ERIKA NICOLE SCHNEIDER Defendant LICENSE SUSPENSION APPEAL APPEAL OF OPERATOR' LICENSE SUSPENSION AND NOW, this 26th day of June, 1999, comes the Appellant, Erika Nicole Schneider, by and through her Attorney, Jane Adams, and respectfully appeals the suspension of driving privileges. 1. The Appellant, Erika Nicole Schneider, PA Operator Number 26122050, resides at 5007 Apache Drive, Mechanicsburg, Pa. 17055. 2. The Appellant, Erika Nicole Schneider, received a Notice of Suspension with a mail date of May 26, 1999. (See Exhibit # 1). 3. The aforesaid suspension of operator's privilege is for a period of ninety (90) days, effective June 30, 1999 at 12:01 am. 4. The suspension is a result of Appellant's conviction of violating Section 6308 (offenses related to alcohol). 5. Appellant did not have a driver's license or driver's permit at the time of conviction. 6. The loss of Appellant's license would create a severe hardship for Appellant. WHEREFORE, Appellant, Erika Nicole Schneider, respectfully requests this Honorable Court grant a hearing on this matter and enter a Supersedeas until such time that a hearing can be held. SCHNEIDER: As a result of your violation on 08/30/1998 of violating Section 6308 (offenses related to alcohol), your driving privilege is being SUSPENDED for a period of 90 DAY(S) as mandated by section 1532D of the vehicle code. In order to comply with this sanction you are required to return any current driver's licenser learner's permit and/or temporary driver's license (camera card) in your possession no later than the effective date listed. If you cannot comply with the requirements stated above, you are required to submit a DL16LC Form or a sworn affidavit stating that you are aware of the sanction against your driving privilege. Failure to comply with this notice shall result in this Bureau referring this matter to the Pennsylvania State Police for prosecution under SECTION 1571(a)(4) of the Vehicle Code. Although the law mandates that your driving privilege is under suspension even if you do not surrender your license, Credit will not begin until all current driver's license product(s), the DL16LC Form, or a letter acknowledging your sanction is received in this Bureau. WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGEMENT, WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY. OTHERWISE, YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS SANCTION.
