Plaintiff, Garden State Car Rental Corporation dfo/a Budget Rent A Car of Newark International Airport is a business entity operating a rental facility located at Newark Airport, Monorail Station, D-2, Newark, New Jersey, 07114. 2. Defendant, Andrew Fish is an adult individual residing at 7043 Carlisle Pike, Carlisle, Cumberland County, Pennsylvania. 3. On January 14, 2001, Defendant, Andrew Fish entered into a rental agreement to rent a 2001 Ford Taurus from the Defendant. (See Exhibit A) 4. On February 4, 2001, Defendant was involved in a motor vehicle accident on Route 34 in South Middleton Township., Cumberland County, Pennsylvania as Mr. Fish struck a pick-up track causing extensive damages to the Tanms resulting in the Tanms being declared a total loss. 5. Defendant Fish has failed to pay the balance owed for the rental of the vehicle which amounts to $1,595.56. The Taurus vehicle was a total loss, less salvage, with a value of $10,461.01. 7. These damages are owed by Andrew Fish pursuant to the rental contract, as Mr. Fish rejected the loss damage waiver, and agreed to responsible for any damages to the vehicle. WHEREFORE, plaintiff demands Judgment against Defendant, Andrew Fish in the amount of $12,066.57 together with interest and costs of suit and delay damages pursuant to Pa. R.C.P. 238.
