LOWNDES, Owner : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA CARLSON CONSTRUCTION, INC., Contractor NO. 03'-- WHEREAS, CHRISTOPHER LOWNDES, JR. and REBECCA H. LOWNDES of 150 Lucinda Lane, Reading, Pennsylvania, is about to execute contemporaneously herewith, a contract, with Carlson Construction, Inc. of 1085 Country Club Road, Camp Hill, Pennsylvania, for the erection of a building upon premises commonly known as LOT H14 FASHIION CIRCLE, Townshi~ EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth ~ the deed dated .-']"'0v~. ~'~} ~-*~, recorded at Deed Book , Page , in the Recorder s Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, June 23, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. CARLSON Exhibit "A" ALL THAT CERTAIN piece or parcel of land situate in East Pennsboro Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the western side of Fashion Circle at the northeastern corner of Lot No. H-13 on the hereinafter mentioned Plan of Lots; thence along the eastern side of Lot No. Hq3, South 28 degrees 38 minutes 23 seconds West, a distance of 125.00 feet to a point at the eastern line of lands now or formerly of Floribunda Associates, L.P.; thence along the said northeastern line of said lands, South 65 degrees 04 minutes 40 seconds East, a distance of 68.00 feet to a point at the same said lands of Floribunda Associates, L.P.; thence along those said same lands, North 61 degrees 05 minutes 00 seconds East, a distance of 125.00 feet to a point at the same lands; thence along those said same lands, North 66 degrees 34 minutes 60 seconds East, a distance of 18.36 feet to a point at the southwestern corner of Lot No. H-16 on the hereinafter mentioned Plan of Lots; thence along the western side of Lot No. H-16, North 29 degrees 00 minutes 00 seconds West, a distance of 115.38 feet to a point on the southern side of Fashion Circle; thence along the said southern line of Fashion Circle, by a curve to the left having a radius of 50.00 feet and an arc length of 89.77 feet to a point, the point and place of BEGINNING. CONTAINING 16,384.05 square feet or 0.38 acre. BEING Lot No. H-14, on the Final Subdivision Plan of Floribunda Heights, Phase II, Sections K & H, dated October 5, 1999, prepared by Melham Associates, P.C., and recorded in the Office of the Recorder of Deeds, Cumberland County, Pennsylvania, in Plan Book 81, Page 73.
