Piscioneri, owner and Manhew Natale and Bridget Natale as Terra Tenants, upon the following claim: 1. Claimants, Yost Distributors, Inc., is a Pennsylvania Corporation having offices at 1928 Greenwood Street, Harrisburg, PA 17104 engaged in the business of distributing and installing supplies and equipment for fireplaces and accessories. 2. Daniel 1'. Piscioneri of 3315 Market Street, Canip Ifill, PA. Owner of 7 Fortuna Lane, Enola, PA. 3. Matthew Natale and Bridget Natale, his wife, by deed dated the 24"' day of March. 1999 and recorded on March 26. 1999 in the office of dte Recorder of Deeds of Cuniberland County in Record book 196 at page 498 appear to have become recent owners and 'Terra Tenants of the lands and dwelling thereon erected described on Exhihit A hereof. 4. Sub Contractor completed the perfiirtnance of his contract which included the start up of fireplace installed on the 25"' day of March. 1999 at the request of the Contractor who indicated that the premises were being sold that day and the Sub Contractor would be paid forthwith upon completion of the contracted star) up. 5. On or about December 11. 1998, Showcase Custom Builders, Inc., acting by and through (;fell Brandt their nuthoriMl agent, entered into a contract with the Sub Contractor for acquiring and the installation of fireplace equipment and accessories for use in the original erection and construction of n single Gvnify dwelling, then being elected on 7 Fortuna Lane: the fair and reasonable prices for the saute are: Model 750TR Slimline 36' Direct Vent Fireplace $ 950.(x) Model 407 Four Piece Slate Surround $ 225,(x) Model Winslow Mantel $ 275.0) PA Sales Tax $ 87,(X) TOTA1. $ 1.537.(x) 6. The contract for tits supplying and installation of the ahme equipment included alter the physical installation, the initial firing off of' tile fireplace as installed under the Sub- Contractors procedure firr "start up" which was ordered by the Contractor and the contract completed on the 25"' day of March, 1999 as aforesaid. 7. Despite a commitment to make immediate payment for the same alter "start up", the Contractor failed and rel'used on demand to keep said commitment and file aforesaid amount remains glue and owing to Sub-Contractor. 8. The premises upon which file improvements were made are descrilxd on Exhibit A and are known as 7 Fortuna Lane.
