests the court to grant custody of the child to her, subject to
reasonable partial custody rights for Defendant.

AND NOW, this day of July, 1999, upon consideration of the attached Custody
Conciliation Report, it is ordered and directed as follows:
1. The Mother, Kathleen M. Kyle, shall enjoy legal and primary physical custody of
the minor child Lauren G. Kitson, bom July 19, 1995.
2. The Father, Scott A. Kitson, shall enjoy periods of visitation with the minor child at
such times and under such circumstances as agreed to by the Mother.
3. Neither party shall abuse alcohol or consume illegal drugs while exercising custody
of the minor child.
4. This order is entered pursuant to the attached Custody Conciliation Report and it is
noted that the Father was not in attendance at the Conciliation Conference. If the
Father desires to modify this order in any way, Father may petition the court to have
the case again scheduled for a Conference with the Custody Conciliator.

IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the following report:
1. The pertinent information pertaining to the child who is the subject of this litigation is as
follows:
Lauren G. Kitson, bom July 19, 1995.
2. A Conciliation Conference was held on July 16, 1999, with the following individuals in
attendance:
The Mother, Kathleen M. Kyle, with her counsel, Richard L. Webber, Jr., Esquire; the
Father, Scott A. Kitson, did not appear. The rather was served with notice of the
Conciliation Conference.
3. The Mother relates that the Father has somewhat limited contact with the minor child.
Based upon the Mother's position and the Father's failure to attend the Conciliation
Conference, the Conciliator recommends the entry of an order in the form as attached.
