YOU HAVE BEEN SUED IN COURT. If you wish to defend against the claims set forth in the
following pages, you must appear at the hearing scheduled herein. If you fail to do so, the case may proceed
against you and a FINAL Order may be entered against you granting the relief requested in the Petition. In
particular, you may be evicted from your residence and lose Or important rights.
A hearing on the matter is scheduled for the 3° , day of 1999, at3_.4,m., in

You MUST obey the Order that is attached until it is modified or terminated by the court after notice

months in jail under 23 Pa. C. S. § 6114. Violation may also subject you to prosecution and criminal penalties
under the Pennsylvania Crimes Code. Under federal law, 18 U.S.C. § 2265, this Order is enforceable
anywhere in the United States, tribal lands, U.S. Territories and the Commonwealth of Puerto Rico. If you
travel outside of the state and intentionally violate this Order, you may be subject to federal criminal
proceedings under the Violence Against Women Act, 18 U.S.C. §§ 2261-2262.

From Abuse, the court hereby enters the following Temporary Order:
[X] 1. Defendant shall not abuse, harass, stalk or threaten any of the above persons in any place where they
might be found.
[ ] 2. Defendant is evicted and excluded from the residence at [FILL IN ADDRESS] or any other permanent
or temporary residence where Plaintiff may live. Plaintiff is granted exclusive possession of the
residence. Defendant shall have no right or privilege to enter or be present on the premises.
[X] 3. Except for such contact with the minor children as my be permitted under Paragraph 5 of this Order,
Defendant is prohibited from having ANY CONTACT with Plaintiff at any location, including but not
limited to any contact at Plaintiff's school, business, or place of employment. Defendant is specifically
ordered to stay away from Plaintiffs home at 1507 Letchworth Road, Camp Hill, PA, for the duration
of this Order.
[X] 4. Except for such contact with the minor children as may be permitted under Paragraph 5 of this Order,
Defendant shall not contact Plaintiff by any means, including through third persons, except by telephone
between the hours of 6:30pm and 7:30pm on weekdays, with the Plaintiff on the other line of the phone
to monitor the call.
[XJ 5. Pending the outcome of the final hearing in this matter, custody of the parties' children shall be as set
out in the Court's Order of June 8, 1999, docket 1196-2576, which suspends a previous Order of
April 29, 1998. The Order of April 29, 1998, gave Defendant partial custody of the children, Molly
and Quinn, and gave the Plaintiff primary custody. The Order of June 8, 1999, suspended Defendant's
right to partial custody and gave full physical custody to the Plaintiff, pending further hearing. A copy
of the Court's Order of June 8, 1999, is appended hereto and is incorporated herein by reference.
Until the final hearing, all contact between Defendant and the children shall be limited to the following:
Phone calls on weekdays, between 6:30 pm and 7:30 pm. These calls may be monitored by the
Plaintiff.
The local law enforcement agency in the jurisdiction where the children are located shall ensure that
the children are placed in the care and control of the Plaintiff in accordance with the terns of this
Order.
[XI 6. Defendant shall immediately relinquish the following weapons to the Sheriff's Office or a designated
local law enforcement agency for delivery to the Sheriffs office:
It is not known if the Defendant owns any weapons of her own, but it is suspected that the Defendant's
boyfriend, Troy Cohen, 196 Hershey Road, Hummelstown, PA, 17036, does own guns. Defendant
currently resides with Mr. Cohen. She shall not take possession nor seek access to these weapons.
Defendant is prohibited from possessing, transferring or acquiring any other weapons for the duration
of this order.
[XI 7. The following additional relief is granted:
Defendant shall stay at least 100 yards away from the Plaintiff, the protected persons, and Plaintiff's
residence.
[X] 8. A certified copy of this Order shall be provided to the police department where Plaintiff resides and
any other agency specified hereafter:

UNTIL MODIFIED OR TERMINATED BY THIS COURT AFTER NOTICE AND HEARING.
NOTICE TO THE DEFENDANT
Defendant is hereby notified that violation of this Order may result in arrest for indirect criminal
contempt, which is punishable by a fine of up to $1,000.00 and/or up to six months in jail. 23 Ps.C.S § 6114.
Consent of the Plaintiff to Defendant return to the residence shall not validate this Order, which can only be
changed or modified through the filing of appropriate court papers for that purpose. 23 Pa.C.S. § 6113.
Defendant is further notified that violation of this Order may subject him/her to state charges and penalties
under the Pennsylvania Crimes Code and to federal charges and penalties under the Violence Against Women
Act, 18 U.S.C. §§ 2261-2262.
NOTICE TO LAW ENFORCEMENT OFFICIALS
This Order shall be enforced by the police who have jurisdiction over the plaintiffs residence OR any
location where a violation of this order occurs OR where the defendant may be located. If defendant violates
Paragraphs 1 through 6 of this Order, defendant may be arrested on the charge of Indirect Criminal Contempt.
An arrest for violation of this Order may be made without warrant, based solely on probable cause, whether
or not the violation is committed in the presence of law enforcement.
Subsequent to an arrest, the law enforcement officer shall seize all weapons used or threatened to be
used during the violation of this Order OR during prior incidents of abuse. Weapons must forthwith be
delivered to the Sheriffs office of the county which issued this Order, which office shall maintain possession
of the weapons until further Order of this court, unless the weapon/s are evidence of a crime, in which case,
they shall remain with the law enforcement agency whose officer made the arrest.

unknown.

10. There is an existing court Order entered by this Court regarding the children's custody. The Court
Order of June 8, 1999 (appended hereto) suspends the Court Order of April 29, 1998, which gave
primary custody to Plaintiff and visitation rights to Defendant. The Court Order of June 8, 1999
suspends Defendant's visitation rights pending further hearing on the matter.
11. The following other minor children presently live with Plaintiff:

12. The facts of the most recent incident of abuse are as follows:
Defendant has committed acts of abuse against minors on whose behalf this action
has been brought. Plaintiff learned from Molly Orris and Quinn Orris as well as
from Defendant's step-mother, that during the weekend of May 30, 1999, while
Molly and Quinn were in custody of Defendant, Defendant threatened to kill
herself and Molly and Quinn by crashing her car into a tree. The minor children
were frightened by Defendant's words and conduct and later told Plaintiff of the
events. Defendant's step-mother confirmed the incident with Plaintiff. During
this same weekend, Defendant assaulted her step-mother, who had to seek medi-
cal attention. Due to Defendant's conduct in these circumstances, Plaintiff
believes the Defendant's threats to be real and substantial, and Plaintiff fears for
the safety of his children and family.
On June 21, 1999, at about 7:00 pm at Plaintiff's residence, Defendant phoned
the Plaintiff and told him that she was going to wait outside of the Plaintiff's
home until she had a chance to take the parties' children, Molly and Quinn, in
violation of the Court's Order of June 8, 1999. On two separate occasions in the
last 30 days, Defendant has had in-patient treatment for drug/alchohol problems
and/or mental health problems (manic depression). Because of Defendant's
mental condition and her previous threat, Plaintiff fears that his children are at
risk of imminent serious bodily injury.
13. Identify the police department or law enforcement agency in the area in which Plaintiff lives that should
be provided with a copy of the protection order:

14. There is an immediate and present danger of further abuse from the Defendant.
Defendant owes a duty of support to the minor children.
FOR THE REASONS SET FORTH ABOVE, I REQUEST THAT THE COURT ENTER A TEMPORARY
ORDER, and AFTER HEARING, A FINAL ORDER THAT WOULD DO THE FOLLOWING (CHECK ALL
FORMS OF RELIEF REQUESTED):
[X] A. Restrain Defendant from abusing, threatening, harassing, or stalking Plaintiff and parties to this action
in any place where Plaintiff or parties to this action may be found.
[X] B. Exclude Defendant from Plaintiff's residence and prohibit Defendant from attempting to enter any
temporary or permanent residence of the Plaintiff.
[XI C. Limit Defendant's temporary custody of the children that set out in this Court's Order of June 8, 1999,
in Civil No. 96-2576.
[X] D. Prohibit Defendant from having any contact with Plaintiff and minor children, personally or through
third persons, including but not limited to any contact at Plaintiff's school, business, or place of
employment, except as the court may find necessary with respect to partial custody and or visitation with
the minor children. Defendant may call the Plaintiff to speak with the parties' minor children, but only
between the hours of 6:30pm and 7:30pm on weekdays, and Plaintiff may monitor these calls if he so
desires.
[X] E. Prohibit Defendant from having any contact with Plaintiff's relatives and Plaintiff's children listed in
this Petition, except as the court may find necessary with respect to partial custody and/or visitation with
the minor children.
[X] F. Order the Defendant to temporarily turn over weapons to the Sheriff for this County and prohibit
Defendant from transferring, acquiring or possessing any such weapons for the duration of the Order.
[X] G. Direct Defendant to pay Plaintiff for the reasonable financial losses suffered as the result of the abuse,
to be determined at the hearing.
[X] H. Order Defendant to pay the costs of this action, including filing and service fees.
[X] I. Order the following additional relief, not listed above:
Defendant shall maintain at distance of at least 100 yards from Plaintiff, the parties' children, and
from Plaintiff's residence.
[X] J. Grant such relief as the court deems appropriate.

AND NOW, this(L day of July, 1999, upon consideration of Defendant's request for
continuance in the matter scheduled for hearing on June 30, 1999, at 3:00 p.m. by this Court's Order
of June 24, 1999, so that she may obtain representation, and by agreement of Plaintiff, by and
through his counsel, the Family Law Clinic, the hearing is hereby rescheduled on July 21, 1999, at
9:30 a.m. in Courtroom No. 3.
Defendant, Amy Jo Orris, was served with a certified copy of the Temporary Protection
From Abuse Order and Petition for Protection From Abuse on June 28, 1999, at her residence at 196
Hershey Road, Hummelstown, Dauphin County, Pennsylvania, by the Dauphin County Sheriffs
Department who were deputized by the Cumberland County Sheriffs Department.
The Temporary Protection From Abuse Order shall remain in effect for a period of one year
from the date it was entered, through June 24, 2000, or until further Order of Court, whichever
comes first.
A certified copy of this Order for Continuance shall be provided to the Lower Allen
Township Police Department and any other appropriate police department and/or law enforcement

MOTION TO DISCONTINUE PURSUANT TO Pa.R.C.P. 229 AND 2039(a)
The Plaintiff, William F. Orris, by his attorneys, The Family Law Clinic, moves the Court to
vacate the Temporary Order entered on behalf of his minor children, Molly E. Orris and Quinn H.
Orris, on June 24,1999, and to discontinue the action, without prejudice. The Plaintiff states:
1. On June 24, 1999, Plaintiff filed the above-captioned PFA case on behalf of his minor
children, Molly E. Orris, age 7, and Quinn H. Orris, age 5.
2. On June 24, 1999, the Court entered a Temporary Order.
3. A final hearing is set for July 21, 1999, at 9:30 a.m. in front of Judge Hoffer.
4. A related hearing on a petition to modify custody filed by Plaintiff was held in front of
Judge Bayley on July 8, 1999, in Civil No. 96-2576.
5. Plaintiff is satisfied that pursuant to the Court's Order of July 9, 1999, in the custody
case, the safety and welfare of his minor children, Molly E. Orris and Quinn H. Orris,
are no longer at risk. A copy of the Order is attached hereto.
6. It is in the best interests of the minor children, Molly E. Orris and Quinn H. Orris, to
discontinue the above-captioned Protection from Abuse action.
7. Diane Rupich, counsel for Defendant, concurs with the relief requested in this Motion.
8. Pa.R.C.P. 2039(a) states that "no action to which a minor is a party shall be
compromised, settled or discontinued except after approval by the court pursuant to a
petition presented by the guardian of the minor."
WHEREFORE, Plaintiff respectfully requests that this Court vacates the Temporary Order
of June 24, 1999, and discontinue the Protection From Abuse Action, No. 99-3847.
