MICHAEL MATTESKY; Respondent : IN THE COURT OF COMMON PLEAS OF :CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION- LAW • 3G/ a NO. 99- CIVIL TERM PROTECTION FROM ABUSE TEMPORARY PROTECTIVE ORDER AND NOW, this le day of June, 1999, upon presentation and consideration of the within Petition, and upon finding that TINA MARIE KASSAM, now residing in Cumberland County, Pennsylvania, is in immediate and present danger of abuse from the Respondent, MICHAEL MATTESKY, the following Temporary Order is entered. The Respondent, MICHAEL MATTESKY, whose current address is Lancaster County Prison, 625 East King Street, Lancaster, Lancaster County, Pennsylvania 17602, is hereby enjoined from physically abusing the Petitioner, TINA MARIE KASSAM, and their minor daughter, Brianna Marie Mattesky, bom June 28, 1998, or placing them in fear of abuse and is ordered to stay away from any location where they may reside. The Petitioner is hereby awarded primary physical custody of the parties' minor child. The Respondent is hereby notified that if he fails to follow this Order, he may be in indirect criminal contempt which is punishable by a fine not to exceed $1,000.00 and/or by a sentence of up to six months in jail and any other appropriate punishment. This Order shall remain in effect until a final order is entered in this case. A hearing shall be held on this matter on the ? /S/ay of June, 1999, at ff az)dm. in Courtroom No. *3 , Cumberland County Courthouse, Carlisle, Pennsylvania. The Cumberland County SherifTs Office shall attempt to make service at the Petitioner's request, but service may be accomplished under any applicable rule of Civil Procedure. This Order shall be enforced by any law enforcement agency where a violation occurs by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the police officer. In the event that an arrest is made under this section, the Respondent shall be taken without unnecessary delay before the court that issued the Order. CIVIL ACTION - LAW NO. 99- CIVIL TERM MICHAEL MATTESKY, Respondent PROTECTION FROM ABUSE PETITION FOR PROTECTIVE ORDER AND NOW, comes the petitioner, Tina Marie Kassam, by and through her attorneys, IRWIN, McKNIGHT & HUGHES, esquire, and files this Petition for Protective Order making the following statement: 1. The petitioner is Tina Marie Kassam, an adult individual residing at 403 North Bedford Street, Carlisle, Cumberland County, Pennsylvania 17013. 2. The respondent is Michael Mattesky, an adult individual currently incarcerated in the Lancaster County Prison located at 625 East King Street, Lancaster, Lancaster County, Pennsylvania 17602. 3. On or about July, 1997, the parties began residing together. 4. The respondent, within two (2) months of residing with the petitioner, began physically abusing the petitioner, including but not limited to grabbing her shoulders, slamming her head on the floor, and knocking her down. 5. Approximately September, 1997, the petitioner found out she was pregnant, and moved to California. 6. In December, 1997, the petitioner and respondent reconciled, and the petitioner moved back to Cumberland County in January 1998. 7. By May, 1998, the respondent began abusing the petitioner again, and the petitioner moved out of the residence in which they were living. 8. After the petitioner moved out in May, 1998, the respondent behaved in such a manner that the police arrested him 1'or various offenses including possession of a controlled substance. 9. During most times of abuse, the respondent ofien threatened to kill the petitioner, and also often stated that he would see her in hell. 10. The respondent was bailed out of jail approximately one (1) month later and moved back in with the petitioner; the petitioner was afraid for her life at this time, but was too frightened to contact the police or obtain a protection from abuse order. 11. The petitioner gave birth to the parties' daughter, Brianna Marie Mattesky, on June 28, 1998. 12. After the child was born, the respondent again began abusing the petitioner, and at one point grabbed her by the throat and strangled her for several seconds leaving marks on the petitioner's neck for two weeks afterwards. 13. The respondent complained often about the minor child while residing with the petitioner and the child, saying "I can't get the fucking little bitch to stop bawling." 14. At the end of January, 1999, the respondent went back to jail for parole violation, and was subsequently transferred to Lancaster County Prison for a parole violation in Lancaster County where he remains today. 15. While in prison, both at the Cumberland County Prison and the Lancaster County Prison, the respondent wrote several threatening letters to the petitioner. Copies of said letters are attached as Exhibit "A." 16. On June 11, 1999, the respondent is scheduled for a preliminary hearing on the parole violation in Lancaster County, and may be released from jail at this time. 17. The petitioner is in fear of serious bodily injury to herself and her two (2) children (she has a minor daughter to her first husband). WHEREFORE, Petitioner respectfully requests this Honorable Court to enter an order providing that : a. Respondent shall refrain from abusing threatening with violence, harassing or visiting the Petitioner in any manner; b. Respondent shall be excluded from the marital residence, or any residence where the Petitioner and her minor children may reside; C. Petitioner shall be granted primary physical custody of the parties' minor children; d. Such other relief as this Court deems necessary. The Petitioner is Tina Marie Kassam, an adult individual whose most recent permanent residence is in Carlisle, Cumberland County, Pennsylvania. 2. The Respondent is Michael Mattesky, an adult individual currently incarcerated in the Lancaster County Prison located at 625 East King Street, Lancaster, Lancaster County, Pennsylvania 17602. 3. For the time being, the Respondent will continue to remain incarcerated at the Lancaster County Prison. 4. Due to the continuing incarceration of the Respondent and other circumstances, the Petitioner seeks to withdraw her Petition for Protective Order at this time. 5. In light of the fact that a hearing on said Petition is scheduled for Monday, June 21, 1999, at 11:00 a.m., before the Honorable George E. Hoffer, Petitioner, requests that said hearing be cancelled.
