Peter Them Builders, Inc., Contractor, IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. q9- 3430 q.\LtS WHEREAS, Todd D. Amsley and Beth M. Amsley, of Harrisburg, Pennsylvania, is about to execute contemporaneously herewith, a contract with Peter Them Builders, Inc. of Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN tract of land situate in Dickinson Township, Cumberland County, Pennsylvania, more particularly bounded and described pursuant to Final Subdivision Plan for Rockwell Farms, Sheet No. 3, recorded in Cumberland County Plan Book 63, Page 79B, as follows: BEGINNING at a point on the eastern right-of-way line of Thrush Drive (50 feet wide right-of-way) at the southwestern corner of Lot No. 58 as shown on the above-described subdivision plan; thence by said Lot No. 58 North 52 degrees, 29 minutes 45 seconds East 400.14 feet to a point at the southeastern corner of said Lot No. 58, which point is also in line of Lot No. 67 as shown on the above-described subdivision plan; thence by said Lot No. 67 and Lot No. 68 as shown on the above-described subdivision plan, South 39 degrees, 48 minutes, 35 seconds East 330.91 feet to a point on the northern right-of-way line of Thrush Drive; thence by the northern right-of-way line of Thrush Drive, South 52 degrees 29 minutes, 45 seconds West 232.15 feet to a point on said right-of-way line; thence by said right-of-way line by a curve to the right having a radius of 174.89 feet an arc distance of 267.68 feet to a point on the western right-of-way line of said Thrush Drive; thence by said right-of-way line, North 39 degrees, 48 minutes, 35 seconds West 162.91 feet to a point on said right-of-way line, the point and place of BEGINNING. CONTAINING 2.90 acres or 126,331 square feet and being designated Lot No. 57 as shown on the above-described Subdivision Plan. ,, UNDER AND SUBJECT, NEVERTHELESS, to all utility and drainage easements as shown on the above-described Subdivision Plan. UNDER AND SUBJECT, NEVERTHELESS to the Building and Use Restrictions as set forth in prior deeds. NOW, the `W- day of 4 v, rN L , 1999, at the time of and immediately before the execution of the principal contrail, and before any authority has been given by the said Todd D. Amsley and Beth M. Amsley, to the said Peter Them Builders, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Peter Them Builders, Inc. and the further consideration of One Dollar, to Peter Them Builders, Inc. paid by Todd D. Amsley and Beth M. Amsley, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men cr workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
