WHEREAS, Joseph C. Patterson and Jan K. Patterson, of Harrisburg,
Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland
Custom Homes of Lancaster, Pennsylvania, for the erection of a dwelling upon a lot of land
situate as follows:
ALL THAT CERTAIN parcel of land situate in the Township of Hampden, County
of Cumberland, Commonwealth of Pennsylvania and being more particularly bounded and
described as follows:
BEGINNING at an iron pin at the southeasterly corner of Lot No. 128 and on
line of land of the Creekview Subdivision Plan Number 4, said point being located South 55"
48' 20" West, a distance of 674.55 feet from an iron pin on the northeast corner of Lot No.
133 and on the southerly right-of-way line of the Township Route 600 (Jerusalem Road) and
the northwest corner of the said Creekview Subdivision; thence, leaving the said Lot No. 128
and extending along the said Creekview Subdivision, South 55° 48' 20" West, a distance of
103.00 feet to an iron pin on the northeasterly corner of Lot No. 126; thence, leaving the said
Creekview Subdivision and extending along Lot No. 126, North 34° 11'40" West, a distance
of 97.59 feet to an iron pin on the easterly right of way of a 50 foot street known as
Sommerton Drive; thence, leaving the said Lot No. 126 and extending along the said drive
North 56° 07'05" East, a distance of 103.00 feet to an iron pin at the southwesterly corner of
the said Lot No. 128; thence, leaving the said right-of-way and extending along the said Lot
No. 128 South 34° 11'40" East, a distance of 97.03 feet to a point and place of BEGINNING.
CONTAINING 10,022.65 square feet and shown as Lot No. 127 on Hampden
Hearth Phase IV Subdivision Plan prepared by Grove Associates and recorded in Plan Book
68, Page 66.

NOW, the "l ly day of May, 1999, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said
Joseph C. Patterson and Jan K. Patterson, to the said Wheatland Custom Homes to commence
work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Wheatland Custom Homes and the further consideration of One
Dollar, to Wheatland Custom Homes paid by Joseph C. Patterson and Jan K. Patterson, it is
agreed that no lien shall be filed against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to
file such liens being expressly waived.
