Sharon E. Wilt but was unable to locate them in his bailiwick. He therefore deputized the

amount of the judgment plus costs or the back payments, late charges, costs and reasonable attorney's fees

2. You may be able to stop the sale by filing a petition asking the Court to strike or open the
judgment, if thejudgment was improperly entered. You may also ask the Court to postpone the sale for good
cause.
3. You may be able to stop the sale through other legal proceedings.

1. If the Sheriffs Sale is not stopped, your property will be sold to the highest bidder. You may

2. You may be able to petition the Court to set aside the sale if the bid price was grossly
inadequate compared to the value of your property.
3. The sale will go through only if the buyer pays the Sheriff the full amount due in the sale.

4. If the amount due from the buyer is not paid to the Sheriff, you will remain the ownerof the
property as if the sale never happened.
5. You have aright to remain in the property until the full amount due is paid to the Sheriff and
the Sheriff gives a deed to the buyer. At that time, the buyer may bring legal proceedings to evict you.
6. You may be entitled to a share of the money which was paid for your house. A schedule of

Plaintiff is NATIONSBANC MORTGAGE CORPORATION SUCCESSOR BY MERGER
TO NATIONSBANC MORTGAGE CORPORATION OF NEW YORK, with its principal place of
business located at 205 PARK CLUB LANE, PO BOX 9000, BUFFALO, NY 14231-9000.
2. The names and last known addresses of the Defendants are: JOHN E. WILT JR. AND
SHARON L. WILT, 109 EAST ORANGE ST., FL 1, SHIPPENSBURG, PA 17257.
3. The interest of each individual Defendant is as mortgagor, real owner of the real property
subject to the mortgage described below, or both.
4. On or about JUNE 30, 1995, Mortgagors made, executed and delivered a Mortgage upon
the premises hereinafter described to THE HUNTINGTON MORTGAGE COMPANY, which Mortgage
is recorded as follows:

The Mortgage is a matter of public record and is incorporated herein as provided by Pa. R.C.P. 1019(g),
A true and correct copy of said Mortgage is attached hereto as Exhibit "A" and incorporated herein by
reference.
5. On or about JUNE 30, 1995, in consideration of their indebtedness to THE
HUNTINGTON MORTGAGE COMPANY, JOHN E. WILT JR. AND SHARON L. WILT made,
executed and delivered to THE HUNTINGTON MORTGAGE COMPANY their promissory Note in the
original principal amount of $50,850.00. A copy of said Note is attached hereto as Exhibit "B" and
incorporated herein by reference.
6. Plaintiff is the legal holder of the Mortgage and Note by virtue of being either the original
Mortgagee, the legal successor in interest to the original Mortgagee, or the present holder of the Mortgage
by virtue of the following assignments:

7. The Mortgage is secured by property located at 125 NORTH WASHINGTON ST.,
SHIPPENSBURG, PA 17257, which is more particularly described in the legal description attached hereto
as Exhibit "C" and incorporated herein by reference.
8. The Mortgage is in default because the monthly installments of principal and interest and
other charges stated below, all as authorized by the Mortgage, due AUGUST 1, 1998 and monthly
thereafter are due and have not been paid, whereby the whole balance of principal and all interest due
thereon have become immediately due and payable forthwith together with late charges, escrow deficit (if
any), and costs of collection including title search fees and reasonable attorney's fees.

9. The following amounts are due on the Mortgage and Note:

Interest continues to accrue at the per diem rate of $11.71 for every day after MAY 31, 1999 that
the debt remains unpaid.
10. The original principal balance of the Mortgage is in excess of $50,000.00 and therefore,
Notice of Intention to Foreclose Mortgage, pursuant to Act 6, 41 P.S. §403 is not applicable.
11. Pursuant to the notice provisions of Act 91, 35 P.S. §1680.403(c), notice was sent to
Defendants, dated MARCH 12, 1999. Copies of the notices to the defendants are attached as Exhibit "D".
Defendants have failed to meet with the plaintiff or any of the consumer credit counseling agencies listed
in the notice and/or have further failed to meet the time limitations specified in the notice and/or have been
denied assistance from the Pennsylvania Housing Finance Agency.
12. Notice pursuant to the Fair Debt Collection Practices Act is attached as Exhibit "E".

WHEREFORE, Plaintiff respectfully requests this Court to enter judgment IN REM in favor of
Plaintiff and against Defendants in the amount set forth in paragraph 9, together with interest, attorney's
fees, and other expenses, costs and charges collectible under the Mortgage and Note and for the foreclosure
and sale of the mortgaged premises.

event shall any such maturity or due dam extend beyond the due dale of the final installment of the principal debt.

mortgage is instituted upon or under this Mortgage, an mori commission of
Five per centum ( 5.0000 %) of said principal debt shall be
payable, and recovered in addition to all principal and interest and all other recoverable sums then due, together with costs of
suit.
14. If any deficiency in the amount of any aggregate monthly payment mentioned in (b) of paragraph 2 shall not be made
good by Mortgagor prior to the due date of the next such payment, or if default he made at any time in any of the covenants
and agreements herein, or in the Note secured, then and in every such arse, the whole principal debt shall, at the option of
Mortgagee, become due and payable immediately. Payment thereof and all imeresl accrued thereon, with an atmmcy's
commission as hercinbefore mentioned, may be enforced and recovered at once, anything herein contained to the contrary
notwithstanding.
In the event of any breach of any covenant condition, or agreement of said Note, or of this Mortgage, it shall be lawful
for Morlgagce to enter upon all and singular the land, buildings, and other rights, corporeal and incorporeal, granted by this
Mortgage, and m Like possession of the same, and or the fixtures and equipment dicrcin, and to have, hold, manage, love to
any person or persons, use and operate the same in such parcels and on such terms and for such periods of time as Mortgagee
may deem props in its sole discretion, Mortgagor agreeing that he shall and will, whenever requested by Mongagoe so to do,
assign, transfer, and deliver unto Mortgages any mace or sublease; and to collect and receive all rents, issues, and profits of
said mortgaged premises and every pan thereof, for all of which said Note shall he a sufficient warrant whether or not such
Icase or sublease has been assigned; and to make from time to time all reasonable alterations, renovations, repairs, and
replacements thereto. After deducting the cost of such alterations, renovations, repairs, replacements, and the expenses incident
to taking and retaining possession of the mortgaged property, the management and operation thereof, and in keeping the some
properly insured, to apply any residue of such rents, issues, and profits to the payment of (a) all ground rents, taxes, charge,
claims, msvssmeaLS, sewer and water rents, and any other liens that may he prior in lien or payment to the debt secured by this
Mortgage, with interest thereon, (b) premiums for said insurance, with interest mcrmn, (c) the interest and principal due and
secured by this Mortgage with all costs and attorney's fees; in such order or priority as Mortgagee may determine, any statute,
law, custom, or use in the contrary notwithstanding.
The Liking of possession of the mortgaged premises by Mongagce, as herein provided, shall not relieve any default by
Mortgagor, or prevent the onforcemuu of any of the remndiex provided by said Nom or this Mortgage.
The remedies provided by said Note and this Mortgage at any other indebtedness therein provided or secured by this
Mortgage, and for the performance of the covenants, conditions, and agreements of said Note or this Mortgage we cumulative
and concurrent, and may be pursued singiy, or successively, or together, at the sole discretion of Mortgagee, and may be
exercised as often as occasion therefor shall occur.
PROVIDED, that in use default shall he made in the payment of any installment of principal and interest, or any other
payment hercinabove or in the conditions of said recited Note provided for, or in the keeping and performance by the
Mortgagor of any =,enanl or agreement contained therein or in this Mortgage to be by said Mortgagor kept and performed,
in the manner and at the time specified for the performance thereof, such default will entide Mangagec forthwith to bring and

NOTICE REQUIRED BY THE FAIR DEBT COLLECTION
PRACTICES ACT. fthe Act) IS S•. _SECTION 1601 A AMENDED
1. This law firm may be deemed a "debt collector" under the Fair Debt Collection
Practices Act. Any and all information obtained during the prosecution of this lawsuit may be
used for the purpose of collecting the debt.
2. The amount of the debt is stated in paragraph 9 of the Complaint.
3. The Plaintiff as named in the Complaint is the creditor to whom the debt is
owed, or is servicing agent for the creditor to whom the debt is owed. The undersigned
attorney represents the interests of the Plaintiff.
4. The debt described in the Complaint, evidenced by the copy of the mortgage
note attached hereto, will be assumed to be valid by the creditor's law firm unless the debtor,
within thirty (30) days after the receipt of this notice, disputes in writing the validity of the
debt or some portion thereof.
5. If the debtor notifies the creditor's law firm in writing within thirty (30) days of
the receipt of this notice that the debt or any portion thereof is disputed, the creditor's law firm
will obtain a verification of the debt and a copy of the verification will be mailed to the debtor
by the creditor's law firm.
6. If the creditor named as Plaintiff in the Complaint is not the original creditor,
and if the debtor makes a written request to the creditor's law firm within the thirty (30) days
from the receipt of this notice, the name and address of the original creditor will be mailed to
the debtor by the creditor's law firm.
