WHEREAS, Robert L. Nause and Rose Ann J. Nause, his wife, hereinafter referred to as Owners, of 3469
Sullivan Street, Mechanicsburg, Cumberland County, Pennsylvania 17055, are about to execute
contemporaneously herewith, a contract with Michael Manning & associates, of 1706 Kathryn Street, New
Cumberland, PA 17070, for the completion of a custom house upon a lot of land situate:
ALL THAT CERTAIN piece, parcel, tract of land situate in East Pennsboro Township, Cumberland County,
Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the dedicated right of way
line of Sullivan Street at the dividing line of Lot Nos, 14 and 15. Hickory Ridge, Phase 1, recorded in plan
Book 77 page 143; thence by said dividing line, South 66 degrees 46 minutes 45 seconds East a distance of
165.49 feet to a point at the dividing line of lands now or late of Irvin E. Stambaugh and Thelma G. Stambaugh
and lands herein described; thence by the same and beyond by other lands of Irvin E. and Thelma G.
Stambaugh, South 3 degrees 48 minutes 20 seconds East a distance of 89.81 feet to a point at the dividing line
of Lot Nos. 16 and 15, herein described; thence by said dividing line, North 66 degrees 46 minutes 45 seconds
West, a distance of 206.30 feet to a point on the dedicated right of way line of Sullivan Street; thence by said
right of way line, North 23 degrees 13 minutes 15 seconds East, a distance of 80 feet to a point, THE PLACE
OF BEGINNING. BEING Lot No. 15, containing 14,871.33 square feet, as shown on the Final Subdivision
Plan of Hickory Ridge Phase 1, as recorded in Plan Book 77 page 143, and being subject to all easements of
record. BEING A PART of the same premises which South Central Service Corporation, a Pennsylvania
corporation, by deed dated February 22, 1995 and recorded March 2. 1995, in the Office of the Recorder of
Deeds of Cumberland County in Deed Book 119 page 120, granted and conveyed unto Michael Manning &
associates, a Pennsylvania General Partnership.
NOW, JUNE 9 , 1999, at the time of and immediately before the execution of the principal contract, and before
any authority has been given by the said Owners to the said Contractor to commence work on the said building,
or purchase materials for the same in consideration of the making of said contract with said Owners and the
further consideration of One Dollar, to Contractor, paid by owners, it is agreed that no lien shall be filed
against the building by the contractor, or any subcontractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said
building, right to file such liens being expressly waived.
