TOMASKO of Harrisburg, Pennsylvania, are }bo?t?}t to,??ggxecute contemporaneously herewit a, c ntract, with LPLfl?t6-yZ. of G1rf t,S w' • , Pennsylvania, for the erection of a, _ story building upon a lot more fully described as follows: ALL THAT CERTAIN piece or parcel ofland situate in the Township of Middlesex, County of Cumberland, Pennsylvania, known as Lot No. 11 of the Final Subdivision Plan of Jack Beitzel prepared by Hartman & Associates, Inc. dated July 1, 1992 and recorded in the Cumberland County Recorder's Office in Plan Book 66, Page 35 and being bounded and described as follows, to wit: BEGINNING at a point on the right of way line of Cedar Road, which point is at the dividing line of the within described Lot No. 11 and Lot No. 10 on the aforementioned Subdivision Plan; THENCE along said dividing line, North 34 degrees 48 minutes 00 seconds East, a distance of 419.35 feet to a point on the right of way line of Cedar Road; THENCE along the right of way line of Cedar Road the following 4 courses and distances: (1) along a curve to the left having a radius of 175 feet and an arc length of 196.28 feet; (2) THENCE North 72 degrees 21 minutes 00 seconds East a distance of 92.14 feet to a point; (3) THENCE along a curve to the left having a radius of 175.00 feet and an arc length of 389.58 feet to a point; (4) THENCE South 55 degrees 12 minutes 00 seconds East a distance of 91.98 feet to a point at the dividing line of the within described Lot No. 11 and Lot No. 10 on the aforementioned subdivision plan, the POINT AND PLACE OF BEGINNING. i CONTAINING 2.0941 acres, more or less. UNDER AND SUBJECT, NEVERTHELESS, to any and all conditions, easements and restrictions set forth on the Subdivision Plan recorded in Plan Book 66, Page 35 and any other conditions, easements and restrictions of prior record. Now, '.(nni1P l 7 1999 at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said RONALD T. TOMASKO and JOYCE E. TOMASKO of Harrisburg, Pennsylvania to the said C to commence work on the said building, o purchase materials for the same in consideration of the making of the said contract with RONALD T. TOMASKO and JOYCE E. TOMASKO of Harrisburg, Pennsylvania and further the consideration of One Dollar to them paid by RONALD T. TOMASKO and JOYCE E. TOMASKO of Harrisburg, Pennsylvania, it is agreed that no lien shall be filed against the building by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, commonly callled a Mechanic's Lien, the right to file such liens being expressly waived.
