MOTION TO MAKE RULE ABSOLUTE
AND NOW, comes the Plaintiff, by his attorneys, Goldberg, Katzman &
Shipman, P.C., who states:
Plaintiff, Scott A. Bryson, sustained property damages as a result of a
motor vehicle accident caused by Defendant, Michael A. Jones, on July 6, 1997.
2. Plaintiff Bryson has obtained a Judgment against Defendant, Michael A.
Jones, on June 10, 2000.
3. Requests for Admissions setting forth the property damage sustained by
Plaintiff Bryson were forwarded to Defendant Jones, and no response to those Requests
was received. There, pursuant to Pa. R.C.P. 4014(6), the Requests are deemed admitted.
4. Plaintiff Bryson tiled a Petition requesting the assessment of damages with
the court. By Order of August I, 2002, the Honorable Edgar B. Bayley issued a Rule
directing the Defendant to show cause why damages should not be assessed on the
Judgment against him. The Rule was returnable 10 days from service. A certified letter
containing the Rule was forwarded to Defendant, Michael Jones, with letter of August 7,
2002. A copy is attached hereto as Exhibit "A." No response has been received from the
Defendant.
As Defendant Jones has not responded to the Rule to Show Cause issued
by this court, Plaintiff requests that the court assess damages in the amount of $3,150.43,
together with interest and costs of suit.
WHEREFORE, Plaintiff requests that this court make the Rule absolute and
assess damages on the Judgment against the Defendant in the amount of $3,150.43,
together with interest and costs of suit.

PETITION TO ASSESS DAMAGES
AND NOW, comes the Plaintiff, by his attorneys Goldberg, Katzman & Shipman,
P.C. who state:
1. Plaintiff Scott A. Bryson sustained property damage as a result of a motor
vehicle accident caused by Defendant Michael Jones on July 6, 1997.
2. Plaintiff Bryson has obtained a Judgment against Michael A. Jones on June
10, 2002.
3. Requests for Admissions, a copy of which are attached hereto as Exhibit A,
were forwarded to Defendant Jones on June 13, 2002 and there has been no response
received to those Requests for Admissions. Pursuant to Pa. R.C.P. 4014(b), as the
Requests have not been answered, they are deemed admitted.
WHEREFORE, Plaintiff Bryson requests the Court issue a Rule upon Defendant
Jones to show cause why the Covet should not assess damages on the Judgment in the
amount of $3,150.43, together with interest and costs of suit.

MOTION TO MAKE RULE ABSOLUTE
AND NOW, comes the Plaintiff, by his attorneys, Goldberg, Katzman &
Shipman, P.C., who states:
I. Plaintiff, Scott A. Bryson, sustained property damages as a result of a
motor vehicle accident caused by Defendant, Michael A. Jones, on July 6, 1997.
2. Plaintiff Bryson has obtained a Judgment against Defendant, Michael A.
Jones, on June 10, 2000.
3. Requests for Admissions setting forth the property damage sustained by
Plaintiff Bryson were forwarded to Defendant Jones, and no response to those Requests
was received. There, pursuant to Pa. R.C.P. 4014(b), the Requests are deemed admitted.
4. Plaintiff Bryson tiled a Petition requesting the assessment of damages with
i
the court. By Order of August I, 2002, the Honorable Edgar 13. Bayley issued a Rule
directing the Defendant to show cause why damages should not be assessed on the
Judgment against him. The Rule was returnable 10 days from service. A certified letter
containing the Rule was forwarded to Defendant, Michael Jones, with letter of August 7,
2002. A copy is attached hereto as Exhibit "A." No response has been received from the
Defendant.
As Delendant Jones has not responded to the Rule to Show Cause issued
by this court, Plaintiff requests that the court assess damages in the amount of $3,150.43,
together with interest and costs of suit.
WHEREFORE, Plaintiff requests that this court make the Rule absolute and
assess damages on the Judgment against the Defendant in the amount of $3,150.43,
together with interest and costs of suit.

AND NOW, comes Scott Bryson, by his attorneys, Goldberg, Katzman & Shipman, P.C. who
states:
Plaintiff, Scott A. Bryson is an adult individual residing at 680-11 Geneva Drive,
Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant, Michael A. Jones is an adult individual residing at 111 West King Street,
Waynesboro, Franklin County, Pennsylvania.
3. This matter involves a motor vehicle accident that occurred on Sunday, July 6, 1997
at approximately 10:15 p.m. in the first block of North Front Street, Wormleysburg, Pennsylvania.
4. Plaintiff Scott Bryson was operating a 1990 Chevrolet Beretta proceeding along Front
Street.
5. Defendant, Michael A. Jones was operating a 1987 Plymouth Sundance vehicle
traveling behind the Bryson vehicle.
6. Plaintiff Scott Bryson was stopped in aline oftraffic when his vehicle was struck from
behind by the vehicle operated by Michael Jones resulting in property damage to the vehicle and
personal injuries to Mr. Bryson.
7. The aforesaid accident arose solely as a result ofthe negligence of Defendant, Michael
Jones in that he:
a, inattentive in the operation of his motor vehicle;
b. took his eyes offofthe roadway because of use of a phone/beeper device and
failed to observe the traffic ahead of him;
C. failed to be alert for the presence of motor vehicles around him,
d. operated his vehicle too closely to the rear of the vehicle ahead of him; and
e. allowed his vehicle to strike the rear of the Bryson vehicle resulting in
damages and personal injuries.
8. The aforesaid accident was solely the result of the negligence of Defendant Jones.
9. As a result of the accident Mr. Bryson's vehicle sustained property damage in the
amount of $3,150.43.
10. As a result of the collision Scott Bryson incurred personal injuries including:
(A) cervical and lumbar strain; and
(B) ongoing complications and pain from these injuries.
11. As a result of the injuries, Mr. Bryson has incurred the cost of medical treatment and
medications and will continue to incur the costs for ongoing care.
12. As a direct result of the aforesaid injury, Plaintiff Bryson has undergone, and will in
the future undergo, great physical and mental pain and suffering, great inconvenience in carrying out

his daily activities, loss of life's pleasures and enjoyment and claim is made for these damages.
13. As a direct result of the aforesaid injury, Plaintiff Bryson has been subjected to great
humiliation and embarrassment and claim is made for these damages.
14. As a direct result of the aforesaid injury, Plaintiff Bryson has sustained and in the
future will likely sustain work loss and an impairment of earning capacity and a claim is made for
these damages.
WHEREFORE, Plaintiff demands judgment against Defendant Michael Jones in an amount
in excess of $25,000 together with interest and costs of suit.

EXPLANATION OF BANKRUPTCY DISCHARGE
IN A CHAPTER 7 CASE
This court order grants a dischazge to the person named as the debtor. It is not a dismissal of the case and it
does not determine how much money, if any, the trustee will pay to creditors.
The dischazge prohibits any attempt to collect from the debtor a debt that has been discharged. For example, a
creditor. is not pernutted to contact a debtor by mail, phone,.or otherwise, to 61e or continue a lawsuit, to attach wages
or other property, or to take any other action to collect a discharged debt from the debtor. /bi a case involving
community prnperry: There are also special rules that protect certain community property owned by the debtor's
spouse, even if that spouse did not file a bankruptcy case.] A creditor who violates this order can be required to pay
damages and attorney's fees to the debtor.
However, a creditor may have the right to enforce a valid lien, such as a mortgage or security interest, against
the debtor's property after -he bankruptcy, if that lien was not avoided or eliminated in the bankruptcy case. Also, a
debtor may voluntarily pay any debt that has been discharged.
'The chapter 7 discharge order eliminates a debtor's legal obligation to pay a debt that is discharged. Most, but
not all, types of debts are discharged if the debt existed on the date the bankruptcy case was filed. (lf this case was
begun under a different chapter of the Bankruptcy Code and converted to chapter 7, the discharge applies to debts
owed when the bankruptcy case was converted.)
Some of the common types of debts which are ~ dischazged in a chapter 7 bankruptcy case are:
a. Debts for most taxes;
b. Debts incurred to pay nondischazgeable taxes;
c. Debts that are domestic support obligations;
d. Debts for most student loans;
e. Debts for most fines, penalties, forfeitures, or criminal restitution obligations;
f. Debts for personal injuries or death caused by the debtor's operation of a motor vehicle, vessel, or aircraft
while intoxicated;
g. Some debts which were not properly listed by the debtor;
h. Debts that the bankruptcy court specifically has decided or will decide in this bankruptcy case are not
discharged;
i. Debts for which the debtor has given up the dischazge protections by signing a reaffirmation agreement in
compliance with the Bankruptcy Code requirements for reaffirmation of debts; and
j. Debts owed to certain pension, profit sharing, stock bonus, other retirement plans, or to the Thrift Savings
Plan for federal employees for certain types of loans from these plans.
This information is only a general summary of the bankruptcy discharge. There are exceptions to these
general rules. Because the law is complicated, you may want to consult an attorney to determine the exact
effect of the discharge in this case.
