Pennsylvania Corporation, Owner Wheatland Custom Homes, Inc. a Pennsylvania Corporation, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA 8o35 STIPULATION AGAINST LIENS WHEREAS, Wheatland Custom Homes, Inc. a Pennsylvania Corporation, of Lancaster County, Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom Homes, Inc. a Pennsylvania Corporation of Lancaster County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland County, Commonwealth of Pennsylvania, being more particularlybounded and described as follows, to wit: BEGINNING at a point on the northern right-of-way line of Crofton Court at the common front property comer of Lot No. 307 and Lot No. 308 as shown on the hereinafter mentioned Plan of Lots; thence along said right-of-way line South 36 degrees 47 minutes 22 seconds West, a distance of 101.00 feet to a point at the dividing line between Lot No. 308 and Lot No. 309; thence along said dividing line North 53 degrees 12 minutes 38 seconds West, a distance of 267.21 feet to a point; thence North 22 degrees 27 minutes 29 seconds East, a distance of 49.74 feet to a point; thence continuing along same North 32 degrees 59 minutes 25 seconds East, a distance of 52.95 feet to a point at the dividing line between Lot No. 307 and Lot No. 308; thence along said dividing line South 53 degrees 12 minutes 38 seconds East, a distance of 283.34 feet to a point, said point being the Place of BEGINNING. THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 308 of the Final Subdivision Plan of Hampden Hearth - Phase IV-B recorded in the Cumberland County Courthouse in Plan Book 79, Page 107. The above described tract containing 33,188.47 square feet, more or less. THE ABOVE DESCRIBED-TRACT BEING SUBJECT TO various easements of record as indicated on the above-referenced Subdivision Plan. UNDER AND SUBJECT to an unnamed stream, a 60 foot drainage easement centered on existing unnamed stream and a 100 year flood plan limit all of which are along the rear lot line. UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book 340, Page 491, and Miscellaneous Book 433, Page 942, in Cumberland County, Pennsylvania. NOW, the ~-~'~% day of June, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Wheatland Custom Homes, Inc. a Pennsylvania Corporation, to the said Wheatland Custom Homes, Inc. a Pennsylvania Corporation to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Wheatland Custom Homes, Inc. a Pennsylvania Corporation and the further consideration of One Dollar, to Wheatland Custom Homes, Inc. a Pennsylvania Corporation paid by Wheatland Custom Homes, Inc. a Pennsylvania Corporation, it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
